DECLARATION
of 15 February 2018
amending Decree No. 176 / 2009 Coll., laying down the details of the application for accreditation of the training programme, the organisation of training in the retraining establishment and the way in which it is completed
The Ministry of Education, Youth and Sports, in agreement with the Ministry of Labour and Social Affairs, provides, pursuant to § 108 (10) of Act No. 435 / 2004 Coll., on Employment, as amended by Act No. 382 / 2008 Coll. and Act No. 327 / 2017 Coll., hereinafter "the Act ':
Decree No. 176 / 2009 Coll., laying down the details of the application for accreditation of the training programme, the organisation of the training in the retraining establishment and the way in which it is completed, is amended as follows:
1. In Article 1 (g), the words "the schedule of hours of the model teaching day, in the case of the presentation form of education 'are replaced by the words" the timetable of education'.
2. In Article 1, the words "unless otherwise specified in paragraph 2 or 3 'shall be added at the end of the text of point (h).
3. In Article 1, at the end of the text of point (i), the words "or a certificate of participation in an accredited training programme as referred to in Article 5a 'are added.
4. In Paragraph 1 (j):
"(j) a curriculum containing a list of thematic units with a minimum hourly subsidy and a minimum total number of teaching hours, with a theoretical and practical separation, in the case of training combined in accordance with § 2 (1) (c), with a division of teaching into presentation and distance,";
5. In Article 1 (k), the word "articles' is replaced by the words" thematic units' and the words "parts thereof, if any, if the retraining programme is divided into them ';
6. in Paragraph 1 (n):
"(n) the name, names and surname, date of birth and, where applicable, academic titles and scientific rank of the natural person responsible for the professional level of retraining and proper conduct of the final examinations under the retraining programme (§ 4), evidence of his or her education and professional experience and his or her agreement to be responsible for the professional level of retraining and proper conduct of the final examinations (§ 4),"
footnote 1 is deleted.
7. in Article 1 (o):
"(o) the name, names and surname and, where applicable, academic degrees and scientific grades of lecturers for the teaching of individual thematic units, their qualifications and professional and pedagogical practices, and their agreement to carry out teaching activities;"
8. in Paragraph 1 (q), the words "the retraining or certification of participation in an accredited training programme" shall be inserted after the words "the certificate."
9. In Paragraph 1, the present text becomes paragraph 1 and the following paragraphs 2 and 3 are added:
"(2) Where the method of verifying acquired knowledge and skills is provided for by another legislation or prepares training to obtain qualifications under another legislation, the application for accreditation of the training programme shall be made in place of the requirement referred to in paragraph 1 (b). (h) it shall contain an indication by which the legislation is governed by the method of verifying the knowledge and skills acquired and the composition of the examination committee.
(3) Where training is prepared to obtain qualifications under the Law on the Recognition of Result of Further Training, the application for accreditation of the training programme instead of the requirement laid down in paragraph 1 (b). (h) it shall include an indication that the method of verification of the knowledge and skills acquired is governed by the law on the recognition of the results of continuing education, and the name, if any, and surname and, where applicable, academic degrees and scientific degrees or the name of the authorised person or persons for whom it is secured and their consent to the security. ';
10. in the second sentence of Article 2 (3), the word "education" shall be deleted;
11. in Paragraph 3 (1):
"(1) The training in the retraining establishment referred to in Article 108 (2) (a) of the Act shall be terminated by successfully verifying the knowledge and skills acquired by means of a final examination under the retraining programme (hereinafter referred to as the" final examination ") no later than 15 days after the end of the training period, unless the method of verifying the knowledge and skills acquired provides for another legislation or prepares the training of the participant to obtain qualifications under another legislation."
footnotes 3 and 4 are deleted.
12. in Article 3 (2), the words "the end of the training is for the participant" shall be replaced by "the completion of the final examination referred to in Article 4 shall be for the participant."
13. The following Section 3a is inserted after Section 3, including the title:
Conditions for issuing a certificate of participation in an accredited training programme
If the knowledge and skills acquired in accordance with § 4 are not verified, the participant shall be entitled to issue a certificate of participation in an accredited training programme if he has completed at least 80% of the training from the total hourly training grant under the retraining programme. ';
14. in Article 4, the words "paragraph 1" shall be inserted after the words "Paragraph 1";
15. In Article 4, at the end of the text of paragraph 6, the words "within the time limit set by the Examination Board, but not later than 30 days after the date of the proper final examination 'shall be added.
16. in § 5 (d), the words "possible academic degrees and scientific degrees" shall be inserted after the word "surname."
17. in § 5 (h):
"(h) the total hourly grant of training under the retraining programme and the hourly grant of teaching by thematic unit with the division of teaching into theoretical and practical, in the case of training combined in the form referred to in § 2 (1) (c) with the division of teaching into presentation and distance,";
18. in Article 5, at the end of the text in point (i), the words "pursuant to Article 4" shall be added.
19. in Article 5, the words "the name, the names, and surnames, any academic titles and scientific degrees," shall be inserted at the beginning of point (k), and after the words "the Commission and" shall be inserted the words "the name, or names, or surnames, or academic titles and scientific degrees, respectively, and."
20. The following Section 5a is inserted after Section 5:
Forms of certificate of participation in an accredited training programme
The certificate of participation in an accredited training programme shall include:
(a) the information provided for in Article 5 (a) to (h);
(b) an indication that this certificate of participation in an accredited training programme does not replace proof of successful verification of acquired knowledge and skills under another legislation;
(c) the place and date of issue of the certificate of participation in an accredited training programme;
(d) the name and, where applicable, the names and surnames, any academic degrees and degrees and the signature of the natural person responsible for the professional level of retraining referred to in Article 1 (1) (n) and the signature of the person who is entitled to act as a retraining establishment. "
Efficacy
This decree shall take effect on the 15th day following its publication.
