DECLARATION
of 1 September 2006
on the implementation of certain provisions of the Breeding Act
The Ministry of Agriculture provides, pursuant to Article 33 of Act No. 154 / 2000 Coll., on the breeding, breeding and registration of livestock and on the amendment of certain related laws (Breeding Act), as amended by Act No. 130 / 2006 Coll., ("the Act '), for the implementation of § 3 (1), § 5 (1), § 6 (9), § 7 (9), § 9 (4), § 10 (3), § 11 (5), § 12 (8), § 15 (5), § 16 (2), § 17 (5), § 18 (3), § 19 (3) and § 21 (10):
§ 1
This decree incorporates the relevant European Union1 provisions, and also builds upon the directly applicable European Union2 regulation and regulates the details of the breeding and breeding of bovine animals, zeba, Indian buffalo ("buffalo '), horses, donkeys, pigs, sheep, goats, poultry, breeding fish and bees.
§ 5
General provisions on testing
(K § 7 (9) of the Act)
In order to test and assess and identify data related to this, technical equipment shall be used to ensure this activity in accordance with the procedures laid down in breeding programmes of individual breeds.
§ 6
Testing and assessment of bovine, zeba and buffalo
(K § 7 (9) of the Act)
(1) The requirements for the content of records kept by authorised persons and breeders are set out in Annex 4 to this Decree, Part A.
(2) Authorised persons shall transmit the records to the person in the manner set out in Annex 4 to this Regulation, Part A.
§ 7
Testing and assessment of horses and donkeys
(K § 7 (9) of the Act)
(1) The requirements for the content of records of the results of testing and assessment of horses and donkeys are set out in individual breeding programmes of recognised breeding associations.
(2) If the testing and assessment of anti-doping tests for the identification of doping substances are included and the result of these tests is positive, the result of the performance test shall not be included in the evaluation of the animal.
(3) The recognised breeders' associations and beneficiaries shall transmit the records to the delegate on an ongoing basis and by 31 January of the following calendar year at the latest.
(4) The recognised breeders' associations and beneficiaries shall transmit to the delegate the list of competitions referred to in Article 7 (6) of the Act by 31 January of the calendar year for which the list of competitions is transmitted.
§ 8
Testing and assessment of pigs
(K § 7 (9) of the Act)
(1) The requirements for the content of the records kept by authorised persons and breeders are set out in Annex 4 to this Decree, Part B.
(2) Authorised persons shall transmit the records to the person responsible in the manner set out in Annex 4 to this Order, Part B.
§ 9
Testing and assessment of ovine and caprine animals
(K § 7 (9) of the Act)
(1) The requirements for the content of records kept by authorised persons and breeders are set out in Annex 4 to this Decree, Part C.
(2) Authorised persons shall transmit the records to the person in the manner set out in Annex 4 to this Order, Part C.
§ 10
Testing and assessment of poultry
(K § 7 (9) of the Act)
(1) The requirements for the content of records kept by authorised persons and breeders are set out in Annex 4 to this Decree, Part D.
(2) Authorised persons shall transmit the records to the authorised person in the manner set out in Annex 4 to this Order, Part D.
§ 11
Testing and assessment of breeding fish
(K § 7 (9) of the Act)
(1) The requirements for the content of the records of the results of testing and assessment of breeding fish are set out in individual breeding programmes of recognised breeding associations.
(2) Recognised breeders' associations and beneficiaries shall transmit the records to the delegate on an ongoing basis and by 28 February of the following calendar year at the latest.
(3) An authorised person in cooperation with a recognised breeding association publishes the results of the testing and assessment of fish whenever a new generation of breeding fish is included.
§ 12
Testing and assessment of bees
(K § 7 (9) of the Act)
The requirements for the content of records kept by authorised persons and breeders are set out in Annex 4 to this Decree, Part E.
§ 14
Requirements for the content of the herd book and breeding register
(K § 9 (2) of the Act)
(1) The Order of the herd-book contains:
(a) the form of keeping the herd-book;
(b) the manner in which the herd-book is broken down;
(c) the conditions for the registration of breeding animals in the herd book, with the exception of the rules of the horse herd books;
(d) the requirements for the entry of animals and their progeny in individual sections and separation of the herd-book;
(e) the method of identification of breeding animals;
(f) the conditions for issuing the zootechnical certificate and the certificate of origin of breeding animals and their presentation;
(g) the organs of the herd-book;
(h) the method of financing the herd-book;
(i) the rules of procedure referred to in Annex I (1) (B) (1) (b) to the Regulation on breeding animals; where it is not contained in the statutes or any other separate document recognised by the breeding association.
