THE LAW
of 30 November 2023
amending Act No. 374 / 2015 Coll., on Financial Market Recovery and Resolution, as amended
Parliament has decided on this law of the Czech Republic:
Act No. 374 / 2015 Coll., on Financial Market Recovery and Resolution, as amended by Act No. 183 / 2017 Coll., Act No. 182 / 2018 Coll., Act No. 307 / 2018 Coll., Act No. 111 / 2019 Coll., Act No. 298 / 2021 Coll. and Act No. 96 / 2022 Coll., is amended as follows:
1. At the end of footnote 1, the words "and Regulation (EU) 2022 / 2036 of the European Parliament and of the Council 'are added.
2. In Paragraph 127, the following paragraph 7 is added:
"(7) The consolidated basis of the persons referred to in paragraphs 2 and 5 shall not include controlled persons who are mortgage credit institutions with their head office in another Member State, are funded by covered bonds and are not entitled to receive deposits if the resolution authority of another Member State decides, in accordance with Article 45a (1) of Directive (EU) 2014 / 591 of the European Parliament and of the Council, that the mortgage credit institution is not required to comply with the internal minimum requirement. ';
3. In Article 129d (2), the words "taking into account all the conditions set out in paragraphs 127 to 131c 'shall be inserted after the words" 129b'.
4. In Section 132b (1) of the Introductory Part of the provision, the words "or if a member of a global systemically significant institution is a person established in a territory other than a Member State who would be a person subject to a resolution if it were established in the territory of a Member State," shall be inserted after the words "a person subject to a resolution."
5. in Article 132b (1) (a) and in Article 132b (2) and (3), the words "crises which" shall be replaced by the words "crises and persons established in a territory other than a Member State who would be persons subject to resolution if they were established in the territory of a Member State, and which."
6. In Article 134 (1), the words "taking into account all the conditions set out in paragraphs 127 to 131c 'shall be inserted after the word" crisis'.
7. In Annex 3, the words "which have been created since the last decision on the distribution of profits or the adoption of any of the measures referred to in Article 26a (1) 'are replaced by the words" minus any distribution of profits or making payments resulting from any of the measures referred to in Article 26a (7)'.
Efficacy
This Act shall take effect on the day following its publication.
