implementing the Act on the performance allowance in construction
The Federal Ministry of Labour and Social Affairs provides, pursuant to Section 13 of Act No. 23 / 1985 Coll., on Merit in Construction, in agreement with the Ministry of Labour and Social Affairs and the Construction of Republics and with the Central Council of Trade Unions:
§ 1
Selected working jobs
Selected workers' jobs are for the purpose of providing a service allowance in the construction sector, the employment of masons, carpenters, reinforced concrete workers, roofers, construction stokers, shamoters, tunnellers, isolators, chimneys, construction engineers, plant locksmiths and plant electricians on the construction site (1) carried out in the organisation of construction production within the scope of the ministries of the construction republics (hereinafter referred to as "organisations').
§ 2
Serious reasons
(1) Serious reasons where the duration of a selected worker's employment is not required on the date on which the entitlement to an old-age pension is acquired or on the date on which it is awarded or on the date on which the selected worker's employment is interrupted are:
(a) transfer of a worker to another work pursuant to § 37 (1) (a) - (c) of the Labour Code;
(b) the termination of employment by the organisation concerned pursuant to Article 46 (1) (d) of the Labour Code, the dismissal by the worker pursuant to Article 51 (1) (c) of the Labour Code or by agreement for those health reasons;
if they have occurred in the last 10 years prior to the establishment of the entitlement to the service allowance.
(2) The duration of the serious reasons referred to in the preceding paragraph shall be extended for the period during which the worker must obtain the period necessary for entitlement to the service allowance.
§ 3
Forms of application
(1) The application for a service allowance shall contain the following information:
(a) the name and surname of the applicant, date of birth, residence and birth number;
(b) an overview of selected working-class jobs, from when and for which the organisation has been engaged, or of the serious reasons referred to in Section 2,
(c) the type and amount of the claimant's pension, the date on which the pension is acquired, the date on which it was awarded and the payer's pension.
(2) The application must be accompanied by attestations of the duration of the selected workers' employment and by a decision granting a pension.
§ 4
Forms of notification
(1) The notification by the organisation of the award of the service allowance shall contain the information referred to in Article 3 (1) (a) from which the service allowance is granted, its amount and the date on which it is due.
(2) The notification of the organisation that the service allowance does not belong shall include the information referred to in Article 3 (1) (a), the duration of the selected worker's employment, the reasons why the service allowance does not belong and the instructions on the possibility of recourse to the court.
§ 5
Registration of organisations
(1) The organisations shall keep records of the selected workers' employment and the reasons referred to in Article 2 (1). At the request of the staff, they shall issue a certificate of the recorded facts.
(2) The certificate shall contain the information referred to in Article 3 (1) (a) and (b).
§ 6
Efficacy
This Decree shall take effect on 1 July 1985.
