Government Regulation
of 31 August 1954
on aid to cover the operating costs of housing cooperatives.
The Government of the Czechoslovak Republic orders pursuant to § 19 No. 2 and § 21 No. 1 of Act No. 106 / 1953 Coll., on housing construction, maintenance and administration of residential property and their financing:
Providing support.
Local economic administrations, following the management of the municipal economy of the councils of regional national committees and the management of housing and construction councils of central national committees (hereinafter referred to as "local economic administrations of the councils of regional national committees'), grant, at their request, support to cover the necessary operating costs associated with the housing sector, provided that such costs cannot be recovered from the income of the cooperative, including income from non-residential property.
(1) The aid shall be fixed to the cooperative on the basis of the approved annual accounts taking into account:
(a) the difference by which the cooperative's annual expenditure, as part of the planned operational costs of the housing economy, is higher than its planned annual revenues;
(b) other income of the cooperative; and
(c) the obligations which may be required of members of the cooperative under the applicable rules.
(2) If the actual revenues from the cooperative's activities are higher than the planned revenues of its housing assets, the aid shall be fixed taking into account these higher actual revenues.
The Local Economy Administration of the Regional National Committee may, in agreement with the Financial Department, provide the cooperative on a quarterly basis on the basis of its financial plan and its own cost plan, upon request.
Cancellation of refunds and termination of contributions.
(1) Cooperatives shall not be measured in accordance with Act No. 260 / 1937 Coll., on Replacement under the Act on Construction, as amended by Act No. 133 / 1948 Coll. The calculation of the compensation under this Act as well as the compensation prescribed under Government Regulations No. 191 / 1921 Coll., No. 160 / 1923 Coll. and No. 96 / 1924 Coll., if the cooperative has not implemented them, shall be abolished; In the same way, the compensation paid by the State to cooperatives for their salaries under the Act on Construction No. 44 / 1927 Coll., No. 43 / 1928 Coll., No. 45 / 1930 Coll. and No. 65 / 1936 Coll.
(2) From 1 January 1954, cooperatives are not granted a State contribution under Act No. 45 / 1930 Coll. and under Government Decree No. 160 / 1934 Coll., Slovakia under Act No. 85 / 1940 Coll. z., nor a contribution under Act No. 86 / 1946 Coll., on construction renewal, as amended by Act No. 115 / 1947 Coll., or under Act No. 41 / 1947 Coll., on State aid for residential buildings.
Supervision.
(1) The supervision of cooperatives which are responsible for the administration because of the aid granted to them under the existing rules shall be carried out by the Central Board of Cooperatives.
(2) Local economic authorities of the Councils of the Regional National Committees and the Ministry of the Local Economy are entitled to control the management of cooperatives with the aid granted. The identified defects shall be discussed with the Central Board of Cooperatives if they are unable to remedy their own field of competence. The deficiencies identified shall also be taken into account when deciding on the fixing of the aid and the granting of an advance on it. This shall be without prejudice to the possibility of imposing consequences on persons responsible under other provisions.
Transitional provision.
(1) In the second half of 1954, cooperatives may be granted advances for support by the Ministry of the Local Economy in agreement with the Ministry of Finance in its budget, and, on the other hand, local economic management by the Councils of the Regional National Committees in agreement with the Financial Services in the budgets of the respective Regional National Committees, in particular, the funds intended for contributions to housing cooperatives. Advances shall be granted on the basis of the requests of cooperatives, supported by their budgets, supporting the payment of advances in the first half of this year.
(2) After the approval of the 1954 annual accounts of cooperatives, they shall provide for support for this year's management of the local economy by the Councils of the Regional National Committees in agreement with the Financial Unions; In doing so, the cooperatives shall settle the advances granted to them in 1954. In order to establish the support and settlement of advances for 1954, the agreement of the Ministry of the Local Economy is needed in agreement with the Ministry of Finance. Any overpayment shall be returned to the budget of the Regional National Committee by the cooperative; any non-payment shall be paid to him by the Regional National Committee's Board for the local economy from the budget of the Regional National Committee for 1955.
Implementing regulations.
Detailed provisions for the implementation of this Regulation shall be issued by the Ministry of the Local Economy in agreement with the Ministry of Finance.
Efficiency.
This Regulation shall enter into force on the day of its publication; they shall be implemented by the Minister for the Local Economy in agreement with the Minister for Finance.
