GOVERNMENT REGULATION
of 29 January 2025
amending Government Regulation No 72 / 2023 Coll., laying down the conditions for the implementation of forest-environmental payment measures, as amended by Government Regulation No 44 / 2024 Coll.
The Government mandates pursuant to § 2c (5) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 85 / 2004 Coll., Act No. 291 / 2009 Coll., Act No. 179 / 2014 Coll. and Act No. 382 / 2022 Coll., and pursuant to § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act No. 441 / 2005 Coll., Act No. 291 / 2009 Coll. and Act No. 179 / 2014 Coll.:
Government Decree No. 72 / 2023 Coll., on the establishment of conditions for the implementation of forest-environmental payment measures, as amended by Government Decree No. 44 / 2024 Coll., is amended as follows:
1. in Paragraph 2 (1) (b), "a" is replaced by a comma;
2. In Article 2, at the end of paragraph 1, the dot is replaced by "a 'and the following point (d) is added:
"(d) leaving trees to cover."
3. In Article 2, the following paragraph 3 is added:
"(3) For the purposes of this Regulation, a tree left for masonry shall be understood as a tree stem without restriction of a species of forest wood with a thickness of at least 30 cm at a stronger end of the strain, at a continuous length of at least 15 metres. '
4. In Article 3 (2), the word "or 'shall be deleted at the end of point (a).
5. In Article 3, at the end of paragraph 2, the dot is replaced by "or 'and the following point (c) is added:
"(c) until the impact of leaving trees for sawing on a circular surface around a tree left for sawing at a radius of 20 m, with a centre at a stronger end of the tree trunk within a growing group held in the register of spatial forest division units to the applicant.";
6. In Paragraph 3 (4) (b), "a 'is replaced by" a'.
7. In Article 3, at the end of paragraph 4, the dot is replaced by "a 'and the following point (d) is added:
"(d) geospatial information on the included circular areas around the trees left to cover."
8. In Section 3, at the end of the text of paragraph 6, the words "or the tree left to cover 'shall be added.
9. In Article 3, the following paragraph 8 is added:
"(8) An application for inclusion in the sub-measure of leaving trees for felling may not be lodged before 2026."
10. in Article 7 (4), in the introductory part of the provision, the words "or circular area" shall be inserted after the word "group."
11. in Article 7 (4) (a), the word "or" shall be replaced by a comma and, at the end of the text of the letter, the words "or, until the impact of leaving trees to fend off," shall be added.
12. the following Section 7a is inserted after Section 7, including the title:
Conditions for inclusion in the sub-measure of the leaving of trees for felling
(1) An applicant may submit only one application per year for inclusion in the sub-measure of leaving trees for felling. The minimum number of listed round areas around trees left to be capped per applicant shall be 10 per application and the maximum number shall be 200 per application for all applications submitted for inclusion under this sub-measure for the entire programming period.
(2) An applicant who is a State contribution organisation, an organisational component of a State or a state undertaking may not be included in the submeasure of leaving trees for treing.
(3) In the aftermath of the retention of trees for felling, circular areas in the surrounding areas of trees left for felling on forest land (2) may be included in the territory of the Czech Republic, defined outside the territory of Natura 20003) or specially protected territories (3) in the register of spatial distribution units of forests.
(4) The area of the grassland group shall not include circular areas around the trees left for masonry in the case of a given crop group or round area being included in:
(a) the consideration of conservation of the grassland type of the economic group, the protection and reproduction of the forest tree gene fund or the conservation of habitat trees;
(b) the consideration of conservation of the crop type of economic ensemble and the protection and reproduction of the gene pool of forest trees pursuant to Government Regulation No 29 / 2016 Coll., as amended,
(c) the title of the maintenance of the economic file pursuant to Government Decree No. 147 / 2008 Coll., as amended; or
(d) title of improvement of the species composition according to Government Decree No. 53 / 2009 Coll., as amended.
(5) The applicant shall have a valid plan or outline for a growing group in which it intends to include circular areas around trees left for laying in the aftermath of leaving trees for felling, stored in digital form in a data warehouse. If in the first year of validity of the plan or outline, the applicant does not have a valid plan or outline in the data warehouse, the circle may be classified on the basis of the dates of the previous plan or outline.
(6) The centre of the circular area of the tree left to be rendered shall be at least 20 m from the border of the grassland groups registered to the applicant and at least 40 m from the other centre of the circular area of the tree left to be rendered.
(7) The applicant in the field shall colour-mark the tree left to cover with a wave, except in yellow, 5 cm wide in a clearly visible place. Above the bellows, the applicant shall indicate the selected designation of the tree left to the mark size of at least 15 cm.
