DECLARATION
of 10 December 2013
amending Decree No. 232 / 2002 Coll., implementing Act No. 3 / 2002 Coll., on freedom of religion and the status of churches and religious societies, and amending certain laws (Act on churches and religious societies), as amended by Decree No. 547 / 2006 Coll.
The Ministry of Culture provides pursuant to Article 29 of Act No. 3 / 2002 Coll., on the Freedom of Religious Religion and the Status of Churches and Religious Societies and on the Amendment of Certain Laws (Act on Churches and Religious Societies), as amended by Act No. 495 / 2005 Coll.:
Decree of the Ministry of Culture No. 232 / 2002 Coll., implementing Act No. 3 / 2002 Coll., on the Freedom of Religious Religion and the Status of Churches and Religious Companies and on the Amendment of Certain Laws (Act on Churches and Religious Companies), as amended by Decree No. 547 / 2006 Coll., is amended as follows:
1. in Article 2 (1) (A) (c):
"(c) the name of the statutory body of the registered church and religious society,"
2. in Articles 2 (1) (A) (d), 3 (1) (A) (e) and 4 (1) (A) (e), the words "and surnames" are replaced by the words "surnames and date of birth."
3. in § 2 (1) (A) at the end of the text of (d), § 3 (1) (A) at the end of the text of (e) and § 4 (1) (A) at the end of the text of (e), the words "and the date of creation and demise of their function" shall be added.
4. In Article 2 (1) (A) (i), the word "company," shall be replaced by the words "company with a legal basis, decision," and the words "rejection of the application for bankruptcy for lack of assets, opening proceedings for compensation and dates," shall be replaced by the words "bankruptcy and cancellation of bankruptcy because the property is completely inadequate, including data."
5. in Articles 2 (1) (A) (j), 3 (1) (A) (l) and 4 (1) (A) (j), the words "and surname and domicile or registered office" shall be replaced by "surname and date of birth."
6. in § 2 (1) (A) (k), § 3 (1) (A) (m) and § 4 (1) (A) (k), the words "and the residence or name and registered office of the insolvency administrator," shall be replaced by the words "or business name and registered office of the insolvency administrator,";
7. Article 2 (1) (A) (n) is deleted.
8. in Article 2 (1) (B) (a), the words "and surname" are replaced by the words "surname and date of birth."
9. In Article 2 (1) (B) (d), the words "personal data 'are replaced by the words" address of the place of residence or residence, birth number and citizenship'.
10. in Paragraph 2 (1) (B) (j), the words "bankruptcy and settlement" are replaced by the words "bankruptcy of the church and religious society."
11. in Article 2 (1) (B) (k):
"(k) the decision of the courts to review the decision of the Ministry;"
12. in Article 2 (1) (B) (l), the words "and its registered legal persons" shall be deleted;
13. in Article 2 (2) (a), "personal data" is replaced by "the address of the place of residence or residence, birth number and citizenship."
14. in Article 2 (2) (d):
"(d) copies of the documents referred to in paragraph 1 containing the address of the place of residence or residence, the birth number and citizenship of natural persons.";
15. in Article 2 (2), point (e) is deleted;
16. in Article 3 (1) (A) (k):
"(k) the number and date of the decision to cancel the registered legal person's registration, stating the legal basis, the decision to enter into liquidation, the bankruptcy and the cancellation of bankruptcy because the property is wholly inadequate, including the information on which those decisions became final, ';
17. in Article 3 (1) (B) (a) and Article 5 (1), the words "and surnames" shall be replaced by the words "surnames and dates of birth."
18. in Article 3 (1) (B) (c):
"(c) the statutes of the registered legal person and the instrument of incorporation of the special-purpose establishment of the registered church and religious society;"
19. in Paragraph 3 (1) (B) (d), the words "the termination of the application for registration" shall be replaced by "the revocation of the registration."
20. in Paragraph 3 (1) (B) (e), "bankruptcy and settlement" is replaced by "bankruptcy of a registered legal person";
21. in Article 3 (1) (B) (f) and Article 4 (1) (B) (f), the words "information on judgments of the courts of judgments" shall be replaced by the words "decisions of the courts of review of decisions" and the words "and, in the cases referred to in point (e), with the designation of the court, the operative part of the judgment of the court, the document of the judgment and the date of its issue," shall be deleted;
22. in Paragraph 3 (2):
"(2) A copy of the documents referred to in paragraph 1 containing the address of the place of residence or residence, the birth number and citizenship of natural persons shall be included in the register of registered legal persons in the non-public part. ';
23. in Article 4 (1) (A) (i), the word "company," shall be replaced by the words "company with a legal basis, decision," and the words "rejection of the application for a declaration of bankruptcy for lack of assets and the opening of a settlement procedure, stating the date and number of the decision on these facts and the date on which" shall be replaced by the words "bankruptcy and cancellation of bankruptcy because the property is completely insufficient, including the particulars of when these";
24. in Article 4 (1) (A), point (n) is deleted;
25. in Paragraph 4 (1) (B) (c), "and k" shall be replaced by "and proposals for."
26. in Article 4 (1) (B) (e), the words "bankruptcy and settlement" are replaced by the words "bankruptcy of the association of churches and religious societies."
27. in Paragraph 4 (2):
"(2) A copy of the documents referred to in paragraph 1 containing the address of the place of residence or residence, the birth number and citizenship of natural persons shall be included in the Register of the Union of Churches and Religious Companies. ';
28. in Article 5 (2), the second sentence, including footnote 1, is deleted;
29. in Article 5 (3) and (4), the word "part" is replaced by the word "components."
30. in Article 6 (1), the words "or on a specified date" shall be added at the end of the text of point (a).
31. in Article 6 (1) (e), the word "extracts" shall be replaced by "extracts" and the words "under Article 20 (1) of the Act" shall be deleted;
32. In the first sentence of Article 6 (2), the words "the date on which they are issued 'shall be inserted after the words" the documents' and the words "or any other fixed date 'shall be added at the end of the text of the second sentence.
33.In Article 6 (6), footnote 4 is replaced by footnote 3.
34. Annexes 1 to 3 shall read as follows:
