DECLARATION
of 16 September 2025
amending Decree No. 488 / 2021 Coll., on the terms and conditions for connection to the gas system
Pursuant to § 98a (2) (g) and (p) of Act No. 458 / 2000 Coll., on the Terms and Conditions of Business and on the Enforcement of Government Administration in the Energy Sector and on the Amendment of Certain Laws (Energy Act), as amended by Act No. 158 / 2009 Coll., Act No. 211 / 2011 Coll., Act No. 382 / 2021 Coll., Act No. 469 / 2023 Coll., Act No. 87 / 2025 Coll. and Act No. 223 / 2025 Coll.:
Decree No. 488 / 2021 Coll., on the conditions for connection to the gas system, is amended as follows:
1. In Section 1, the words "and 'after the words" to be connected' are replaced by the words "equipment in biomethane production plants'; the words" necessary equipment to ensure the safe and reliable operation of the distribution system in gas production plants and the conditions for the establishment and operation of gas composition adjustment facilities';
2. in Article 2 (e), the words "total maximum and minimum hourly capacity" are replaced by the words "total maximum and minimum hourly quantities of gas collected or delivered," and the words "combination" are replaced by the words "size of the total required."
3. in Article 2 (f), the word "technical" shall be deleted;
4. in Article 3 (1) (d):
"(d) the proposed minimum power of the installation corresponding to the total annual gas collection from the transmission system or to the supply of gas to the transmission system of at least 10 000 MWh if the connection of the installation to the transmission system is required.";
5. In Article 3 (2), the word "or 'shall be added at the end of point (b).
6. in Article 3 (2), point (c) shall be deleted;
Point (d) shall be renumbered (c).
7. in Paragraph 3 (2) (c) and in the title of Annex No 1, the word "retail" is replaced by "retail."
8. In Article 4 (1) of the Introductory Part of the provision, the words "in paper or electronic format 'are inserted after the words" to be lodged'.
9. in Paragraph 4 (1), the word "or" shall be deleted at the end of (c).
10. In Article 4, at the end of paragraph 1, the dot is replaced by a comma and the following points (e) to (g) are added:
'(e) before changing the required maximum and minimum hourly quantities of gas;
(f) prior to a change in the nature of the sampling point; or
(g) before changing the measuring device. ';
11. in Article 4 (2), the words "or (d)" shall be replaced by the words "to (g)" and at the end of the paragraph, the sentence "In the event of a change referred to in paragraph 1 (e) concerning a customer of a household category or a retail customer with the character of cooking, preheating or heating under the regulation governing the gas market rules," shall not apply, and the condition for connecting the applicant's equipment to the parent system is only the conclusion of a connection contract where the change of the required maximum or minimum hourly amount of gas does not exceed 20% of the values agreed in the existing connection contract and the expected annual gas consumption in the existing connection contract is no more than 63 MWh. "
12. Paragraph 6 (3) reads as follows:
"(3) In the case of a request for a gas plant to be connected to a distribution system, the distribution system operator shall propose the connection conditions to the extent specified in Annex 10 to this Regulation so that they comply with the requirements for the technical readiness of the relevant part of the distribution system. In other cases of a request for connection of a gas production plant, the parent system operator shall propose technical connection conditions to include the conditions for installation of the necessary equipment to ensure the safe and reliable operation of the parent system. ';
footnote 2 is deleted.
13. In Article 6, the following paragraph 4 is added:
"(4) Where the connection or operation of the applicant's installation equipment is necessary, the operator of the parent system shall propose the technical connection conditions to include the installation and operation conditions for the gas composition adjustment equipment. ';
14. in Article 8, the words "(b) or (d)" shall be replaced by "(c)," the words "; this shall not apply to an applicant of a household category and a retail consumption, to whom the parent system operator shall submit a proposal for the conclusion of a connection contract within 7 days of the date of receipt of the request" shall be deleted and the sentence "In the case of a requirement under the first applicant of the household category and a retail customer, and in the case of a requirement under Article 4 (2), the parent system operator shall submit a proposal for the conclusion of a connection contract within 7 days of receipt of the request."
15. in Article 9 (2), the words "due to special consideration" shall be deleted;
16. In Article 9, the sentence "This shall not apply to customers of the category of medium and wholesale customers where the distribution system operator and the applicant agree in writing to extend this period; that extension may be for a maximum period of 12 months. ';
17. in Article 9, the following paragraph 6 is added:
"(6) If a customer with a type A or B measurement under the Gas Measurement Order has not agreed with the distribution system operator a corresponding increase in fixed daily distribution capacity within 12 months of the date of the change in the connection contract, the collateral at the required capacity increase value shall cease to exist. This shall not apply where the distribution system operator and the applicant agree in writing to extend this period; that extension may be for a maximum period of 12 months. ';
18. In Paragraph 10 (2), the word "s' is inserted after the word" connected '.
19. In Article 10 (5), the words "or the start of the gas collection or, if the capacity increase referred to in Article 9 (6) is terminated 'shall be inserted after the word" operation'.
