Ordinance on the establishment of sanitary limits of chemical, physical and biological indicators for the indoor environment of accommodation rooms of certain buildings

DECLARATION
of 13 February 2025
laying down health limits for chemical, physical and biological indicators for the indoor environment of certain buildings
According to § 108 (1) of Act No. 258 / 2000 Coll., on the Protection of Public Health and on the amendment of certain related laws, as amended by Act No. 167 / 2023 Coll., (hereinafter "the Act '), the Ministry of Health provides for the implementation of § 13 (1) of the Act:
§ 1
Subject matter
This decree sets out the hygiene limits of chemical, physical and biological indicators for the indoor environment of living rooms in construction pursuant to Section 13 (1) of the Act.
§ 2
Basic concepts
For the purposes of this decree:
(a) potential exposure to the duration of the intended residence of persons designated for use of the space;
(b) variability in concentration of the test substance in relation to time and space;
(c) a chemical and biological indicator of any substance or micro-organism introduced into, or derived from, the living room, which has, directly or may have, after physical or chemical transformation or co-operation with another substance, harmful effects on the environment or on material property,
(d) by the regulatory limit of the chemical and biological indicator, the maximum permitted level of pollution of the living rooms expressed in measured units per unit of volume, referring to the standard conditions considered to be 20 ° C / 293,15 K and a pressure of 101,325 kPa;
(e) the minimum and maximum values by the physical indicator limit;
(f) by a respiratory fibre particle with a diameter of 0,05 μm to 3 μm, a length of 5 μm and a length to width ratio of more than 3;
(g) asbestos, the common name for the group of naturally occurring fibrous silicates, which are divided into serpentines (chryzotile, Cas No 12001-29-5) and amphibolis (actinolite, Cas No 77536-66-4; amositi, Cas No 12172-73-5; anthophylite, Cas No 77536-67-5; crokydolite, Cas No 12001-28-4; tremolite, Cas No 77536- 68-6),
(h) biopersistent mineral fibre particles with a diameter of 0,05 μm to 3 μm, a length of 5 μm and a length-to-width ratio of more than 3 and belonging to substances of the first class of carcinogens (1A and 1B according to the classification laid down in the directly applicable European Union Regulation on the Registration, Evaluation, Authorisation and Restriction of Chemicals (1));
(i) other mineral fibre inert particles with a diameter of 0,05 μm to 3 μm, a length of 5 μm and a ratio of length to width greater than 3.
§ 3
Microclimatic conditions
(1) For operation in the indoor environment of the living rooms, the microclimatic conditions set out in Tables 1 to 3 of Annex 1 to this Decree shall be complied with. In sanitary facilities in the indoor environment of the living rooms, the minimum air temperature and the quantity of air carried shall be respected as set out in Table 3 of Annex 1 to this Decree.
(2) The internal average temperature in the indoor environment of the living rooms shall not fall below the minimum value set out in Table 1 of Annex 1 to this Decree in more than two consecutive days. In the event of a fall below this value, corrective action shall be provided, in particular by ensuring a stay in a temperature-free environment.
(3) The internal average temperature in the indoor environment of the living rooms shall not exceed the maximum value set out in Table 1 of Annex 1 to this Decree in more than two consecutive days. In the event of an increase above this value, a reduction of the heat load on persons present, in particular in the non-heat-loaded environment, shall be ensured and a drinking regime shall be provided for those present.
§ 4
Ventilation
(1) The living room must be directly ventilated, in the way that the outdoor air is brought into it naturally or forced directly.
(2) The supply of outdoor air is ensured by natural or forced exchange of air, possibly through a mixture of outdoor and circulatory air. Ventilation ensures the collection of resulting pollutants or heat-humidity loads in the living room.
(3) The quantity of air exchanged in the living room and the ventilation regime is determined in terms of the number of persons and activity performed. The measured interval, which shall represent the potential exposure of humans and the variability of the concentrations of the observed pollutants, shall not exceed 1 200 ppm of the arithmetic mean of carbon dioxide and shall not exceed 2 500 ppm during the measurement.
(4) The exhaust air outlets to the outdoor environment shall be so placed that the contaminated air is not sucked back into the surrounding living rooms.
(5) Systems and equipment providing air exchange, filtration and heat-humidity treatment of air must have regular technical maintenance and cleaning according to the manufacturer's or supplier's instructions, operating schedule or comply with the requirements of Czech technical standards governing ventilation requirements of building 2).
