DECLARATION
of 31 January 2006
on the verification of the conformity of the copy or copy with the instrument and the authenticity of the signature
According to Section 21 of Act No. 21 / 2006 Coll., on the verification of the conformity of a copy or a copy with the instrument and on the verification of the authenticity of the signature and on the amendment of certain laws (the Law on Verification), hereinafter referred to as "the Act ':
List of municipal authorities carrying out vision and legalisation
The list of municipal authorities carrying out vision and legalisation is set out in Annex 1 to this Decree.
Vision marking
(1) The visibility shall be marked on the visible sheet by means of a verification clause on each sheet. If the validating person does not provide the verification clause with each sheet of the visible document, they shall join them firmly in the bundle by stitching it over. The sticker shall be affixed by means of an official stamp on both sides so that part of the stamp of the official stamp is printed on the visible sheet. The model of the verification clause is set out in Annex 2 to this Decree.
(2) If there is not enough space on the visible sheet to mark the verification clause, the verification clause shall be marked on a separate sheet of paper fixed to the visible sheet in the manner referred to in paragraph 1, the slip being marked with an official stamp on both sides so that part of the printing of the official stamp is printed on the visible sheet.
(3) Where a visible document is composed of one or more sheets and each single sheet contains only one page described and is visible, the unwritten page of the sheet visible from the upper left corner to the lower right corner shall be crossed out and the verification clause marked on the side of the sheet visible. If there is not enough space to mark the verification clause on the side of the sheet which is visible, the verification clause shall be marked on the other side of each sheet from above, unless these are firmly connected to the volume as specified in paragraph 1.
(4) If there is a visible document in the text or between the verification clause marked on the visible sheet and the text shown on the visible sheet, the sentinel shall cross the unmarked space on the visible sheet from the upper left corner into the lower right corner.
(5) Where the document submitted is an output from an authorized conversion of documents carried out in an automated manner and a multiple sheet is composed of a visible document, the validator shall connect all the sheets of the documents to a fixed volume as specified in paragraph 1.
Legalisation marking
(1) Legalisation shall be indicated by means of a verification clause. The models of the verification clause are set out in Annexes 3 and 4 to this Decree.
(2) If a file of documents is firmly connected to a bundle during legalization, it shall be joined by a suture which shall be folded. The sticker shall be stamped on both sides in such a way that part of the stamp is printed on the instrument.
(3) If there is not sufficient space on the instrument on which the signature is legalized to indicate the verification clause, the verification clause shall be marked on a separate sheet of paper fixed to the document in the manner referred to in paragraph 2.
Test certificate
The model of the certificate showing that the examination provided for in Section 14 (1) (c) of the Act is set out in Annex 5 to this Decree.
Identification of the certificate on the list
(1) The verification clause shall be marked on the instrument visible in the form of:
(a) the stamp and the manual entry of the particulars referred to in Section 8 of the Act by the validating person;
(b) a copy, equipped with computer technology, containing the information provided for in Section 8 of the Act. The copy shall be printed on a self-adhesive label or on a sheet or on a separate sheet of paper. The label shall be affixed on a visible sheet and stamped in such a way that part of the stamp is printed on the visible sheet and part of the stamp is printed on that label. A copy of the verification clause on a separate sheet of paper shall be firmly linked to the visible sheet as referred to in Section 2 (2); or
(c) a printout with the help of computer technology with the manual listing of the data referred to in Section 8 of the Act by the verifying person.
(2) The verification clause shall be marked on the instrument on which the signature is legalized in the form of:
(a) the stamp and the manual entry of the particulars referred to in Article 12 of the Act by the validating person;
(b) a copy, equipped with computer technology, containing the information provided for in Section 12 of the Act. The copy shall be printed on a self-adhesive label or on a sheet or on a separate sheet of paper. The label shall be affixed to the instrument on which the signature is legalised and shall be stamped with an official stamp so that part of the stamp is printed on the instrument on which the signature is legalized and part of the stamp shall be printed on that label. A copy of the verification clause on a separate sheet of paper shall be firmly linked to the document on which the signature is legalized in the manner set out in Section 3 (2); or
(c) a printout with the help of computer technology with the manual listing of the data referred to in Section 12 of the Act by the verifying person.
(3) The verification document shall be affixed by means of a stamp of the sentinel or by hand listing the name or, where appropriate, the names and surnames in block letters, if the name or, where appropriate, the names and surnames are not included in the copy made out by the computer, its signature and official stamp.
