DECLARATION
of 26 September 2008
amending Decree No 77 / 2003 Coll., laying down requirements for milk and milk products, frozen creams and edible fats and oils, as amended
The Ministry of Agriculture provides pursuant to § 18 (1) (a) and (g) of Act No. 110 / 1997 Coll., on Food and Tobacco Products, and amending and supplementing certain related laws, as amended by Act No. 146 / 2002 Coll., Act No. 247 / 2003 Coll., Act No. 316 / 2004 Coll. and Act No. 120 / 2008 Coll.:
Decree No. 77 / 2003 Coll., laying down requirements for milk and milk products, frozen creams and edible fats and oils, as amended by Decree No. 124 / 2004 Coll. and Decree No. 78 / 2005 Coll., is amended as follows:
1. In the introductory sentence, footnote 1, including the footnote reference, is deleted.
2. Paragraph 1 (1), including footnotes 1 and 1a, reads as follows:
"(1) This decree implements the relevant provisions of the European Communities (1), following the directly applicable regulation of the European Communities (1a) and adapting the requirements for milk and milk products.
1) Council Directive 83 / 417 / EEC of 25 July 1983 on the approximation of the laws of the Member States relating to certain types of milk proteins (caseins and caseinates) intended for human consumption. Directive 2001 / 114 / EC of 20 December 2001 on certain types of concentrated and dried milk intended for human consumption. Council Directive 2007 / 61 / EC of 26 September 2007 amending Directive 2001 / 114 / EC on certain types of concentrated and dried milk intended for human consumption.
(1a) Council Regulation (EC) No 1234 / 2007 of 22 October 2007 establishing a common organisation of agricultural markets and on specific provisions for certain agricultural products (Single CMO Regulation). "
3. In Article 1, at the end of paragraph 3, the dot is replaced by a comma and the following points (ee) to (gg) are added:
"(ee) milk retention - the product obtained by the concentration of milk proteins based on the ultrafiltration of milk, partly skimmed milk or skimmed milk,
(ff) milk permeate - the product obtained by removing milk proteins and milk fat from milk, partly skimmed milk or skimmed milk based on ultrafiltration,
(gg) lactose - a natural component of milk which is normally obtained from whey with an anhydrous lactose content of at least 99,0% m / m on the dry anhydrous product; may be anhydrous or contain one crystal water molecule or may be a mixture of both forms. ';
4. In Article 3 (1), "44 'is replaced by" 43'.
5. in Paragraph 3 (24), point (f) shall be deleted;
Point (g) shall be renumbered as point (f).
6. Paragraph 3 (34) is deleted.
Paragraphs 35 to 44 shall be renumbered paragraphs 34 to 43.
7. In Paragraph 4, the following paragraph 9 is inserted after paragraph 8:
"(9) In the case of concentrated milk and milk powder, the protein content of milk may be adjusted at a minimum level of 34% by weight in non-fatty dry matter by adding or removing milk ingredients in such a way that the ratio between whey proteins and casein is not altered in the treated milk. Milk retention, milk permeate and lactose may be used for this adjustment. '
Paragraphs 9 to 13 shall be renumbered paragraphs 10 to 14.
8. Paragraph 11 (l) reads:
"(l) virgin oil - oil under the Single CMO Regulation (1a)."
9. In Annex No 2, Tables 5 and 6 read:
