DECLARATION
of 23 October 2009
amending Decree of the Ministry of Transport No. 223 / 1995 Coll., on the eligibility of vessels to operate on inland waterways, as amended
The Ministry of Transport provides pursuant to § 52 of Act No. 114 / 1995 Coll., on Inland Navigation, as amended, for the implementation of § 9 (1) and § 10 (2) of this Act:
Decree No. 223 / 1995 Coll., on the eligibility of vessels to operate on inland waterways, as amended by Decree No. 83 / 2000 Coll., Decree No. 186 / 2005 Coll., Decree No. 6 / 2006 Coll., Decree No. 38 / 2006 Coll. and Decree No. 173 / 2009 Coll., are amended as follows:
1. In Annex 2, point 1.01.4. read:
"1.01.4. Where a small vessel is newly put into service by a recreational vessel or by a jet ski which is subject to the technical requirements for recreational craft under another legislation (7), the technical safety requirements for such craft shall be the basic technical requirements laid down in this other legislation and Articles 5.02.3, 5.03, 5.05.4, 5.05.5, 5.06.3, 5.06.4 and 6.01 to 6.04 of this Annex. The requirements laid down in Articles 5.02.3, 5.03, 5.05.4, 5.05.5, 5.06.3, 5.06.4 and 6.01 to 6.04 of this Annex shall not apply to a scooter as defined in the previous sentence. Compliance with the requirements of another legislation shall be demonstrated by the submission of a declaration of conformity and the CE marking of the vessel. Save as otherwise provided in this Annex, the technical safety requirements which were binding upon the entry into service of the vessel in service shall apply. ';
2. In Annex 2, point 1.01.5. read:
"1.01.5. The engine of a small vessel newly put into service and the engine newly installed on a small vessel in service shall comply with the essential technical requirements referred to in another legislation7), including the connection of the EC declaration of conformity to the engine and the CE marking of the measure. This provision shall not apply to the replacement of a built-in engine for the same type, the installation of a vessel's engine, the construction of which has been authorised by 31 December 2009, and vessels which will be newly put into service by 31 December 2010 and to engines which will be newly installed on a small vessel by 31 December 2010. ';
This Decree shall take effect on the 15th day following its publication.
