DECLARATION
of 27 October 2008
amending Decree No. 54 / 2008 Coll., on the method of prescribing medicinal products, the particulars on the prescription and the rules on the use of the prescription
The Ministry of Health, after consulting the Ministry of Agriculture, the Ministry of Defence, the Ministry of Interior, the Ministry of Justice and the Ministry of Finance, according to § 114 (3) and to implement § 80 of Act No. 378 / 2007 Coll., on Medicines and on Changes to Certain Related Acts (Law on Medicines):
Decree No. 54 / 2008 Coll., on the method of prescribing medicinal products, the particulars on the prescription and the rules on the use of the prescription are amended as follows:
1. In Article 6 (1) (b), the words "the address of the patient's place of residence or, where applicable, the place of residence in the Czech Republic, if it is a foreigner, the patient's telephone number, which may be indicated by the doctor only with the consent of the patient; patient identification number (insurer 9); if the identification number has not been assigned, the date of birth of the patient 'shall be replaced by' the address of the patient's whereabouts, the patient's telephone number, which may nevertheless be indicated by the doctor only with the consent of the patient; the number of the insured person (9), if allocated; if the number of the insured person has not been assigned, or if it is not possible from the insured person's number to determine the age of the insured person, the age of the patient in children under 3 years, specifying for months and for other persons over the years; ';
2. in Article 6 (1) (c) (2), the words "with the simultaneous indication of the quantity requested" shall be inserted after the word "ingredients."
3. in Paragraph 6 (1) (g) (1):
'1. the name and, where appropriate, the name, surname of the doctor, address, including the telephone number of the place of regular healthcare provision and the identification number allocated by the health insurance undertaking, if the health insurance company has been allocated; where there is a medical practitioner as referred to in paragraph 6 who does not otherwise provide medical care, the address of the place of regular medical care, the place of residence, if any, of the natural person; ';
4. in Article 6 (1) (g), point 3 is deleted;
Point 4 is renumbered point 3.
5. In Article 6 (1) (g), at the end of point 3, the comma is replaced by a semicolon and the sentence "the data referred to in point 1, 2 or 3 shall be entered in this recipe at the location specified by the data interface when the electronic recipe is used."
6. in Article 12 (1) (b):
"(b) the name and, where appropriate, the name, surname, number of the insured person; if the insured person's number has not been allocated, or if it is not possible from the insured person's number to determine the age of the insured person, the age of the patient, in the case of a child under 3 years, specifying for months and for other persons over the years, the code number of the relevant health insurance undertaking, if that information is available,
7. in Article 12 (1) (f):
"(f) the name or, where applicable, the name of the prescriber, the address of the place of regular medical care, or the address of residence, in block letters,"
8. in Article 13 (1) (b) (2), the words "with the simultaneous indication of the quantity requested" shall be inserted after the word "ingredients."
9. in Article 13 (2) (b):
"(b) the name and, where appropriate, the name, surname and number of the insured person who is the intended recipient of the transfusion preparation, if allocated; where the necessary data are not known, the indication clearly identifying the intended beneficiary shall be given; ';
10.Paragraph 15 (3) reads as follows:
"(3) Paragraph 14 (1) shall apply mutatis mutandis to determine the period of validity of the extract. '
11. in Paragraph 18 (1) (f), the words "permanent residence or address of residence, as the case may be," shall be replaced by the words "place of regular veterinary care."
12. in Article 19 (1) (o), in the sentence behind the semicolon, the words "place of business" are replaced by the words "place of regular veterinary care."
13. in Paragraph 21 (1) (h), in the sentence behind the semicolon, the words "place of business" are replaced by the words "place of regular veterinary care."
14. In Article 23, the following paragraph 2 is inserted after paragraph 1:
"(2) The formula for distribution to the breeder is issued by the treating veterinarian."
Paragraphs 2 to 5 shall be renumbered paragraphs 3 to 6.
15. in Article 23 (3) (a):
"(a) is not a product containing antibiotics or chemotherapeutic agents intended for injection in accordance with the marketing authorisation decision;"
16. In Article 23, the following paragraph 4 is inserted after paragraph 3:
"(4) A prescription for distribution to the breeder may be prescribed for a veterinary medicinal product, the dispensation of which is subject to a prescription, up to a maximum of that corresponding to the need for a therapeutic bark established by the treating veterinarian for a period not exceeding 28 days. For emergency treatment, a veterinary medicinal product may be prescribed not exceeding the average weekly requirement on the holding concerned. '
Paragraphs 4 to 6 shall be renumbered paragraphs 5 to 7.
17. in Article 23 (5) (c), "identification" is replaced by "category."
18.Paragraph 23 (7) reads as follows:
"(7) Paragraph 14 (1) shall apply mutatis mutandis to determine the period of validity of the formula for distribution to the breeder. ';
Transitional provision
For a period of two years following the entry into force of this Decree, the date of birth may be indicated on the recipe instead of the age of the patient.
This Decree shall take effect on the 15th day following its publication.
