THE LAW
of 8 February 1995
on non-periodic publications
Parliament has decided on this law of the Czech Republic:
(1) For the purposes of this Act, non-periodical publications are copies of literary, scientific and artistic works (1) intended for public dissemination, which are published on a one-off basis, or no more than once a year, or in parts or more, if they form a single whole.
(2) For the purposes of this Act, public dissemination means the making available of non-periodical publications to an individually unspecified circle of persons.
(3) This Act shall not apply to the following non-periodic publications:
(a) copies of audiovisual works, 2)
(b) copies which serve the operational need for the manufacture and disposal of products or for the provision of services, or copies which form part of products;
(c) banknotes, postage stamps, coins, credit stamps, 3) stamp stamps, postal prices, tickets and securities, 4)
d) Plastic and Wall Maps, Globes and Basic and Thematic State Map Works 5) in Analog and Digital form,
(e) three-dimensional copies of works of art;
(f) copies of computer programs, 1)
(g) promotional materials of political parties and political movements, civil associations, organisations with an international element, foundations, churches and religious societies, 6)
(h) copies issued abroad unless the publisher has an organisational component in the Czech Republic.
(1) The non-periodic publication shall contain the following information:
(a) the name of the work;
(b) the names of the authors whose works are contained in the publication if they are known and the authors have not expressly prohibited their publication, or the pseudonyms of the authors,
(c) the trade name and registered office or the name, surname and permanent residence of the person who issued the non-periodic publication (hereinafter referred to as the publisher);
(d) the year of first issue, if known;
(e) for works translated, the original title of the work and the title of the edition from which the translation was obtained,
(f) the title of the copyright holder;
(g) International standard numbering of books, if any,
(h) the trade name and registered office or name, surname and permanent residence of the person who produced the non-periodic publication and the year in which the publication was issued.
(2) The publisher shall ensure that non-periodic publications contain the information referred to in paragraph 1.
(3) A non-periodic publication which does not contain the information referred to in paragraph 1 must not be published.
(1) The publisher shall, free of charge and in respect of his or her cargo, submit to the following beneficiaries, within 30 days of the date of issue (1), a specified number of publications (hereinafter referred to as "compulsory copies," except as referred to in paragraph 2:
(a) two compulsory copies of the National Library of the Czech Republic,
b) one compulsory copy of the Moravian Earth Library in Brno,
(c) one compulsory copy of the Scientific Library in Olomouc;
d) one regional compulsory copy of the Municipal Library in Prague and the local regional library according to the publisher's seat.
(2) The publisher of the non-periodical publication, taken in blind letters, is obliged to submit one compulsory copy to the Library and Printer for the blind K. E. Macana in Prague.
(3) If the required copy of the defect has been submitted in the light of technical processing, the consignee shall be entitled to request its replacement for impeccable. This right may be exercised within three months of the date on which the copy was delivered to him, otherwise his right shall cease. The publisher shall make the exchange within 10 days from the date on which he has received the speech of the recipient by whom he has exercised the right to exchange.
The publisher is obliged to offer one copy of the books to the libraries designated by the Ministry of Culture within 30 days of the date of issue from each non-periodical publication which he issues. The time limit for receipt of an application for the conclusion of a purchase contract shall be one month from the receipt of the tender. If the tender is not accepted within that period, the right to conclude the purchase contract shall cease.
(1) A natural, legal or business natural person commits an offence by publicly disseminating a non-periodic publication which does not contain the information referred to in Article 2 (1).
(2) The publisher of the non-periodic publication shall commit an offence by:
(a) shall not ensure that the non-periodic publication contains the information referred to in Article 2 (1);
(b) shall not surrender compulsory copies of the non-periodic publication referred to in Article 3; or
(c) fails to fulfil the bidding obligation under Article 4.
(3) A penalty may be imposed in respect of an offence:
(a) 15 000 CZK if the offence referred to in paragraph 2 (c) is committed;
(b) 25 000 CZK if the offence referred to in paragraph 1 is committed,
(c) 50 000 CZK if the offence referred to in paragraph 2 (a) or (b) is committed.
(4) Transfers under this law are discussed by the Regional Office. Where an offence is committed pursuant to paragraph 2, the local jurisdiction of the Regional Office shall be governed by the seat or place of residence of the publisher of the non-periodic publication.
The scope laid down by the Regional Authority under this Act is the exercise of the delegation.

Paragraph 2 (3) shall not apply to publications issued before the application of this Law.
This Act shall take effect on 1 January 1996.
