DECLARATION
of 5 February 2010
amending Decree No. 29 / 2004 Coll., implementing Act No. 149 / 2003 Coll., on trade in forest reproductive material
The Ministry of Agriculture provides pursuant to Section 39 of Act No. 149 / 2003 Coll., on the putting into circulation of forest reproductive material of forest important species and artificial cross-breeds intended for forest renewal and afforestation, and on the amendment of certain related laws (Act on trade in forest reproductive material) ("the Act '):
Čl. I
Decree No. 29 / 2004 Coll., implementing Act No. 149 / 2003 Coll., on trade in forest reproductive material, is amended as follows:
1. Paragraph 1 (10), including footnote 4, reads:
"(10) Reproduction material may only be put into circulation if it does not exhibit harmful organisms (4). Reproductive material found to be infected with harmful organisms (4) subject to exceptional plant health measures shall be demonstrably excluded from further use.
4) Act No. 326 / 2004 Coll., on Plant Health and on the amendment of certain related laws, as amended. '
2. In the second sentence of Article 2 (2) and in the second sentence of Article 2 (3), the words "the code of the region of provenance and the code of the number of the height band 'are replaced by the words" the five-digit code, where the character is 9 in the first place and the other four places are composed of the serial number of the newly created section, assigned by the person authorised by the Ministry'.
3. In Article 2, the following paragraph 6 is inserted after paragraph 5:
"(6) If the conditions set out in Section 5 (4) of the Act are met, it is permissible to combine sections within the category of identified reproductive material or within the category of selected reproductive material originating from a single recognised unit of different maturing year, indicating the relevant maturing years and the proportion of reproductive material per year. '
Paragraph 6 shall become paragraph 7.
4. In Paragraph 3 (2), "14 'is replaced by" 14a'.
5. In Article 3 (3), the first sentence is deleted.
6. In Article 5 (5), the words "Part B of the movement certificate (accompanying labels) 'are replaced by the words" Both parts of the movement certificate'.
7. In Article 5, the following paragraph 6 is added:
"(6) Where a supplier is entitled to issue plant passports under another legislation (4), the accompanying sheet and the accompanying label shall serve as a plant passport (5) for the genera or species of wood provided for in this Regulation.
(5a) Article 15 of Decree No 215 / 2008 Coll., on measures to prevent the introduction and spread of harmful organisms of plants and plant products, as amended. '
8. In the first sentence of Paragraph 13 (2), the word "renewal 'is replaced by" outline'.
9. In Article 13, the following paragraph 5 is added:
"(5) The code of the gene base designation shall be assigned by the authorised person.";
10. in Paragraph 14 (1) (a), the words ", date of birth, birth number, where assigned, place and district of birth," shall be inserted after the words "name and surname."
11. in Article 14 (1), at the end of point (f), the comma is replaced by a dot and point (g) is deleted;
12. in Article 14 (2) (f), the words', date of birth, birth number, place and district of birth 'shall be inserted after the word "surname."
13. in Paragraph 14 (2), the comma at the end of point (h) is replaced by a dot and point (i) is deleted;
14. in Article 15 (4) (c) and (5) (b), "15 November" is replaced by "30 November."
15. In Article 15 (6), the introductory part of the provision reads: "Each section of reproductive material held before 30 November of the calendar year or put into circulation before 30 November of the calendar year shall be recorded by the supplier responsible for the person by 15 December of that calendar year."
16. Annex 2 shall read as follows:

POZNÁMKY:
Výška nadzemní části - U semenáčků a sazenic o minimální výšce 10 cm, resp. 15 cm (číselný znak 1, 2 a 5) je tolerance výšky nadzemní části až o 5 cm povolena pouze směrem nahoru s výjimkou borovice lesní a borovice černé, kde se připouští tolerance výšky nadzemní části také směrem dolů, a to až o 3 cm. U všech ostatních rozpětí výšky nadzemní části je povolena tolerance směrem nahoru i dolů až o 5 cm.
Tloušťka kořenového krčku - U všech rozpětí výšek nadzemní části při splnění ostatních parametrů kvality, určených pro dané výškové rozpětí, je u nejmenší tloušťky kořenového krčku povolena 10 % tolerance směrem dolů s výjimkou krytokořenných semenáčků z výsevů do pěstebních obalů, pěstovaných po dobu maximálně jednoho roku (s vyloučením nepřípustných vad dle Přílohy č. 5), u nichž je povolena tolerance nejmenší tloušťky kořenového krčku směrem dolů až o 1 mm. Obojí uvedené tolerance nejsou povoleny v případech, kdy je minimální tloušťka kořenového krčku stanovena na 3 mm.
ODKAZY A JEJICH SPECIFIKACE:
a) nejmenší tloušťka kořenového krčku v mm
b) při pěstování sadebního materiálu z 8. a 9. lesního vegetačního stupně lze zvýšit maximální věk o 1 rok
c) pouze krytokořenné semenáčky, prostokořenné semenáčky se nepřipouští
d) při výšce nadzemní části do 35 cm se u prostokořenných semenáčků připouští tloušťka kořenového krčku 4 mm
e) u krytokořenných sazenic smrku ztepilého z výsevů do pěstebních obalů, pěstovaných po dobu maximálně dva roky (s vyloučením nepřípustných vad dle Přílohy č. 5), se připouští nejmenší tloušťka kořenového krčku 4 mm bez další tolerance směrem dolů
f) Vzhledem ke geneticky podmíněné růstové variabilitě je u sazenic smrku ztepilého původem z 8. lesního vegetačního stupně hlavním kritériem výsadbyschopnosti tloušťka kořenového krčku při dodržení ostatních parametrů kvality. U všech rozpětí výšek nadzemní části sazenic se připouští tolerance 10 cm nahoru i dolů.“.

