DECLARATION
of 6 October 2025
amending Decree No. 106 / 2001 of the Ministry of Health Coll., on sanitary requirements for rehabilitation actions for children, as amended
According to Article 108 (1) of the Act No. 258 / 2000 Coll., on the Protection of Public Health and on the Amendment of Certain Related Acts ("the Act '), as amended by Act No. 274 / 2003 Coll., Act No. 392 / 2005 Coll., Act No. 222 / 2006 Coll., Act No. 151 / 2011 Coll., Act No. 223 / 2013 Coll., Act No. 267 / 2015 Coll., Act No. 202 / 2017 Coll., Act No. 205 / 2020 Coll. and Act No. 167 / 2023 Coll., for the implementation of § 8 (2), § 9 (3) and § 11 (1) (a) and (d) Act:
Decree of the Ministry of Health No. 106 / 2001 Coll., on sanitary requirements for recovery actions for children, as amended by Decree No. 148 / 2004 Coll., Decree No. 320 / 2010 Coll. and Decree No. 422 / 2013 Coll., is amended as follows:
1. footnote 3 shall read:
"3) Act No. 283 / 2021 Coll., Construction Act, as amended. '
2. In Article 3 (2), the word "individual 'is deleted.
3. In Paragraph 3 (4), the words "whole body 'shall be added at the end of the first sentence.
4. In the second sentence of Article 3 (4), the words "for 5 children one 'are deleted, the words" one' are deleted and the words "and for 30 children at least one shower rose 'are deleted.
5. In Article 3 (4), the third sentence is deleted.
6. In the third sentence of Article 3 (4), the word "all 'is deleted and after the word" be' the word "further 'is inserted.
7. In Article 3, at the end of paragraph 4, the sentence "Intimacy must be ensured for children when bathing or showering."
8. In Paragraph 3 (5), the first sentence is replaced by the following: "In recovery operations, toilets are set up." and the second sentence is replaced by the following: "Use of toilets need not be divided by sex, but intimacy must always be ensured while using them."
9. In Article 3 (6), the first sentence is replaced by the following: "An infirmary shall be established in the buildings; where no isolation is established, the conditions for its establishment shall be established where necessary. 'and after the first sentence, the sentence" Sick Bay, in the case of establishment and isolation, shall be inserted in a separate room equipped with a sink with running drinking water and with the possibility of heating and using hot water.';
10. In the third sentence of Article 3 (6), the words "Isolation must have 'are replaced by the words" In case of isolation must have been established' and the words "and must be equipped with beds' are added at the end of the third sentence.
11. in Article 3 (6), the fifth sentence is deleted;

13. in Paragraph 4 (1), the words "with isolation" shall be deleted;
14. In Paragraph 4 (3), at the end of the second sentence, the words "or, in the event of an infectious disease occurring, an additional person older than 18 years of age who is active in a recovery operation 'shall be added.
15. in Paragraph 4 (3), the sentence "Repeatedly used mattresses or mattresses must be kept in undamaged and clean condition" shall be inserted after the third sentence.
16. in Article 4 (5), the words "and maintenance" shall be inserted after the words "daily cleaning" and the sentence "All premises shall be kept clean and user-friendly throughout the day."
17. in Article 5 (1), the word "hand" shall be inserted after the words "personal hygiene."
18. in Article 5 (2), the words "which satisfy the requirements which apply to them under the Law" shall be inserted after the words "drinking water";

"6) For example, Decree No. 38 / 2001 Coll., on sanitary requirements for food and food contact products, as amended. Regulation (EC) No 1935 / 2004 of the European Parliament and of the Council of 27 October 2004 on materials and articles intended to come into contact with food and repealing Directives 80 / 590 / EEC and 89 / 109 / EEC, as amended. Commission Regulation (EU) No 10 / 2011 of 14 January 2011 on plastic materials and articles intended to come into contact with foodstuffs, as amended. Sections 25 and 26 of Act No. 258 / 2000 Coll., as amended. '
20. in Article 7 (1), the word "kitchen" shall be inserted after the word "washing."