(4) The verification clause shall be marked on the instrument so as not to interfere with its contents.
(5) In the event of an error in the verification clause prior to the closure of the vision or legalisation, Article 6c (1) shall apply mutatis mutandis, unless a new verification clause is possible to provide the instrument.
Format and formalities of the document in electronic form for which legalisation may be carried out
(1) An electronic document signed by an electronic signature to be legalized (hereinafter referred to as an electronic signature document) must be in PDF / A format and must not exceed 50 MB. In the case of use of PDF / A format in PDF / A-3 and above, the electronic signature document shall not contain a document in a data format which is not an output data format under the legislation governing the management of the file service or a document containing additional documents.
(2) The electronic signature document shall not contain a malicious code which is capable of causing damage to the information system through which the exercise of the public administration contact points (hereinafter referred to as the "information system ') or the software of the public authority contact point is ensured.
(3) The electronic signature in the electronic signature document must be visible unless it is a guaranteed electronic signature based on an electronic signature certificate.
(4) Where an electronic signature document is signed by a guaranteed electronic signature based on an electronic signature certificate, the integrity of that document shall not be infringed.
Procedure for implementing legalisation on a document in electronic form
(1) An electronic signature document complying with the requirements of Section 5a shall be accepted by the Office through the data storage of the electronic application of the information system in a way that allows remote access (hereinafter referred to as "data storage").
(2) The electronic signature document shall be stored in the data repository for the purpose of legalization for a period of 30 days.
(3) On a document with an electronic signature which meets the requirements of § 5a, the validator shall legalize by attaching a verification clause. The connection of the verification clause shall be carried out by the certifying person using the information system by attaching a document in electronic form containing the verification clause and an imprint of the document on which the electronic signature is legalized. The document containing the verification clause shall be signed by the certifying person by his qualified electronic signature and stamped by a qualified electronic time stamp.
(4) Document containing the verification clause of the Authority after the legalisation of the applicant according to its choice
(a) send it to its data box; or
(b) transmit via the data repository; the document containing the verification clause shall be stored in the data repository for a period of 30 days from the date on which the legalisation was carried out.
Model verification book
(1) The model of the initial certificate sheet is set out in Annex 6 to this order.
(2) The model of the signature model sheet is set out in Annex 7 to this Decree.
(3) The model form for the verification book is set out in Annex 8 to this Order.
Identification of the verification book
(1) The verification book shall bear the name "Verification book" on the front of the binding.
(2) Where the Office has in parallel more than one volume of the verification book, each volume of the verification book shall be marked on the front of the bond and on the opening sheet so that the individual volumes are distinguished from each other. The indication of the volume of the verification book is part of the serial number of the vision or legalization in the verification clause.
Implementation of entries in the verification book
(1) Registration in the verification book shall be carried out by the verifier in the form of:
(a) a manual listing of the prescribed sections of the certificate form; or
(b) the affixing of a self-adhesive label, equipped with computer technology, in the form of a verification book; the applicant for legalisation, the witness and the verifiers are not signed on the label.
(2) If it is not apparent from a document which is visible or on which the signature is legalized, what type of document it is, the verifier shall enter this entry in the relevant section of the verification book on the basis of the applicant's declaration and shall at the same time add a note to this section that the information has been completed on the basis of the applicant's declaration.
(3) The entry in the certificate shall be deemed to be closed at the time of the signature of the certifying person in the relevant section.
(4) The section of the form of the verification book, which will remain blank after the entry, shall be crossed out by the certifying person.
Implementation of corrections in the verification book
(1) In the event of an error in the verification record, the validator shall cross that figure out in such a way that it remains legible, indicate the correct figure and attach to the correction made the "opr 'clause, or" corrected / a', followed by his signature, date and print of the official stamp.
(2) The blank entry in the verification book may be deleted by crossing out the original entry so that it remains legible. The date and imprint of the official stamp shall be indicated on the cancellation of the registration in the certificate, indicating the reason for the cancellation of the registration, to which the certifying person shall attach his signature, the date and the stamp.
(3) The serial number of the cancelled registration shall be used for the following entry in the verification book.
Use of abbreviations
The abbreviation can only be used in the minutes if it is common and does not affect the completeness and clarity of the minutes made. However, the names, surnames, street names and town names cannot be shortened.
Efficacy
This Decree shall take effect on 1 March 2006.