Formula for age labelling and cultivation of planting material
The cultivation method is marked graphically, where the first number indicates the number of growing periods before the training, cutting or incorporation into the packaging, the second number indicates the number of growing periods after this intervention (both within 0,5 years). The sum of the numbers in the formula indicates the period of cultivation in the nursery, except for topol cutters where the above part has been cut.
Graphics symbols:
+ is marked with training or inclusion in packaging;
- the cutting of the roots is marked;
f cultivation in an artificial housing (foils, greenhouse, parchment);
for growing in packaging (roofed planting material);
p natural rejuvenation;
of roasting;

Examples of designation of planting material:

0,5-0,5 is a single-year seedling grown in uncovered mineral soil; the root system has been cut during the growing season

25. In Annex 19, points 6 and 7 are added:
'6. Grades of phenotypic class C
Grades of phenotypic class C shows average economic values and a less satisfactory health condition. For the trees listed in Section 3 (2) of the Act, seed shall not be harvested from the crops of this category (but may be recovered naturally), other trees shall be collected if recognised as a source identified.
7. Objects of phenotypic class D
Grades of phenotypic class D is genetically and economically inappropriate (below average economic values), or crops with clearly impaired health status or significantly impaired stability. The seed shall not be harvested and natural renewal shall not be possible; these crops must be gradually restored and replaced by more genetically valuable crops. ';
26. in Annex No 20, point (4), the words "the value of the character: according to Annex No 4 to Decree No 83 / 1996 Coll. - the three-digit character" shall be replaced by "the maximum three-digit character assigned by the person responsible."
27. in Annex 20 (9):

'6. Species purity:
In the case of closely related species of wood (e.g. summer and winter oak), the species purity (representation of individual species on the crop) shall be assessed. ';

Requirements for the recognition of sources for the production of qualified reproductive material
1. Seed sets
(1) Documentation (localization of the set, type of wood, quality of the starting individuals - ortets, target, cross-sectional plan and location chart, components and data on their provenance, isolation, station conditions) and any change of these parameters must be approved and registered by the authorised person.
(2) The relevant clones are selected for their exceptional characteristics, paying particular attention to the criteria:
(a) Age and stage of development: the crops must be made up of trees whose age and stage of development permit the use of selection criteria.
(b) Adaptability: it must be clear that the crop is adapted to environmental conditions in the area of provenance.
(c) Health status and resistance: trees in the crops must not be contaminated by harmful organisms and must be resistant to adverse habitat and climatic conditions at the place of occurrence, except for damage caused by environmental pollution.
(d) Production volume: for the recognition of selected crops, the volume of timber production in the normal case must be higher than the mean value applicable to comparable ecological and economic conditions.
(e) Quality of wood: in some cases it may be an essential selection criterion.
(f) Shape and habitat: trees in the crops must exhibit particularly good morphological characteristics, in particular the directness and circling of the strain, the good shape and size of the branches and the good ability of natural branching. Moreover, forkbeard and spiralously grown strains should occur in a small extent.
(3) The relevant clones or families must or must have been planted in accordance with a plan approved by the authorised person and drawn up in such a way that each component of the clones is identified.
(4) Educational interventions in seed orchards shall be described together with the selection criteria applied to them and registered by the authorised person.
(5) The seed sets should be managed and the reproductive material harvested in such a way as to achieve the aim of the seed set. In the case of seed sets intended for the production of artificial cross-breeds, the percentage of cross-breeds on the reproductive material shall be demonstrated by analysis.
2. Family parents
(1) Family parents shall be chosen for their exceptional characteristics, in particular the criteria referred to in point 1 (2), or for their combined capacity.
(2) The objective, the interbreeding plan, the pollination method, the components, the insulation, the location and any modification of these parameters must be approved and registered by the authorised person.
(3) The identity, number and proportion of parents in the mixture must be approved and registered by the authorised person.
(4) In the case of parents of a family intended for the production of artificial cross-breeds, the percentage of cross-breeds on reproductive material should be demonstrated by analysis.
3. Clones
(1) Ortets used for the production of clones are selected for their exceptional characteristics, in particular the criteria referred to in point 1 (2).
(2) Clones must be identifiable on the basis of distinguishing marks approved and registered by the authorised person.
(3) The quality of clones is determined on the basis of experience or has been demonstrated by long-lasting experiments.
(4) The recognition of clones by a Member State shall be limited to the maximum number of years or to the maximum number of vegetative offspring (ramet).
4. Clone mixtures
(1) Clones must meet the requirements laid down in paragraphs 1, 2 and 3 of point 3.
(2) The identity, number and shares of clones contained in the mixture, the selection method and the initial clones must be approved and registered by the authorised person. Each mixture of clones must show sufficient genetic diversity.
(3) Recognition by a Member State shall be limited to the maximum number of years or to the maximum number of vegetative offspring (ramet). ';