(2) The breeding register shall contain:
(a) the form of keeping a breeding register;
(b) the manner in which the breeding register is broken down;
(c) conditions for the registration of breeding animals in the breeding register;
(d) the requirements for the entry of animals and their progeny in individual sections and separation of the breeding register;
(e) the method of identification of breeding animals;
(f) the conditions for issuing the zootechnical certificate and the certificate of origin of breeding animals and their presentation;
(g) the authorities of the breeding register,
(h) the method of financing the breeding register; and
(i) the rules of procedure referred to in Annex I (1) (B) (1) (b) to the Regulation on breeding animals; where it is not in another separate document of the pig breeding establishment.
§ 15
Requirements for the content of the order of breeding records of poultry
(K § 10 (3) of the Act)
The order of the breeding register of poultry shall include:
(a) records of the origin of each breeding animal;
(b) records of reproduction and utility;
(c) the types of productive poultry,
1. records of origin of grandparents' flocks and parent flocks,
2. records of the number of poultry in the strains and the number of poultry included in the individual laying control;
3. records of the number of pedigree hatched and marked pups stopped for breeding.
§ 16
Requirements for the content of the breeding register of breeding fish
(K § 10 (3) of the Act)
The order of breeding records of breeding fish shall contain the information set out in Annex 5 to this Regulation, Part A.
§ 17
Requirements for the content of the herd register of bees
(K § 10 (3) of the Act)
The order of the breeding register of bees shall contain the information set out in Annex 5 to this Regulation, Part B.
§ 18
Requirements for the content of certificates of origin for breeding animals
(Paragraph 11 (5) of the Law)
(1) Article 30 of the Regulation on breeding animals shall apply mutatis mutandis to certificates of origin for bovine, zeba and buffalo animals.
(2) Article 30 of the Ordinance on breeding animals shall apply mutatis mutandis to certificates of origin for ovine and caprine animals.
(3) For the certificate of origin of pigs and the proof of origin of pigs, Article 30 of the Ordinance on breeding animals shall apply mutatis mutandis.
(4) Article 30 of the Ordinance on breeding animals shall apply mutatis mutandis to the certificate of origin of horses and donkeys.
(5) The certificate of origin of the fish contains:
(a) the name and address of the person keeping the breed register of the breed concerned;
(b) the registration number of the breeding animal in the breeding register;
(c) means of identification,
(d) the identification number of the breeding animal;
(e) date of the swab, date of fouling and diagnostic characteristics,
(f) breed, line or population, as appropriate;
(g) the sex of the breeding animal;
(h) the name and, where applicable, the name, surname and permanent residence or the name and address of the breeder in whose breeding the breeding animal has been established;
(i) the name and, where applicable, the name, surname and permanent residence or the name and address of the owner;
(j) bilateral origin of at least two generations of ancestors, unless otherwise provided for in the rules of breeding records;
(k) the date of issue of the certificate of origin; and
(l) the signature of the person authorised to act on behalf of the recognised breeding association which issued the certificate of origin.
(6) The certificate of origin of breeding poultry contains:
(a) the species of breeding poultry;
(b) the registration number of the breeding animal in the breeding register;
(c) the date of hatching;
(d) the sex of the animal;
(e) the name and, where applicable, the name, surname and permanent residence or the name and address of the breeder;
(f) the name and, where appropriate, the name, surname and permanent residence or the name and registered office of the owner;
(g) the origin from the father to 3 generations of ancestors, from the mother to 2 generations of the father's line,
(h) the date of issue of the certificate of origin; and
(i) the signature of the person authorised to act on behalf of the recognised breeding association which issued the certificate of origin.
(7) The certificate of origin of the mother bees contains:
(a) the full registration number of the mother;
(b) the name of the breeding operation;
(c) the level of breeding;
(d) the date of hatching of the mother,
(e) the date of dispatch; and
(f) the identification mark of the mother, which is the colour and number of the mark.