20. In Article 10 (8), the words "and Article 4 (2) 'shall be added at the end of the first sentence.
21. In Paragraph 13, the current text becomes paragraph 1 and the following paragraph 2 is added:
"(2) If the connection of the applicant's installation to the gas composition adjustment installation is a necessary condition, the installation shall be connected beyond the standard connection. ';
22. In Section 14, the word "biomethane 'is replaced by" gas from renewable energy sources'.
23. In Annex 3, Part B, at the end of paragraph 2, the dot is replaced by a comma and the following point (e) is added:
"(e) in the case of a hydrogen factory, a technological description of the production.";
24. In Annex 5, Part B, paragraph 2, including footnote 5, read:
"(2) The applicant shall also indicate in the application:
(a) the nature of the sampling point (5) - the nature of the collection or the predominant nature of the collection, timing and use of the sampling point,
(b) estimated annual consumption (m3.r-1, MWh.r-1),
(c) the capacity required (m3.h-1),
(d) data on numbers, types, types and unit inputs (m3.h-1, kW) of installed appliances (existing, cancelled, required).
5) Annex 13 to Decree No. 349 / 2015 Coll., on Gas Market Rules, as amended. '
25. In Annex No 5, Part B, the following paragraph 3 is added:
"(3) The applicant in the category of customers shall also indicate the intermediate or wholesale customer in the application:
(a) the quantity and timing of gas distribution, in particular the expected maximum annual gas consumption (m3.r-1, MWh.r-1) and the maximum hourly gas consumption (m3.h-1, MWh.h-1), both broken down over the period from 1 April to 30 September inclusive and from 1 October to 31 March inclusive, and the maximum daily gas consumption (m3.d-1, MWh.d-1);
(b) for sampling points for which two or more measuring devices, the maximum and minimum hourly amount of gas (m3.h-1) for each measuring device, are envisaged for account of differences in the input or location of individual appliances, etc.,
(c) in the case of appliances, the estimated date of their entry into service, if different from the date of connection of the sampling point, and information on the use of the appliances as backup;
(d) for appliances with power consumption above 100 m3.h-1, the possibility of accidental operation and seasonal use;
(e) the sampling curve during the maximum gas day after each hour in the case of the predominant nature of the technology;
(f) the existence of a multi-cephalic system, the estimated part of the daily distribution capacity which may be covered by the transition to replacement fuel and the number of days of operation per replacement fuel at the level of the estimated daily distribution capacity;
(g) the intention to produce electricity or to provide balancing services to the TSO. "
26. In the title of Annex 9, the word "BIOMETANE 'is replaced by" ENERGY GAS'.
27. In Annex 9, the current text becomes paragraph 1 and the following paragraph 2 is added:
"(2) The technical requirement for the construction of a coal pipeline connecting a hydrogen production from renewable energy sources to a distribution system purchased by a distribution system operator is to build related technological objects as referred to in paragraph 1 (a), (c), (d) and (e) together with a gas composition adjustment device."
28. The following Annex 10 is added, including the title:
"Annex No 10
EQUIPMENT INSTALLED IN GAS PRODUCTION NOT AVAILABLE FOR SAFE AND SOLUTIVE OPERATIONS OF THE DISTRIBUTION SYSTEM
1) In order to ensure the safe and reliable operation of the distribution system, the distribution system operator shall propose conditions for the location, installation and provision of access in gas production facilities for:
(a) deorisation of gas;
(b) ensuring that the specified maximum input pressure to the distribution system is not exceeded and that the gas flow back from the distribution system is prevented;
(c) the possibility of shutting down the gas plant by means of a closing fittings;
(d) remote transmission of data to the distribution system operator's dispatching system from the deoring plant, from the gas output pressure from the gas plant and from the gas quality measurement and the supplied gas quantity, including both operational and recalculated values;
(e) remote control from the distribution system operator's dispatching system for the operation of the deoring and gas supply interruption devices.
(2) The distribution system operator shall ensure the operation of the facilities referred to in paragraph 1 (a), (d) and (e).
(3) In the case of a hydrogen production plant, the distribution system operator shall propose conditions for the location, installation and provision of access for the equipment referred to in paragraph 1, together with the gas composition adjustment equipment, including remote data transmission equipment from the installation to the distribution system operator's dispatching and remote control equipment. In such a case, the distribution system operator shall ensure the operation of such facilities alongside the installation referred to in paragraph 2. ';
Transitional provision
The application for connection, the application for the conclusion of the connection agreement or the request for amendment of the connection agreement submitted before the date of entry into force of this decree shall be assessed in accordance with Decree No 488 / 2021 Coll., as effective before the date of entry into force of this decree, including the determination of the costs associated with the connection.
Efficacy
This Decree shall take effect on the day following that of its publication.
