DECLARATION
of 1 October 2025
amending Decree No. 108 / 2011 Coll., on the measurement of gas and on the method of determining the compensation for wrongful removal, unauthorised delivery, unauthorised storage, unauthorised transport or unauthorised distribution of gas, as amended
The Ministry of Industry and Trade provides, pursuant to § 98a paragraph 1 (a) of Act No. 458 / 2000 Coll., on the Terms and Conditions of Business and on the Performance of State Administration in the Energy Sector and on the Amendment of Certain Laws (Energy Act), as amended by Act No. 158 / 2009 Coll., Act No. 211 / 2011 Coll., Act No. 165 / 2012 Coll., Act No. 131 / 2015 Coll., Act No. 362 / 2021 Coll., Act No. 469 / 2023 Coll. and Act No. 87 / 2025 Coll., and under Section 53 (1) Sb., Act No. 165 / 2012 Coll., on Supported Energy Resources and on the Amendment of Certain Laws, as amended by Act No. 382 / 2021 Coll.:

Decree No. 108 / 2011 Coll., on the measurement of gas and on the method of determining the compensation for wrongful removal, unauthorised delivery, unauthorised storage, unauthorised transport or unauthorised distribution of gas, as amended by Decree No. 289 / 2013 Coll., Decree No. 236 / 2017 Coll. and Decree No. 78 / 2021 Coll., is amended as follows:
1. In the title of the decree, the words "physical and chemical parameters determining the quality of the gas' shall be inserted after the words" gas measurement '.
2. In the introductory sentence, the words, "Act No. 211 / 2011 Coll., Act No. 165 / 2012 Coll., Act No. 131 / 2015 Coll., Act No. 362 / 2021 Coll., Act No. 469 / 2023 Coll. and Act No. 87 / 2025 Coll., and pursuant to § 53 (1) (s) of Act No. 165 / 2012 Coll., on Supported Energy Sources and on Amendment to Certain Acts, as amended by Act No. 382 / 2021 Coll. 'shall be inserted after the words" Act No. 158 / 2009 Coll.'.
3. in Article 1 (1) (a) at the end of the text of points 1 and 1 (1) (b) at the end of the text of point 1, the words "unless it is already established in the territory of that State" shall be added.
4. In Article 1 (1) (c), the following point 4 is added:
"fourth sampling point,"
5. in Article 1 (1) (d), the words "other production gas" shall be replaced by the words "gas equipment of another gas producer or a point of sampling for the supply of biomethane to a service station or dispens4)."

6. in Article 3 (1) (d), the following point 4 is added:

8. In Article 3 (6), the words "or economic 'shall be inserted after the words" from technical operations'.
9. in Article 5 (2) (b) (1), the word "working" shall be inserted after the word "5."
10. in Article 5 (2) (b) (2), "calendar" is inserted after "14."
11. at the end of the text in points (k) and (l), the words "or emergency condition (2)" shall be added.
12. in Article 8 (2), the words "transmission system operator or distribution system operator" are replaced by the words "licence holder."
13. In Article 9, the words "not more than 36 months before the detection of unauthorised collection 'shall be added at the end of the text of paragraph 1.
14. in Article 9 (7) (a) and (b), "24" is replaced by "36."
15. in Article 9 (10) (a):
"(a) the average of the daily values of the short-term market index POTE published by the market operator in accordance with the legislation laying down the rules of the gas market (1) during the last 3 months preceding the month in which the unauthorised collection was detected; the price in EUR / MWh is converted into CZK / MWh at a daily EUR / CZK rate declared by the Czech National Bank on the current gas day D; if the daily course is not available, the value of the daily course shall be used at the next immediately preceding day D-n, when the value of the daily course was published, '.
16. in Article 9 (10), the following points (b) and (c) are inserted after point (a):
"(b) additional costs, risk increases and reasonable profit of CZK 335 excluding value added tax / MWh,
c) a permanent monthly salary of CZK 224 excluding value added tax / collection place / month,. "
Points (b) to (e) shall be renumbered (d) to (g).
17. The heading "Measurement of the physical and chemical properties of gas and the method of measuring the quantity and quality of biomethane 'is inserted above the designation of Section 10 and the heading of Section 10 is deleted.
18. in Article 10 (5) (b):
"(b) the transfer point between the gas production plant and the transmission system or distribution system or the pipeline of another gas production plant; the physical and chemical parameters of the gas shall always be measured at this point in the range at least as in (a); in the case of the connection of a biomethane production plant to another gas producer's coal pipeline, the physical and chemical parameters of the biomethane produced in such a production plant shall correspond to the values set by the system operator to which the gas producer's coal pipeline is connected; ';
19. In Article 10 (6), the words "methods of measuring quality parameters of biomethane and, in the case of biomethane produced from biomass, the frequency of their measurements by biomass group 'shall be inserted after the words" gas'.
20. The following Section 10a is inserted after Section 10:
„§ 10a
(1) The biomethane manufacturer shall submit before the start of the supply of biomethane from the new biomethane production plant or when the parameters of the biomethane production plant are changed to the relevant operator to which the biomethane plant is connected, the results of the measurements of the quality parameters of the biomethane or biogas from which the biomethane is produced, only in the case of one-time measurement parameters.
(2) The biomethane manufacturer shall ensure, no later than the 10th working day following the change in the biomass group used for the production of biomethane to the higher biomass group referred to in paragraph 5 of Annex 5 to this Regulation, that all required one-off measurements are carried out and the results are transmitted without delay to the competent operator.
(3) The biomethane manufacturer shall notify the competent operator in electronic form of the date of measurement of one-off measurements of quality parameters of biomethane, at least 5 calendar days before their implementation. The values of the single measurement quality parameters of biomethane shall be transmitted by the biomethane manufacturer to the competent operator no later than 10 calendar days after receipt of the measurement report.
(4) The holder of the licence to which the biomethane production facility is connected shall transmit to the competent operator, at least once per hour, the values of the continuous measurement and data on the quantity of biomethane delivered to the transmission system, distribution system or gas storage device or pipeline.
(5) The biomethane manufacturer ensures measurement of one-time quality parameters of biomethane. '
21. in Paragraph 10a (2), "paragraph 5" is replaced by "paragraph 6";
22. Annex 5 reads as follows:

