GOVERNMENT REGULATION
of 12 November 2021
amending Government Regulation No 401 / 2015 Coll., on the characteristics and values of permissible pollution of surface water and waste water, the formalities for authorisation to discharge waste water into surface water and sewerage and sensitive areas
The Government orders pursuant to § 38 paragraph 10 of Act No. 254 / 2001 Coll., on Water and on the Amendment of Certain Laws (Water Act), as amended by Act No. 20 / 2004 Coll., Act No. 150 / 2010 Coll. and Act No. 113 / 2018 Coll.:
Government Decree No. 401 / 2015 Coll., on the parameters and values of permissible pollution of surface water and waste water, the formalities for the authorisation to discharge waste water into surface water and sewerage and sensitive areas are amended as follows:
1. in the last sentence of Article 6 (2), in the last sentence of Article 8 (2), in the first sentence of Article 11 (4) and in Annex 3 (B) (1) to the second sentence of Part 3, the word "defective" shall be inserted after the word "dangerous."
2. In Paragraph 8 (1), the words "substances or particularly dangerous substances not listed in Annex 1 to this Regulation 'are replaced by the words" defective substances'.
3. in the first sentence of Article 9 (4), in the first sentence of Article 11 (4), in the first and last sentences of Article 12 (2) and in Annex 1 (B) (7) to Table 2, the word "defective" shall be inserted after the word "dangerous."
4. In the last sentence of Article 11 (4), the word "defective 'shall be inserted after the word" dangerous'.
5. In the first sentence of Article 12 (3), the words "containing particularly dangerous substances not listed in Table 3 of Annex 1 to this Regulation and waste water 'are deleted and the word" defective' is inserted after the word "dangerous'.
6. In Paragraph 12 (4), the word "substances' is replaced by" defective substances or priority hazardous substances';
7. In Annex 1, Part A Table 1a is inserted "* 'in the first row of the table after the text" Pcelk'.
8. In Annex 1, Part A, note 1, to Table 1a, sixth sentence, the number "1 'is deleted after the word" table'.
9. in Annex 1, Part A, Notes 3) and 5) to Table 1a of the last sentence and Annex 1, Part A, Note 2) to Table 1b of the last sentence, the words "3) to Table 1" are replaced by the words "2) to the table."
10. In Annex No 1, Part B, Table 2, point 20.12 reads:

12. in Annex 1, Part B, Table 2, point 75.00, the reference to footnote 16 is deleted.
13. in Annex 1, Part B, footnote (a) to Table 2, the words "unless otherwise specified" shall be added at the end of the first sentence.
14. in Annex 1, Part B, note (a) to Table 2, last sentence, the words "A or B or C" are deleted and the words "3) to Table 1" are replaced by the words "2) to the Table."
15. in Annex 1, Part B, Note 14) to Table 2:
"(14) In the case of waste incineration plants and co-incineration plants, waste water from the cleaning of gases. The concentration limit values shall be considered to be met if:
(a) for undissolved substances 95% daily (points) of the measured values or measurements of representative samples proportional to the flow rate over 24 hours shall not exceed the limit value of 30 mg / l and no value shall exceed 45 mg / l;
(b) for heavy metals and arsenic, no value in representative samples proportional to the flow rate over 24 hours taken at least once a month does not exceed the concentration limit value; and
(c) for dioxins and furans measured every 6 months, the first year of operation every 3 months, no measured value shall exceed the concentration limit value.
The limit values shall be observed at the place where the waste water from the flue gas treatment plant containing the scheduled substances is discharged from the incineration or co-incineration plant into the aquatic environment. Where waste water from flue gas treatment is cleaned outside the incineration or co-incineration plant at a waste water treatment plant intended for the treatment of only this type of waste water, the limit values shall apply to the effluent from that waste water treatment plant. Where waste water from waste gas treatment is cleaned at the site of its formation together with waste water from other sources in the combustion plant, the operator shall carry out measurements of:
(a) in the waste water flow from the waste gas treatment process prior to admission to the common waste water treatment plant;
(b) in the flows or flows of other waste water prior to their admission to a common waste water treatment facility; or
(c) at the point of final discharge of waste water after treatment from waste incineration plants or waste co-incineration plants.
Where flue gas treatment waste water is cleaned on or off site together with other waste waters, the limit values shall be recalculated in a balance sheet.
The permit shall provide for operational continuous control measurements of waste water, at least pH, temperature and flow. ';
16. in Annex 1, Part B, the following entries 27a to 27d are inserted after footnote 27) to Table 2:
"27a) In the case of more than 1 ore type, the above emission limit values shall be applied in proportion to the quantity of these ores used.
27b) When using neutral rutile.
27c) When using synthetic rutile.
27d) When using slag. '
17. In Annex No 1 to Part C of the title, Annex No 1 to Part C of the title of Table 3 and Annex No 3 to Part B of the title of Table 3, the word "defective 'shall be inserted after the word" dangerous'.
18. In Annex 3, Part A, Notes 1 to 16 to Table 1a are deleted, including references to notes.
19. in Annex 3, Part A, footnote F) to Table 1a, the words "Decree No. 307 / 2002 Coll., as amended," are replaced by the words "Decree No. 422 / 2016 Coll., on Radiological Protection and Security of Radionuclide Source."
20. In Annex 3, Part A Table 1b is replaced by "0,017 'in column NEC for indicators benzo [b] fluoranthene and benzo [k] fluoranthene.
21. In Annex 3, Part A footnote to Table 1b is replaced by "Substances' and the words" or priority hazardous substances' are added at the end of the note.
22. in Annex 3, Part A, note 10) to Table 1b, the word "polyaromatic" is replaced by "polycyclic aromatic."
23. In Annex 3, Part A Table 1c is replaced by the following:

25. In Annex 3, Part A, Notes 17 to 27 to Table 1c are deleted, including references to notes.
26. in Annex 3, Part A, footnote G) to Table 1c, the words "Decree No 307 / 2002 Coll., as amended," are replaced by the words "Order No 422 / 2016 Coll."
27. In Annex 3, Part A Table 1c is the sentence "Note: Priority substances marked with the symbol" * 'are particularly dangerous defective substances.';
28. In Annex 3, Part A, Note 3) to Table 1c is deleted.
29. In Annex 6, row 28, the word "polyaromatic 'is replaced by" polycyclic aromatic'.
30. In Annex 7 to the heading of the table, the words "indicated under Tables 1a and 1b 'are replaced by the words" to Tables 1a and 1b'.
Efficacy
This Regulation shall take effect on 1 January 2022.
