DECLARATION
of 2 June 2004
on certain details of the major accident prevention system
The Ministry of the Environment provides, pursuant to § 5 (3), § 7 (4), § 8 (3), § 11 (6), § 12 (10) and § 14 (4) of Act No 353 / 1999 Coll., on the prevention of major accidents caused by selected hazardous chemicals and chemical products and amending Act No. 425 / 1990 Coll., on District Offices, the modification of their scope and on certain other measures related thereto, as amended (Act on the Prevention of Major Accidents), as amended, as amended by Act No. 82 / 2004 Coll., (hereinafter referred to as "Act '):
Principles for the analysis and assessment of major accident risks
(K § 5 (3) of the Act)
(1) Analysis and assessment of major accident risks shall be carried out for the purposes of:
(a) processing of a major accident prevention security programme, 1)
(b) processing of security report.2)
(2) For risk analysis and assessment procedures shall be adopted and implemented to ensure a systematic risk assessment, both from normal and exceptional operating conditions, and an estimate of the likelihood of their occurrence and the severity of the possible consequences.
(3) A risk analysis and assessment is carried out for:
(a) the object or equipment from the project documentation processing phase to the destruction of the object or equipment;
(b) normal and exceptional operating conditions, including possible failure of the human factor;
(c) the possibility of an external threat.
(4) The extent of possible damage is expressed in terms of risk
(a) the health and lives of persons;
(b) livestock;
(c) the environment;
(d) property.
(5) The risk analysis and assessment shall identify and establish requirements for the qualification, assumptions and training of staff and the organisation of work.
(6) Risk analysis and assessment must be documented, including an indication of the methods used and of the basic approaches used to eliminate or reduce risks.
(7) Risk analysis and assessment shall be carried out using qualitative and quantitative analytical methods to the extent and details that must correspond to the likelihood of a major accident occurring and the severity of its possible consequences.
(8) Where the resulting value of a major accident risk appears disproportionate to a given risk source, a more detailed risk analysis shall be carried out and risk reduction measures shall be established and implemented. The implemented measures shall be re-examined by risk analysis and assessment.
(9) The acceptability or unacceptable risk is given by a summary of the results of the analysis and risk assessment and an evaluation of other local conditions and factors (e.g. social, economic, territorial and other).
Structure of the safety management and major accident prevention system
(K § 7 (4) of the Act)
(1) Parts of the security programme for the prevention of a major accident, hereinafter referred to as "the programme," are subdivided into:
(a) the overall objectives and principles for preventing a major accident;
(b) a safety management system;
(c) organisation of major accident prevention,
(d) management of the operation of the premises or equipment;
(e) control of changes in the object or equipment;
(f) emergency planning;
(g) monitoring the implementation of the programme;
(h) control and audit.
(2) Overall objectives and principles for the prevention of a major accident
(a) they are based on the analysis and assessment of the risks of a major accident and shall be established in a framework such that they are always in a clear and comprehensible manner to ensure the adequate structure and functioning of the major accident prevention and safety management system for each of the areas referred to in paragraph 1;
(b) they must correspond to the nature of the sources of danger and must be clearly and clearly expressed;
(c) may be part of work and environmental safety programmes, provided that they are expressed and processed in the structure and scope of this decree.
(3) The safety management system is part of the overall management of the building or equipment and includes the creation and introduction of indicators, parameters and criteria necessary for the subsequent evaluation of the effectiveness of the measures implemented.
(4) A major accident prevention organisation shall enable the objects or facilities to meet the objectives set. The necessary technical, financial and human resources are planned to achieve the objectives. Organisation of major accident prevention
(a) ensure that at all levels of management the tasks and duties of personnel involved in the reduction of major-accident risks and the responsibility of individuals for carrying out the tasks are laid down;
(b) include the provision of adequate human resources management, i.e. the selection of personnel for activities directly affecting the possibility of a major accident, the provision of the necessary education and training of the staff of the establishment or establishment, and, where necessary, the staff of the cooperating organisations working in the territory of the establishment or establishment;
(c) include the identification of activities requiring specific training and training of relevant staff;
(d) include in the premises and facilities the provision of employee participation in the preparation, implementation and implementation of the programme.
