DECLARATION
of 2 March 2018
amending Decree No 277 / 2004 Coll., on the determination of medical fitness to drive motor vehicles, medical fitness to drive motor vehicles with the condition and requirements of a medical certificate certifying health reasons for which a safety belt cannot be fastened on the seat of a motor vehicle (Ordinance on medical fitness to drive motor vehicles), as amended
According to § 137 (3) of Act No. 361 / 2000 Coll., on road traffic and on amendments to certain laws (Road Traffic Act), as amended by Act No. 411 / 2005 Coll. and Act No. 101 / 2013 Coll., to implement § 84 (7) of the Road Traffic Act:
Decree No. 277 / 2004 Coll., on the determination of the medical fitness to drive motor vehicles, medical fitness to drive motor vehicles with the condition and formalities of a medical certificate certifying the health reasons for which the safety belt cannot be fastened to the seat of a motor vehicle (the certificate on medical fitness to drive motor vehicles), as amended by Decree No. 253 / 2007 Coll., Decree No. 72 / 2011 Coll. and Decree No. 271 / 2015 Coll., are amended as follows:
1. At the end of footnote 1, the sentence "Commission Directive (EU) 2016 / 1106 of 7 July 2016 amending Directive 2006 / 126 / EC of the European Parliament and of the Council on driving licences' is added.
2. In Annex No 3, Chapter IV, item 1, Group 1 (a), the word "serious' is replaced by the words" uneffectively treated severe '.
3. In Annex 3, Chapter IV, item 1, Group 1, the word "or 'shall be deleted at the end of point (b).
4. In Annex 3, Chapter IV, item 1, Group 1, at the end of point (c), the dot is replaced by a comma and the following points (d) and (e) are added:
"(d) inefficiently treated cardiovascular disease associated with the risk of sudden loss of consciousness, such as severe cardiomyopathy, large aneurysms of the thoracic or abdominal aorta, severe valve defects or congenital heart defects, or
(e) conditions requiring mechanical support for cardiac activity. ';
5. In Annex 3, Chapter IV, item 1, Group 2, point (b):
"(b) severe heart, vascular or valve disease, including congenital in functional class III and IV of NYHA classification,"
6. In Annex 3, Chapter IV, item 1, Group 2 (e), the word "defibrillator 'is replaced by" cardioverter-defibrillator'.
7. In Annex 3, Chapter IV, item 2, Group 1 (a), the words "and other serious forms of coronary artery disease 'shall be inserted after the words" myocardium'.
8. In Annex 3, Chapter IV, item 2, Group 1 (b), the word "defibrillator 'is replaced by" cardioverter-defibrillator'.
9. In Annex 3, Chapter IV, entry 2, Group 1 (d), "a 'is replaced by" a', the words "or valve including congenital 'are inserted after the word" blood vessels' and the words "or 'are deleted at the end of point (d).
10. In Annex 3, Chapter IV, item 2, Group 1, at the end of point (e), the dot is replaced by "or 'and the following point (f) is added:
"(f) treated cardiovascular disease associated with the risk of sudden loss of consciousness, such as severe cardiomyopathy, large aneurysms of the thoracic or abdominal aorta, severe valve defects or congenital heart defects."
11. in Annex 3, Chapter in entry 1, the words "Group 1 and 2 'are replaced by the words" Group 2';
12. In Annex 3, Chapter in entry 1, Group 2 (b), the words "without warning symptoms or the applicant or the driver does not realize them 'are replaced by the words" which the applicant or driver is unable to recognise ("non-recognition syndrome') ';
13. In Annex 3, Chapter in entry 2, Group 1:
"Group 1
(a) a second and other awake hypoglycaemia occurring within a period of 12 months of the first hypoglycaemia and to be managed by another person,
(b) a second and other awake hypoglycaemia occurring within a period of 12 months of the first hypoglycaemia and which the applicant or driver is unable to recognise ("non-recognition syndrome"),
(c) a condition within 12 months of the first hypoglycaemia requiring the assistance of the other person,
(d) diabetes mellitus accompanied by serious organ complications, or
(e) diabetes mellitus when treatment with medicines at risk of developing hypoglycaemia has been initiated and the driver or applicant
1. is adequately informed about hypoglycaemia, and
2. proves that it understands the risks posed by hypoglycaemia and shows that it can control this condition sufficiently; the method of demonstration shall be recorded by the physician in the medical file kept on the person under assessment.
Regular medical examination of the medical condition by the physician of the relevant specialised competence shall always be a condition of medical fitness, to be carried out at least once every 3 years. '
14. In Annex No 3, Chapter V, entry 2, Group 2 (a), the words "in points (c) and (d) 'shall be inserted after the words" for Group 1'.
15. in Annex 3, Chapter In entry 2 of Group 2 of the final part of the provision, the words "3 years' are replaced by the words" year '.
Efficacy
This decree shall take effect on the 15th day following its publication.
