Ordinance on the treatment of revenue from railway freight, transport and express tickets, luggage cards and rail demand sheets

Decree of the Minister of Finance
of 7 March 1946
on the fixing of roll-on charges on railway loading lists, transport and express tickets, luggage cards and rail removal lists.
Under Articles 1 and 2, paragraphs 1, 3 and 6 of the Act of 19 February 1946, No 32 Coll., on the unification and adaptation of certain fee regulations, I declare in agreement with the Minister of Transport and for Slovakia also with the delegates of finance and transport and public works:
§ 1.
(1) In the Czech and Moravian-Silesian countries, the obligation to circulate the documents referred to in paragraph 2 is renewed on 16 March 1946.
(2) In view of the increase in the rates of fixed spreadsheets laid down in § 2 of Act No. 32 / 1946 Coll., the following rates of the stamp duties on railway freight sheets, transport and express tickets, baggage cards and rail removal sheets are now applicable throughout the national territory:
(a) for consignments, including live animals in containers weighing at least 5 000 kg or for which a wagon has been fitted for exclusive use, as well as consignments of live animals not transported in containers, excluding the cases referred to in (b), 8 Kccs;
(b) for all other consignments, excluding the consignments referred to in (c), and for consignments of pigs, sheep, goats, donkeys and small animals which are not transported in containers, provided that the same consignment note does not contain more than 4 of these animals, and then for consignments of empty private wagons, even if their actual weight is greater than 5000 kg, if they are transported free of charge or for discounted import, 2 Kccs;
(c) in the case of express goods and baggage, if they are charged a shipping fee or an interest in delivery fee, 1 CZK.
§ 2.
(1) In the countries of Czech and Moravian-Silesian, there is a cost of freight tickets and in domestic transport also of express tickets to be used in principle either
(a) by the use of an appropriate blanket issued by a railway administration with a stamp for 8 Kčs, 2 Kčs or 1 Kčs for a blank already printed in black; or
(b) by the use of an appropriate bill of lading issued by a private cargo, with a stamp of 8 Kns or 2 Kns of red and blue, officially imprinted.
(2) In Slovakia, the stamp duties on the bills of lading, the ticket and the bill of lading and the domestic transport are also to be fixed by the use of the appropriate bill of lading issued by the public administration with a stamp for 8 CZK, 2 CZK or 1 CZK for the blank already printed in black.
§ 3.
(1) The cost-transport package fee for inserts is the same as the fee for the document to which the insert is attached. They shall be prepared by gluing the stamp with the appropriate amount and degrading it with a railway stamp in black.
(2) If, after the contract of carriage has been negotiated, a bill of lading has been found to have been used with a wheel lower than the statutory rule, the fee shall be paid in accordance with the procedure referred to in the preceding paragraph.
(3) When using a blank with a stamp printed or officially printed stamp, it is not required to be degraded by a station stamp.
(4) If the consignment is presented by means of a bill of lading, express note, etc., on the basis of a fee exemption without a stamp, the bill shall explicitly state the legal reason for exemption from the stamp fee.
§ 4.
(1) The wheel fee for luggage tickets and express tickets for international transport is paid directly in cash. The selected fee is charged by the railway administration to the financial administration.
(2) In the Czech and Moravian-Silesian countries, the fee is also paid directly in cash for the ticket fee.
(3) However, the Ministry of Transport may, after prior agreement with the Ministry of Finance, withdraw the provisions of paragraph 2 on the provision of cash charges and state that the fees are adjusted by using the relevant stamp blanket. In this case, the provisions of Section 2 of this Decree shall apply mutatis mutandis.
§ 5.
(1) Shipments submitted abroad shall be issued by rail only if the consignee confirms the collection on a sample note, with a stamp for 8 Ccs, 2 Ccs or 1 Ccs on a printed blank. The Ministry of Transport may declare in an agreement with the Ministry of Finance that the consignee of the consignment is obliged to comply with the step obligation by attaching the stamp to the bill of lading, which shall be invalidated by the railway station stamp in black.
(2) The provisions of Section 3 (1) apply mutatis mutandis to the removal of loading lists, following other accompanying documents accompanying the consignment from abroad.
Transitional provisions.
§ 6.
In the Czech and Moravian-Silesian countries, either by applying the stamp of the stamp of the railway station in black or by using the blank issued by the railway administration (not yet registered), provided with an additional stamp of 8 Kčs, 2 Kčs or 1 Kčs of red and blue, are required to be used for temporary periods of time before the stocks are consumed.
§ 7.
In Slovakia, after 15 March 1946, the bills of ladle, tickets and ticket-holders with printed stamps 1.50 CZK may continue to be used only on condition that the value of the stamp printed on them is added to 2 Ccs or 8 Ccs mutatis mutandis in accordance with § 3, paragraphs 1 and 2.
§ 8.
In Slovakia, until the issue of express tickets in domestic transport by the cost of the financial administration (§ 2 (2)), the applicable tax should be paid directly in cash at the time of the express. The Railway Administration shall pay the fee thus collected to the Financial Administration.
§ 9.
This decree shall take effect on 16 March 1946.