Explanatory notes:
1. The values are given under the reference conditions referred to in Section 1 (3).
2. For biomethane, the values are limited in accordance with Table 3 of the Gas pipeline with an overpressure up to 0,4 MPa.
3. The calorific values will be calculated on the basis of the gas composition.
4. With a hydrogen content above 5%, it is necessary to verify, on the basis of the combustion characteristics of the gas mixture, how high the actual hydrogen percentage may be. The safety and reliability of the gas infrastructure concerned and of the gas collection facilities must be verified in order to be able to exceed or not to meet relative density.

1. Values under reference conditions (§ 1 (3)).
2. A specific value in the range of ± 1 ° 3% is given in the connection contract.
3. The average value of GCV at the connection point or in each quality zone for the preceding month shall be published by the relevant operator in a manner enabling remote access; the indication of the quality zone to which the bio-methane plant will be connected shall be indicated in the connection contract.
4. The methane content may be lower than 95% of the mol. if the GCV determined by the operator of the parent gas infrastructure is respected.
5. The propane content up to 5,5 mol per cent of the daily average shall be determined by the operator in the connection contract.
6. The specific value of the content of organic silicon compounds will be stated in the connection contract.
7. For landfill or sludge gas biomethane production, the distribution system operator and the biomethane producer may agree additional qualitative parameters in the connection contract, including the frequency of their measurements, on the basis of an analysis of the biomethane sample, to ensure the safe and reliable operation of the gas system.
8. The term absent means the removal of solid particles, dust, cutting or harmful living micro-organisms to such an extent as to ensure the safe and reliable operation of gas and gas collection facilities.

1. Biomass Group 1 is all biomass species listed in Table 2 except biomass in points (b), (c), (d) (1), (g), (h), (i), (p) and listed in Table 3 except biomass in point (g) of Annex 1 to Decree No 110 / 2022 Coll., on the determination of the species and parameters of supported renewable sources and sustainability criteria and on the saving of greenhouse gas emissions for bioliquids and biomass fuels.
2. Biomass Group 2 is the biomass species listed in Table 2 in points (b), (c), (d) (1), (g), (h), (i), (p) and Table 3 in point (g) of Annex 1 to Decree No 110 / 2022 Coll., on the determination of the species and parameters of supported renewables and sustainability criteria and greenhouse gas emissions savings for bioliquids and biomass fuels.
3. Applies to biomethane membrane separation technology from biogas and to the use of the indophenol method for the determination of ammonia content.
4. Where biomass is used in the manufacture of biomethane, the frequency of measurements shall be determined by a group with a higher number.
5. The measurement frequency for one-time quality parameters of biomethane may be higher if the measured values are close to the limit value specified in the Decree on Measurement No. 108 / 2011 Coll., by less than 5%, the shortest measurement frequency being once every 3 months. ';

Čl. II
Efficacy
This Decree shall take effect on the 15th day following its publication, with the exception of Article I (21), (23) and (24), which shall take effect on 1 January 2026.