§ 5
Lighting
The requirements for daytime, combined and electric lighting in the indoor environment of the building living rooms are deemed to be met if they comply with the requirements of the Czech technical standards governing the lighting requirements (3).
§ 6
Chemical indicators
The requirements for the quality of the internal environment of the living rooms are met if the concentrations of the test substances under standard conditions do not exceed the limit concentrations of the chemical parameters listed in Annex 2 to this Regulation and in Section 7 and are set as one hour. The measured interval shall represent the potential exposure of humans and the variability of the concentrations of the observed pollutants.
§ 7
Particulate matter limit PM2,5
The requirements for the quality of the indoor environment of the living rooms are met unless the value of 50 μg / m3 of the arithmetic mean of the particle mass concentration of the fraction PM2,5 is exceeded in accordance with the requirements of the Czech technical standard governing the quality requirements of the air (4) under standard conditions at a measured interval which must represent the potential exposure of persons and the variability of concentrations.
§ 8
Limit of respiratory asbestos, respiratory asbestos and biopersistent and other respiratory mineral fibres
(1) The limits are set for the number of respiratory asbestos, the number of respiratory asbestos and biopersistent and the number of other mineral fibres subject to standard conditions. The requirements for the quality of the indoor environment of the living rooms are met if the value is not exceeded
(a) 500 simple number of respiratory asbestos or the number of asbestos and biopersistent mineral fibres determined under standard conditions per m3 by the transmission emission microscopy method (TEM) or a value of 1000 number of respiratory asbestos and the number of asbestos and biopersistent mineral fibres per m3 determined as the upper limit of the estimated Poisson distribution;
(b) 1 000 simple number of respiratory asbestos and the number of asbestos and biopersistent mineral fibres per m3 determined under standard conditions as simple number by scanning electron microscopy (SEM); or
(c) 10 000 simple numbers of other respirable mineral fibres determined under standard conditions per m3 by the transmission emission microscopy (TEM) method or by the scanning electron microscopy (SEM) method.
(2) The minimum volume of air sample taken is 2 m3 at the standard flow rate of 8 dm3 / min. The representativeness of sampling must be in accordance with the requirements of the Czech technical standard governing requirements for the indoor environment 5) of the living rooms. The measurement always determines the type of asbestos respirable fibres. The type of biopersistent and other mineral respiratory fibres shall be determined whenever their number exceeds the limit laid down for the number of asbestos and biopersistent mineral fibres or for other mineral fibres.
§ 9
Limits on biological indicators
(1) The presence of moulds on internal surfaces and structural elements of the construction is not allowed.
(2) The requirements for the quality of the internal environment of the living rooms, with the exception of those requiring increased requirements for its purity, are met if the concentrations do not exceed:
(a) bacteria of 500 colonies forming units per m3 of air (hereinafter referred to as "KTJ / m3 of air"); and
(b) mould 500 cfu / m3 air.
(3) The concentrations of micro-organisms referred to in paragraph 2 shall be determined after collection by active air intake in accordance with the requirements of Czech technical standards for the horizontal determination of the total number of moulds and yeast and the horizontal determination of the total number of micro-organisms (6).
§ 10
The provisions of Sections 3 and 5 and Annex 1 to this Decree shall not apply to the buildings referred to in Section 7 (1) of the Act.
§ 11
Availability of Czech technical standards
Czech technical standards that are used under this decree are published on the website of the Czech Standardisation Agency.
§ 12
Repeal
They shall be deleted:
1. Decree No. 6 / 2003 Coll., laying down the hygiene limits of chemical, physical and biological indicators for the internal environment of the living rooms of certain buildings.
2. Decree No. 304 / 2022 Coll., amending Decree No. 6 / 2003 Coll., laying down the hygiene limits of chemical, physical and biological indicators for the indoor environment of accommodation rooms of certain buildings.
§ 13
Efficacy
This decree shall take effect on the first day of the calendar month following its publication.

Explanatory notes to the references to Tables 1 to 3:
A) If the type of space is not given in Table 1, the requirement of a living room with a similar activity character shall be based on.
B) Textrooms and daily rooms which are not set up under Section 7 (1) of the Act.
(C) If there are no other requirements for the indoor environment of the living room given by the protection of the objects exposed, or of the exposures and specific operations where a different technological requirement is required.
D) Sports grounds with the exception of their ice areas and similar facilities where a different technological requirement is required.
(E) If there are no other requirements for the living room environment in medical facilities given by the performance or treatment process.