(8) The applicant shall indicate the location of the centre of the circular area of the tree left to be closed by means of a geolocation tool in the register of spatial forest distribution units. '
13. in Paragraph 8 (5) (b), the words "centre position" shall be inserted after the words "define."
14. In Article 8, paragraph 6 is added:
"(6) The applicant who has submitted an application for inclusion in the sub-measure of leaving trees to cover shall also indicate:
(a) the identification of the circular areas around the trees left for felling;
(b) geospatial information which defines the location of the centre of the circular area around the trees left to cover referred to in the application for classification for which the grant is requested; and
(c) details of the plan or outline. ';
15. in Article 9 (1) (a), the words "or the trees left to cover" shall be inserted after the word "trees."
16. in Article 9 (5) (b), the words "where sanitation has been carried out to prevent the spread of forest pests, the applicant shall leave at least 4 other trees with a minimum calorific thickness of 30 cm."
17. In Article 9, the following paragraph 6 is inserted after paragraph 5:
"(6) The Fund shall grant a subsidy to cover the retention of trees if:
(a) there is a tree left on a given circular surface to cover in accordance with Article 2 (3); and
(b) the applicant shall visibly mark the trees left in the field for covering as indicated in Section 7a (7). "
Paragraph 6 shall become paragraph 7.
18. In Paragraph 10 (1), at the end of point (b), the word "a 'is replaced by a comma.
19. In Article 10, at the end of paragraph 1, the dot is replaced by "a 'and the following point (d) is added:
"(d) EUR 200 / 1 ha of round area classified as a result of leaving the trees for covering."
20. In Article 11 (11) to (13), the words "and the subtlety of leaving trees to cover 'shall be inserted after the words" habitat trees'.
21. In Article 11 (12), the words "or under Article 7a (4)" shall be inserted after the words "Paragraph 7 (4)."
22. In Article 11 (13), the words "or a tree left to be tarred 'shall be inserted after the words" Habitat tree'.
23. in Article 11 (13) (b), the words "or the tree left to the surface" shall be inserted after the word "tree."
24. In Article 11 (14), the words "or a tree left to the ground 'shall be inserted after the words" around the Habitat tree' and the words "or, in accordance with Article 3 (2) (c), from the centre of the circular surface of the tree left to the ground 'shall be inserted after the words" the centre of the Habitat tree'.
25. in Article 13 (1), the words "or the centre of the circular surface of the tree left for the rendering," shall be inserted after the words "Section 7 (6)" and in Section 7a (6) "and the words" one of the circular areas on which "shall be replaced by the words" the circular areas on which. "
26. in Article 13 (5), the words "and Article 9 (6) (a)" shall be inserted after the words "Paragraph 9 (5) (a)," and after the word "tree" shall be inserted the words "or the centre of the circular area of the tree left to be folded."
27. In Article 13 (6), the words "or, where sanitation has been carried out to prevent the spread of forest pests, no minimum of 4 other trees with a minimum calorific thickness of 30 cm shall be inserted after the word" mining. "
28. In Article 13 (7), the words "or Article 9 (6) (b)" shall be inserted after the words "Paragraph 9 (5) (c)," or "after the word" trees "shall be inserted," after the words "Paragraph 9 (5) (c)," the words "or" Section 7a (7) "shall be inserted," and the words "does not provide the applicant with a 3% subsidy for the assigned area for which he has violated the relevant calendar year" shall be replaced by the words "reduce the applicant for the assigned area for which he has broken the condition, the subsidy calculated in accordance with Article 10 for the relevant calendar year by 3%."
29. in Article 14 (2), the words "or 7a (6)" shall be inserted after the words "Section 7 (6)," and the words "or, as a consequence, the leaves of trees to cover," shall be inserted after the words "Section 7 (6)."
30. In Article 14 (3), the words "or the leaving of trees to cover 'shall be inserted after the word" trees'.
31. in Article 14 (7), the words "(a), (b) or (6) (a)" shall be inserted after the words "Article 9 (5)" and the words "or, by way of derogation, leaving the trees to fouling."
32. In Article 14 (8), the words "or the subtlety of leaving trees for sawing 'shall be inserted after the word" trees' and the words "or the centre of the circular surface of the tree left for sawing 'shall be inserted.
Transitional provision
The procedure for an application initiated under Government Regulation No. 72 / 2023 Coll., as effective before the date of entry into force of this Regulation, shall be completed under Government Regulation No. 72 / 2023 Coll., as effective before the date of entry into force of this Regulation.
Efficacy
This Regulation shall take effect on 1 March 2025.
