DECLARATION
of 6 October 2025
amending Decree No. 432 / 2003 Coll., laying down the conditions for the classification of works into categories, the limit values for biological exposure test indicators, the conditions for the collection of biological material for carrying out biological exposure tests and the formalities for reporting of work with asbestos and biological agents, as amended
According to Section 108 (1) of Act No. 258 / 2000 Coll., on the Protection of Public Health and on the Amendment of Certain Related Acts, as amended by Act No. 167 / 2023 Coll. and Act No. 290 / 2025 Coll., (hereinafter referred to as "the Act"), the Ministry of Health provides for the implementation of Sections 37 (1), 39 (3) and (4) and 41 (1) and (7) of the Act:
Decree No. 432 / 2003 Coll., laying down the conditions for the classification of works into categories, the limit values of biological exposure test indicators, the conditions for the collection of biological material for carrying out biological exposure tests and the formalities for reporting of work with asbestos and biological agents, as amended by Decree No. 107 / 2013 Coll., Decree No. 181 / 2015 Coll. and Decree No. 240 / 2015 Coll., are amended as follows:
1. In footnote 1, the following sentence is added to the separate rows:
"Directive 2009 / 148 / EC of the European Parliament and of the Council of 30 November 2009 on the protection of workers from the risks associated with exposure to asbestos at work (codified version). Directive (EU) 2023 / 2668 of the European Parliament and of the Council of 22 November 2023 amending Directive 2009 / 148 / EC on the protection of workers from the risks associated with exposure to asbestos at work. Directive (EU) 2024 / 869 of the European Parliament and of the Council of 13 March 2024 amending Directive 2004 / 37 / EC of the European Parliament and of the Council and Council Directive 98 / 24 / EC as regards limit values for lead and its inorganic compounds and diisocyanates. ';
2. In Article 5, the words "with a legal person 'shall be inserted at the beginning of point (a), the words" with a legal person and' shall be deleted, after the word "name, 'shall be inserted, where appropriate, the words" names and' shall be added at the end of the text of the letter 'and the words "with the natural person's name and surname, date of birth, address of residence' shall be added.
3. In Section 5, at the end of the text in point (b), the words "their name list, including evidence of training on the proper prevention of asbestos hazards for all exposed persons and the date of issue of the last medical opinion on fitness for work 'shall be added.
4. In Article 5 (k), the words "the method of ensuring control of asbestos concentration in working air and 'are deleted, the dot is replaced by a comma and the following point (l) is added:
"(l) the method of ensuring control of asbestos concentration in the working air.";
5. In Article 5, the current text becomes paragraph 1 and the following paragraph 2 is added, including footnote 14:
"(2) If reporting is made by the person mentioned
(a) in Article 12 (a) to (c) and (e) of the Labour Safety and Health Act (14), the report does not state:
1. the data referred to in paragraph 1 (b) concerning the date of issue of the last medical opinion on fitness for work; and
2. the particulars referred to in paragraph 1 (i) to (k);
(b) in Article 12 (d) of the Labour Safety and Health Act (14), the report does not include the data referred to in (a) and does not further support the certificate of training on the application of proper prevention of health risks in the management of asbestos referred to in paragraph 1 (b).
14) Act No. 309 / 2006 Coll., which regulates other requirements of safety and health at work in employment relations and on ensuring health and safety at work or providing services outside employment relations (Act on ensuring further conditions of safety and health at work), as amended. "
6. In Annex No 1, Part 2, paragraph 3, the words "classified as carcinogenic category 1 or 2, mutagenic category 1 or 2 and toxic for reproduction category 1 or 2 and others under the Chemical Act (11), marked with R26, R 27, R 28 and their combinations, R39, R 42, R 43, R 45, R 46 and R 49, R 60, R 61 ', including footnote 11, are deleted.
7. In Annex No 1, Part 2, Chapter "Category Two '(c), the words" classified as carcinogenic category 1 or 2 with a standard sentence indicating the specific risk of R 45 or R 49, mutagenic category 1 or 2 with a standard sentence indicating the specific risk of R 46 and toxic for reproduction category 1 or 2 with a standard sentence indicating the specific risk of R 60 or R61 according to the Chemical Act (11) and other chemical substances or mixtures according to the chemical law 11) marked with R 26, R 27, R 28, R 42, R 43 and combinations thereof, and also with R 39 in combination with other standard phrases indicating the specific risk, chemical substances or mixtures mentioned in the Chemical Code (11)';
8. In Annex No 1, Part 2, Chapter "Category Three '(c), the words" classified as carcinogenic category 1 or 2 with a standard sentence indicating the specific risk of R 45 or R 49, mutagenic category 1 or 2 with a standard sentence indicating the specific risk of R 46, toxic for reproduction category 1 or 2 with a standard sentence indicating the specific risk of R 60 or R 61 according to the Chemical Act (11) and other chemical substances or mixtures according to the Chemical Act 11) marked with R 26, R 27, R 28, R 42, R 43 and combinations thereof, and also with R 39 in combination with other standard phrases indicating the specific risk, chemical substances or mixtures mentioned in the Chemical Code (11)';
(9) Footnote 13:
"13) Government Decree No. 291 / 2015 Coll., on Health Protection against Non-Ionising Radiation. '.
10. In Annex No 1, Part 10, Chapter "Category Three ', point (b), the word" only' is deleted and the words "in single-shift traffic 'are added at the end of the text of the letter.
11. In Annex No 1, Part 13, Chapter "Category Two ', the words" corresponding to a depth up to 10 metres for below-surface work' are deleted.
12. In Annex No 1, Part 13, Chapter "Category of third ', the words" corresponding to a depth of between 10 and 40 metres for work below the surface' are deleted.
13. In Annex No 1, Part 13, Chapter "Category Four ', the words" corresponding to a depth of 40 metres or more' are replaced by the words "or any diving work carried out below the surface, regardless of the depth of the dive '.
14. In Annex No 2, Table 2, the column "Timeliness of the limit 'is added and the row in the column" Blood substance' contains the word "Lead ':

Efficacy
This Decree shall take effect on 1 January 2026.