(5) The management of the operation of the object or equipment ensures that:
(a) procedures are established, adopted and put in place to ensure the safe conduct of all relevant activities, including maintenance and permanent or temporary cessation of operation of the premises or installations;
(b) the procedures, instructions and methods for ensuring the safe performance of the activities shall be prepared in cooperation with the staff performing them;
(c) written procedures, instructions and methods shall be regularly updated and made available to all employees whose activities are affected. The documentation may refer to the relevant internal rules at each point.
(6) Control of changes in the object or device ensures that
(a) safe procedures for planning and making changes to existing premises, installations or plants, including storage, are prepared, adopted and put in place. The planned changes shall be assessed in terms of their impact on operational safety,
(b) particular attention shall be paid to changes in staffing, technical solutions, technological processes, software and changes in external conditions which may affect the occurrence and consequences of major accidents;
(c) the procedures for managing changes are also used in the design and implementation of new production and storage facilities and processes.
(7) Emergency planning shall ensure, inter alia, that they are accepted, implemented and documented.
(a) procedures for identifying expected emergency situations based on identified sources of major accident risk;
(b) the means of verification and assessment of compliance of emergency plans and measures to protect and intervene in order to reduce the impact of a major accident with the emergency situations identified.
(8) Monitoring the implementation of the programme shall ensure that they are:

(e) procedures for recording and investigating accidents, including those without consequences, and procedures for implementing corrective measures.
(9) Control and audit ensure that they are:
(a) procedures for periodic and systematic examination and evaluation of the implementation of the programme and the effectiveness of the safety management system and the prevention of a major accident are adopted and implemented;
(b) the results of the checks and other findings are documented;
(c) the results of the checks are discussed by the management of the operator and, where appropriate, the programme and the resulting activities are updated;
(d) provide for audits carried out by an independent organisation. The audit results serve as an objective indicator of the function of the safety management system and the prevention of a major accident.
Major accident prevention security programme
(K § 7 (4) of the Act)
The scope and manner of processing of the programme document for the protection of life and health of humans, livestock, the environment and property are set out in Annex 1.
Content of the Safety Report chapters
(K § 8 (3) of the Act)
The content of the chapters of the safety report document is set out in Annex 2.
Scope and manner of processing of the internal emergency plan
(Paragraph 11 (6) of the Law)
(1) The internal emergency plan provides for:
(a) a way of ensuring emergency preparedness for information, material, human and economic resources in the event of an accident;
(b) the way in which possible accidents are handled;
(c) measures to ensure appropriate monitoring of the consequences and remediation of the accident site.
(2) The internal emergency plan is updated and verified by practical exercises. The results of the different types of practical exercises shall be documented and written entries, indicating the deficiencies identified, including the deadlines for their removal. The documentation is part of the internal emergency plan.
(3) The scope and manner of processing the internal emergency plan are set out in Annex 3.
Scope and manner of processing of the documentation for the establishment of the emergency planning zone and for the development of an external emergency plan
(Paragraph 12 (10) of the Law)
The scope and manner of processing of the documentation for the establishment of the emergency planning zone and for the development of an external emergency plan are set out in Annex 4.
Scope and manner of information to the public and procedure for ensuring public information in the emergency planning zone
(Paragraph 14 (4) of the Act)
The scope and manner of processing of information to the public and the procedure for ensuring public information in the emergency planning zone are set out in Annex 5.
Repeal
Decree No 8 / 2000 Coll., laying down the principles for the assessment of the risks of a major accident, the scope and manner of processing of the security programme for the prevention of a major accident and the safety reports, the processing of the internal emergency plan, the processing of the documentation for the establishment of the emergency planning zone and for the development of an external emergency plan and the scope and manner of information to be provided to the public and the procedure for ensuring information to the public in the emergency planning zone.
Efficacy
This Decree shall take effect on 1 July 2004.

Major accident prevention security programme
The document clearly shows that a high level of human and environmental protection is ensured by appropriate means, internal arrangements and management systems. The document shall contain these parts and chapters.
