DECLARATION
of 28 December 2023
amending Decree No 404 / 2016 Coll., on the formalities and breakdown of the reports necessary for the processing of reports on the operation of systems in the energy sector, including the deadlines, scope and rules for the compilation of reports (Statistical Decree), as amended by Decree No 154 / 2018 Coll.
According to Section 98a (2) (m) of Act No. 458 / 2000 Coll., on the Terms and Conditions of Business and on the Enforcement of State Administration in the Energy Sector and on the Amendment of Certain Laws (Energy Act), as amended by Act No. 131 / 2015 Coll.:
Regulation No 404 / 2016 Coll., on the formalities and breakdown of the reports necessary for the processing of system operation reports in the energy sector, including the dates, scope and rules for the compilation of reports (Statistical Decree), as amended by Decree No 154 / 2018 Coll., is amended as follows:
1. In Paragraph 3 (1), "17 'is replaced by" 20'.
2. in Paragraph 3 (2) (c):
"(c) the distribution of electricity operating the local distribution system with the export or import of electricity outside the territory of the Czech Republic shall draw up statements to the extent specified in Annex 3 to this Decree,"
3. in Article 3 (2), the following point (e) is inserted after point (d):
"(e) the distribution of electricity operating the regional distribution system shall draw up reports to the extent specified in Annexes 3, 5 and 20 to this Regulation;"
Points (e) to (k) shall be renumbered as points (f) to (l).
4. in Article 3 (2) (f), the words "Annex 6" shall be replaced by the words "Annexes 6 and 18."
5. in Paragraph 3 (2) (g), "8 and 12" shall be replaced by "8, 12 and 19."
6. in Article 3 (2) (h), the words "and 19" shall be inserted after the words "12."
7. Annex No 1, including the title and footnote 1, reads as follows:

In the case of a licence holder for the production of electricity which does not use fuels (in particular photovoltaic power plants, wind power plants and hydropower plants) and has a quantity of electricity produced under the Decree governing the reporting of energy from supported sources (1), the Authority shall use as evidence the processing of quarterly and annual reports on the operation of the energy sector systems by the licence holder under the Ordinance governing the reporting of energy from supported sources from the market operator system.

• the quantity of gas stored on all the state sub-accounts of the Czech entry-exit system at the end of each gas day of the previous month
• the quantity of gas stored on all state sub-accounts of the foreign input system at the end of each gas day of the previous month
• the amount of gas transferred from the state sub-accounts of the Czech input-output system to the state sub-accounts of the neighbouring input-output system at the end of each gas day of the previous month
• the amount of gas transferred from the state sub-accounts of the foreign input-output system to the state sub-accounts of the Czech input-output system at the end of each gas day of the previous month
(b) annual dates by 15 May of the following year
• statements according to (a) in the annual version
(c) monthly data during the heating season until the 15th day of the following month
• amount of security standard gas supply based on the system of the market operator after individual gas suppliers
(d) control hourly deduction by 30 April of the year in question
• check hourly reading according to the Czech transmission system operator
• check clock reading by gas producers in the Czech Republic

Transitional provision
The licence holder shall draw up and submit the statements for 2023 in accordance with Decree No 404 / 2016 Coll., as effective before the date of entry into force of this Order.
Efficacy
This decree shall take effect on 1 February 2024.
