amending Decree of the Ministry of Transport No. 223 / 1995 Coll., on the eligibility of vessels to operate on inland waterways, as amended
The Ministry of Transport provides pursuant to § 9 (1), § 10 (1) and (5) and § 52 of Act No. 114 / 1995 Coll., on Inland Navigation, as amended:
Decree No 223 / 1995 Coll., on the eligibility of vessels to operate on inland waterways, as amended, is amended as follows:
1. in Article 7 (1) (c):
'(c) for small vessels for a maximum period of eight years, if it is a new vessel, and for a maximum of four years, if it is a vessel put into service; for each second renewal inspection, the part of the vessel shall be checked; for vessels over 25 years of age, the part of the vessel shall be checked at each inspection; an international certificate for a recreational craft for a maximum period of four years may be issued for a small vessel's certificate for navigation abroad,'.
2. In Annex 3, the following paragraph 3.01.1 is inserted:
"3.01.1. On small vessels, only a combustion engine intended for use on a vessel which is manufactured after 1980 but which is not more than 25 years old may be used. This shall not apply to original historical vessels and copies thereof, provided that they have been identified as copies by the manufacturer which was manufactured before 1950 and by vessels with fixed original branded engines or propulsion that were manufactured after 1950. '
The existing paragraphs 3.01.1. to 3.01.5. shall be renumbered 3.01.2. to 3.01.6.
Transitional provisions
For small vessels operating on the effective date of this Decree, an engine other than that intended for use on board and manufactured after 1980 but not earlier than 25 years may be used no more than three years after the effective date of this Decree.
Efficacy
This Decree shall take effect on 1 March 2006.