BASIC INFORMATION ON THE OBJECT OR EQUIPMENT
1. Identifying details of the operator of the building or installation
(a) business company (name), registered office, postal address, IC,
(b) the names, surnames and telephone number of the statutory representative.
2. Information about the object or device
(a) name,
(b) address.
3. Activity and Employee Data
(a) principal and ancillary activities, permits and authorisations for such activities;
(b) the year of establishment of the business firm or establishment and the relevant dates for the construction, reconstruction and change of operations;
(c) the number of employees on the premises, including the number of employees on each shift.
PRESENTATION OF THE PROCEDURES AND RESULTS BY ANALYSIS AND EVALUATION OF THE RISK OF SERIOUS HAVARIA FOR THE OBJECT OR EQUIPMENT INCLUDED IN THE GROUP AND
1. Overview of identified objects or equipment, indicating the type and quantity of hazardous substances in them.
2. An overview of all hazardous substances in an object or plant, their classification and the properties needed for risk assessment.
3. Results of assessment and descriptions of hazardous chemical reactions in undesirable contact with chemicals in an object or facility or under undesirable operating conditions.
4. Results of assessments and descriptions of possible situations in an object or plant which have the potential to cause damage to human health, livestock, environment and property.
5. Results, assessment procedure and descriptions of possible situations outside an object or installation which may cause a major accident.
6. Results of identification and descriptions of major accident risk sources, relative assessment of their severity and identification of significant risk sources in the business map.
7. Procedure for identifying and selecting representative major accident scenarios, including their description.
8. Procedure for making estimates of the consequences of representative major-accident scenarios on human health and lives, livestock, environment and property and presentation of the results of estimates.
9. The procedure and results of the estimation of the probability of representative accident scenarios.
10. Results of risk assessment, including a graphical representation of the effects of major accidents.
11. Results of the assessment of the acceptability of major accident risks.
12. Results and the procedure for assessing the influence (reliability and error) of the human factor in relation to relevant sources of risk.
13. Indication of the methodologies used in risk analysis.
14. Detailed descriptions of the non-published methodologies used.
15. Description of the measures for unacceptable sources of risk, their implementation plan and the system for monitoring the implementation of this plan.
16. Description of the system of continuous monitoring of the effectiveness of risk control measures.
17. Information on the assessment carried out of the adequacy of security and safeguard measures in relation to existing risks.
DESCRIPTION OF THE PREVENTION SYSTEM OF SERIOUS HAVARIA INCLUDING CUSTOMS OBJECTIVES AND PRINCIPLES OF THE PREVENTION OF SERIOUS HAVARIA (CONTAINING AND IMPORTANT FULL)
1. Overall objectives and principles for the prevention of a major accident

3. Organisation of major accident prevention
3.1 Information on the organisation and planning of the necessary resources, including:
(a) the way in which technical, financial and human resources are secured and backed up to implement the programme;
(b) whether these resources are also secured in the light of a rapid and effective response in relation to changing or unusual circumstances, as well as the possibility of, for example, changing or eliminating production.
3.2 Information on human resources, i.e. workers involved in the reduction of major accident risks, including
(a) an indication of the employment position (functional classification), a description of the tasks and duties of these staff members, their substitutability,
(b) identification of these workers in the organisation scheme;
(c) an indication of the location of the storage of the current list of such personnel;
(d) the identification of persons (functions) responsible for the establishment and functioning of the safety management and prevention system of a major accident;
(e) reference to documents defining the responsibilities and responsibilities of workers, external organisations and visitors in the major accident prevention sector;
(f) the indication and identification of the responsibilities of managers for:
- ensuring the necessary resources (including human resources) for the development, implementation and functioning of the management system,
- analysis and evaluation of the risks of the object and equipment,

(g) a description of the system for controlling the performance of tasks at all stages of management;
(h) an indication of how to deal with serious accident prevention issues at all stages of the procedure;
(i) an indication of the procedure for informing employees of the results of the major accident prevention proceedings;
(j) an indication of the procedure for dealing with accidents and accidents without consequences (major accidents, accidents, accidents, technical disturbances, accidents, etc.) and the implementation of measures to prevent them,
(k) an indication of how the qualifications of external suppliers and service providers are checked;
