COMMUNICATION
Ministry of Foreign Affairs,
supplementing and correcting Decree No 21 / 1968 Coll., on the Convention on the Privileges and Immunities of International Professional Organisations, approved by the United Nations General Assembly in New York on 21 November 1947
The Ministry of Foreign Affairs announces that on 6 September 1988 the Czechoslovak Socialist Republic informed the Secretary-General of the United Nations, in accordance with Article XI (43) of the Convention on the Privileges and Immunities of International Professional Organisations, approved by the United Nations General Assembly in New York on 21 November 1947, of the decision to make binding the provisions of the Convention on:
(i) the Food and Agriculture Organisation of the United Nations (FAO);
(j) the World Intellectual Property Organisation (WIPO);
(k) the United Nations Industrial Development Organisation (UNIDO).
The implementation of the provisions of the Convention in relation to those organisations under its Article XI, Section 43, became effective for the Czechoslovak Socialist Republic on 6 September 1988.
Furthermore, on 26 April 1991, the Czech and Slovak Federal Republics informed the Secretary-General of the United Nations of the decision to implement the provisions of this Convention with respect to:
(l) the International Monetary Fund (IMF),
m) International Bank for Reconstruction and Development (IBRD),
(n) International Financial Corporation (IFC); and
(o) the IDA.
The implementation of the provisions of the Convention in relation to these organisations under its Article XI, Section 43, became effective for the Czech and Slovak Federal Republic on 26 April 1991.
At the same time, on 26 April 1991, the Czech and Slovak Federal Republics announced to the Secretary-General of the United Nations an appeal to the Convention on the Privileges and Immunities of International Professional Organisations of 21 November 1947, which was made when the Czechoslovak Socialist Republic acceded to the Convention on 29 December 1966.
The Federal Assembly of the Czech and Slovak Federal Republic has given its assent to the withdrawal of the reservation and the President of the Republic signed the reservation.
Withdrawal of the reservation:
"The Czechoslovak Socialist Republic shall not be considered to be bound by the provisions of Sections 24 and 32 of the Convention which provide for the binding jurisdiction of the International Court of Justice in disputes arising from the interpretation or implementation of the Convention; As regards the jurisdiction of the International Court of Justice for these disputes, the Czechoslovak Socialist Republic takes the view that in order for a dispute to be brought before the International Court of Justice to be resolved, the consent of all parties in the dispute is necessary in each case. This reservation shall also cover the provisions of Section 32 according to which the parties are to accept the International Court of Justice's opinion as decisive. ';
took effect on 26 April 1991.
On 22 February 1993, the Czech Republic notified the Secretary-General of the United Nations that it was considered to be bound by the Convention on the Privileges and Immunities of International Professional Organisations of 21 November 1947, including the Communication, with effect from 1 January 1993.
At the same time, the Ministry of Foreign Affairs states that in Decree No. 21 / 1968 Coll., on the Convention on the Privileges and Immunities of International Professional Organisations, the title of the Convention is to read correctly:
"CONVENTION
on the privileges and immunities of international professional organisations approved by the United Nations General Assembly on 21 November 1947 ';
and the text of the Convention between the conclusion of Section 17 and the title of Section 18 is to be correctly indicated:
„Článek VI
Officials'.