21. in Article 7 (2), the words "fit for food contact" shall be replaced by the words "intended for food contact which complies with the requirements laid down in specific legislation6) and the words" fit for food contact material "shall be deleted;
22. in Article 7 (3), the words "washing of foodstuffs, dishes" are replaced by the words "sanitary washing of foodstuffs, kitchen, dining and children's own dishes."
23. In Article 7, the sentence "The last rinsing of the dishes and children's own dishes intended for repeated use shall be added at the end of paragraph 3."
24. in Article 7 (7), the words "and expenditure" shall be inserted after the words "on preparation" and the words "only before its heat treatment and during auxiliary work" shall be deleted;
25. in Article 7 (7), the second sentence is deleted;
26. in Paragraph 8 (1), the words "flat firmly" are replaced by "be."
27. in Article 8 (2), the word "with" shall be inserted after the word "action."
28. In Annex No 2, in the table "Training range ', in the row where the theme" 3. First aid - practical part, "16' is replaced by" 17 '.
29. In Annex 2, in the table "Training range ', in the row where the topic" 6. The rights and obligations of health professionals in recovery actions', "1 'is replaced by" 0' and "3 'is replaced by" 2'.
30. In Annex 2, point 2.1.6 is inserted after point 2.1.5:
"2.1.6. call for medical emergency services, telephone-assisted first aid (TAPP)."
Paragraph 2.1.6 is renumbered point 2.1.7.
31. In Annex 2, point 2.4.9, the words "anaphylactic shock 'are added.
32. In Annex 2, point 2.4.11, the word "shock 'is replaced by" shock situations'.
33. In Annex No 2, the following point 2.4.12 is inserted after point 2.4.11:
"2.4.12. sudden mobility and speech disturbances (FAST) '.
34. In Annex 2, at the end of the text in point 3.1, the words "telephone-assisted emergency resuscitation (TANR) 'are added.
35. In Annex 2, points 3.1.1 and 3.1.2 are inserted after point 3.1:
"3.1.1. cardiopulmonary resuscitation training using an automated external defibrillator (AED)
3.1.2. Training for cardiopulmonary resuscitation in children. "
36. In Annex 2, point 3.3.1, the word "semi-breathable 'is deleted.
37. in Annex No 2, point 5.3 is deleted;
Points 5.4 and 5.5 shall become paragraphs 5.3 and 5.4.
38. In Annex 2, point 5.4, the words "health and 'are replaced by the words" s'.
39. In Annex No 2, point 6.7 is deleted.
Paragraph 6.8 is renumbered paragraph 6.7.
40. In Annex 2, point 7.5.2, the word "AIDS 'is deleted.
41. in Annex 3, Table 3 (B) (c), the word "permanent" shall be deleted;
42. In Annex No 3, Table 4, the sentence "The right to review a medical opinion may be waived 'is inserted after the first sentence and in the third sentence, the word" Proposal' is replaced by the words "Under Paragraph 46 (3) of the same Act, it does not have a proposal 'and the word" does not' after the word "Opinion 'is deleted.
43. In Annex 4, point I., the words "and surface wounds' are deleted.
44. In Annex 4, point II, the words "resuscitation mask 'are replaced by the words" barrier protection for artificial breathing'.
45. In Annex 4, point II, the text "45 x 55 cm 'is deleted.
46. In Annex No 4, the words "- isothermic film 'shall be added at the end of point II.
47. footnotes 12 to 17 are deleted.
Transitional provision
A natural person who, prior to the date of entry into force of this Order, has received a first-aid course focusing on medical activities at a school in nature or a recovery action as referred to in Annex 2 to Decree No. 106 / 2001 Coll., as effective before the date of entry into force of this Order, shall be considered as having received a first-aid course under Decree No. 106 / 2001 Coll., as effective from the date of entry into force of the Decree.
Efficacy
This Decree shall take effect on 1 January 2026.
