GOVERNMENT REGULATION
of 14 December 2011
amending Government Regulation No. 77 / 2008 Coll., on the establishment of the thresholds for the purposes of the Act on Public Procurement, on the definition of goods acquired by the Czech Republic - Ministry of Defence, for which a specific financial limit applies, and on the conversion of the amounts laid down in the Act on Public Procurement in Euro into Czech currency, as amended, and Government Regulation No. 78 / 2008 Coll., establishing financial limits for the purposes of the Concession Act, as amended by Government Regulation No. 474 / 2009 Coll.
The Government hereby orders pursuant to § 159 (1) to implement § 12 (1) and § 154 of Act No. 137 / 2006 Coll., on Public Contracts, as amended, and § 34 (3) to implement § 14 (1) and § 15 (1) (b) of Act No. 139 / 2006 Coll., on Concession Contracts and Concession Procedure (Concession Act), as amended:
Amendment to Government Decree No. 77 / 2008 Coll., on the setting of the thresholds for the purposes of the Act on Public Procurement, on the definition of goods procured by the Czech Republic - Ministry of Defence, for which a specific financial limit applies, and on the conversion of amounts set out in the Act on Public Procurement in Euro into Czech currency, as amended
Government Regulation No. 77 / 2008 Coll., on the establishment of the thresholds for the purposes of the Act on Public Procurement, on the definition of goods acquired by the Czech Republic - Ministry of Defence, for which a specific financial limit applies, and on the conversion of amounts laid down in the Act on Public Procurement in Euro into Czech currency, as amended by Government Regulation No. 474 / 2009 Coll. and Government Regulation No. 276 / 2011 Coll., is amended as follows:
1. in footnote 1, "(2009 / C 292 / 01) 'is replaced by" (2011 / C 353 / 01)';
2. footnote 2 shall read:
"(2) Commission Regulation (EU) No 1251 / 2011 of 30 November 2011 amending Directives 2004 / 17 / EC, 2004 / 18 / EC and 2009 / 81 / EC of the European Parliament and of the Council as regards the thresholds used in the procurement procedures."
3. In § 2 (1) (a) and § 2 (2) (a) the amount "3 236 000 CZK" is replaced by "3 256 000 CZK."
4. In § 2 (1) (b) and § 2 (2) (b) of the introductory part of the provision, the amount "4 997 000 CZK" is replaced by "5 010 000 CZK."
5. In § 2 (1) (c), § 2 (2) (c) and § 2 (4) (a), the amount "10 020 000 CZK" is replaced by "10 021 000 CZK."
6. In § 2 (3) and § 2 (4) (b) the amount "125 451 000 CZK" is replaced by "125 265 000 CZK."
7. In § 3 (a), the amount "19 419 000 CZK" is replaced by "18 789 000 CZK."
8. In § 3 (b), the amount "CZK 2 071 000" is replaced by "CZK 2 004 000."
9. In § 3 (c), "25 893 000 CZK 'is replaced by" 25 053 000 CZK'.
Amendment of Government Regulation No. 78 / 2008 Coll., setting financial limits for the purposes of the concession law, as amended by Government Regulation No. 474 / 2009 Coll.
Government Regulation No. 78 / 2008 Coll., setting financial limits for the purposes of the concession law, as amended by Government Decree No. 474 / 2009 Coll., is amended as follows:
1. in footnote 1, "(2009 / C 292 / 01) 'is replaced by" (2011 / C 353 / 01)';
2. footnote 2 shall read:
"(2) Commission Regulation (EU) No 1251 / 2011 of 30 November 2011 amending Directives 2004 / 17 / EC, 2004 / 18 / EC and 2009 / 81 / EC of the European Parliament and of the Council as regards the thresholds used in the procurement procedures."
3. In Article 2 (1) and (2), "CZK 125 451 000 'is replaced by" CZK 125 265 000'.
EFFECTIVE
This Regulation shall enter into force on 1 January 2012.