§ 19
Certificate of origin of the flock
(Paragraph 11 (5) of the Law)
(1) The certificate of origin of the flock shall contain:
(a) the name and, where appropriate, the name, surname and permanent residence or the name and address of the breeder who carries out the breeding of the breeding programme from which the hatching eggs or breeding poultry originate;
(b) the method of identification of hatching eggs or breeding poultry;
(c) the number of hatching eggs or the number of breeding poultry by sex;
(d) age of hatching eggs, age of breeding poultry on the day of issue of the certificate of origin of the flock;
(e) the name and designation of hatching eggs or breeding poultry;
(f) the degree of multiplication of hatching eggs or breeding poultry;
(g) the last name, name and permanent residence or the name and address of the breeder;
(h) the farm registration number and the code of the cadastral territory where the poultry is kept;
(i) the date of issue of the certificate of origin,
(j) the signature of the person authorised to act on behalf of the recognised breeding association which issued the certificate of origin and, where appropriate, the stamp thereof.
(2) The certificate of origin of a flock of productive types of breeding poultry shall be issued for one cross-sectional combination for the whole flock.
§ 20
Details of the particulars of the certificate of origin for poultry flocks moved from or imported from the Member States of the European Union
(Paragraph 11 (5) of the Law)
The certificate of origin for poultry flocks moved from or imported from the Member States of the European Union shall contain:
(a) the name and, where appropriate, the name, surname and permanent residence or the name and address of the breeder who carries out the breeding of the breeding programme from which the hatching eggs or breeding poultry originate;
(b) the country of origin,
(c) proof of identification of hatching eggs or breeding poultry issued in the country of origin;
(d) the number of hatching eggs or the number of breeding poultry by sex;
(e) the age of breeding poultry on the date of issue of the certificate of origin;
(f) the name and designation of hatching eggs or breeding poultry;
(g) the degree of multiplication of hatching eggs or breeding poultry;
(h) the name of the output product from the propagation stage;
(i) the last name, name and permanent residence or the name, registered office and identification number of the breeder, if any;
(j) the registration number of the holding where the poultry is kept;
(k) the date of issue of the certificate of origin,
(l) the signature of the authorised person who issued the certificate of origin and, where appropriate, the stamp thereof.
§ 21
Details of data on certificates of verification of origin and genetic type determination
(Paragraph 12 (8) of the Law)
(1) The certificate of verification of origin and the genetic type certificate shall contain:
(a) the laboratory number under which the breeding animal is kept in the database of the authorised person;
(b) identification number of the tested animal, name, if known, breed, year of birth, sex,
(c) identification of the parents in horses at all times, for other species of animals in the case of verification of origin, their name, if known, of the breed;
(d) a source of DNA which means the biological material from which the DNA was derived,
(e) the date of verification of the origin or determination of the genetic type;
(f) the result of verification of origin or determination of the genetic type.
(2) The result of the verification of origin or determination of the genetic type shall be expressed by:
(a) "origin agrees with those parents," if the combination of genetic types of parents is compatible with the genetic type of offspring;
(b) "origin does not agree with those parents" if the combination of genetic types of parents is incompatible with the genetic type of offspring, namely:
1. "origin does not agree with those parents - father does not agree,"
2. "origin does not agree with those parents - mother does not agree,"
3. 'origin does not agree with those parents - both parents do not agree'; or
4. "origin does not agree with those parents - it is not possible to determine which parents do not agree,"
(c) "origin agrees with the father referred to in the first place, provided the mother is correct," if more than one possible father has been mentioned and all of them have been excluded from the first place,
(d) "origin cannot be verified" if there is no genetic type of one or both parents (in the case of breeding fish of parent flocks) or of more than one father, two or more fathers may not be excluded; or
(e) "basic testing" means the confirmation that the genetic type of the animal, in the breeding fish of the tested flock, has been included in a database of genetic types kept by the authorised person in order to enable the origin of its offspring to be verified.
§ 22
Details of the management of the central register of breeders
(Paragraph 15 (5) of the Law)
The data registered in the central register of breeders are set out in Annex 6 to this decree.
§ 23
Details of the keeping of operational records and transmission of such records to the delegate
(Paragraph 16 (2) of the Law)
The requirements for the content of the operating records kept at the semen collection centre are set out in Annex 7 to this Decree. Operating records shall be transmitted to the authorised person, where justified on request, within 14 days.
§ 24
Details of keeping records of insemination and transmission of such records to the breeder and to the delegate
(Paragraph 17 (5) of the Law)
The requirements for the content of the records on the conduct of the insemination and the details of the transmission of those records to the person responsible are set out in Annex 8 to this Order.
§ 25
Technical assistance to ensure proper and secure implementation of insemination
(Paragraph 17 (5) of the Law)
For proper and safe examination of the breed and for insemination, the breeder shall ensure
(a) for the person authorised to carry out the insemination
1. separate space, in particular for the storage of aids or clothing,
2. source of hot water,
3. document for the insemination records;
