Act of the Czech National Council on certain measures in the field of radio and television broadcasting

Czech National Council
of 22 December 1992
concerning certain measures in the field of radio and television broadcasting
The Czech National Council decided on this law:
(1) The Council of the Czech Republic for Radio and Television shall decide by 31 January 1993 at the latest which broadcasting circuit is the own broadcasting circuit of the Czech Television. 1)
(2) The next broadcasting circuit of the Czech Television entrusted to the administration is a circuit designated as OK 3 on 1 December 1992, until 31 December 1995, unless otherwise provided for by the law adopted by 31 December 1995.
(1) In the ownership of Czech Television, the date of the demise of Czechoslovak Television transfers the real estate items listed in Annex 1 to this Act and the movable items belonging to them.
(2) The Ministry of Finance of the Czech Republic (hereinafter referred to as "the Ministry") will decide on the scope of the movable items referred to in paragraph 1 on a proposal from Czech Television.
(1) The legal successor of Czechoslovak Television in copyright rights to works and related rights to copyright within the scope set out in Sections 6 and 46 and following of the Act on Literary, Scientific and Artistic Works (hereinafter referred to as "Copyright Act") is Czech Television.
(2) Paragraph 1 shall apply to works produced by a study of Czechoslovak television on the territory of the Czech Republic.
(3) Czech television shall ensure from authorised persons whose works and performances are subject to protection under copyright law, rights to use works and performances under paragraph 1 by third parties, if the third party so requests, under conditions agreed between the third party and the Czech Television. Authorised persons' rights under copyright remain unaffected.
(4) Czech television shall ensure a level playing field for the use of works transferred under paragraphs 1 and 2 by the licence holders for television broadcasting under the conditions laid down by the copyright.
(5) The fulfilment of the obligations under paragraphs 3 and 4 is controlled by the Council of Czech Television.
(1) The property of the Czech Radio with the date of the disappearance of the Czechoslovak Radio transfers the real estate listed in Annex 2 to this Act, the movable property which belongs to it, and the movable property which is found on the effective date of this Act in immovable property owned by the Czech Radio.
(2) The Ministry of Finance of the Czech Republic, acting on a proposal from the Czech Radio, will decide in doubt the extent of the movable items referred to in paragraph 1.
(1) The legal successor of the Czechoslovak Radio in copyright rights to works and related rights to copyright within the scope set out in Sections 6 and 46 and following of the Copyright Act is the Czech Radio.
(2) Paragraph 1 shall apply to works produced by a study of Czechoslovak Radio on the territory of the Czech Republic.
(3) The Czech Radio shall ensure from authorised persons whose works and performances are subject to protection under copyright law, rights to use works and performances under paragraph 1 by third parties, if the third party so requests, under the conditions agreed between the third party and the Czech Radio. Authorised persons' rights under copyright remain unaffected.
(4) The Czech Radio shall ensure a level playing field for the use of works transferred pursuant to paragraphs 1 and 2 by holders of radio licences under the conditions laid down by copyright.
(5) The Council of the Czech Radio shall check the fulfilment of the obligations under paragraphs 3 and 4.
Act No. 468 / 1991 Coll., on the operation of radio and television broadcasting, is amended as follows:
1. Article 9 (3) and (4) read as follows:
"(3) The broadcasting operator is reserved by law for transmission channels (part of the frequency spectrum) and network of transmitters to cover the territory of the Czech Republic by one television programme, including visual and audio information, unless the special law provides otherwise.
(4) The operator of radio broadcasting from the law is reserved for transmission routes (part of the frequency spectrum) and network of transmitters to cover the territory of the Czech Republic by one broadcast circuit in the middle wave band and two broadcast circuits in the very short wave band. "
2. In Section 9 (6), the words "and the licensing authority (Section 10) are added."
3. Paragraph 12 repeals paragraph 2.
4. Paragraph 23 (1) is deleted.
5. Paragraph 24 is deleted.
6. The following Section 28a is inserted after Section 28:
The licensing authority shall decide, on a proposal from the radio operator, by the Act on broadcasting circuit equipment in accordance with Article 9 (4) of the Frequency and on the release of additional frequencies intended for regional broadcasting. ';
The Act of the Czech National Council No. 103 / 1992 Coll., on the Council of the Czech Republic for Radio and Television Broadcasting, as amended by the Act of the Czech National Council No. 474 / 1992 Coll., is amended as follows:
1. In Article 2, the following paragraph 2 is inserted after paragraph 1:
"(2) The Council shall submit to the Czech National Council for approval a draft Council budget not later than the end of October of the previous calendar year and a draft Council final account not later than the end of May of the following calendar year. The budget for 1993 shall be submitted by the Council to the Czech National Council by the end of January 1993 at the latest."
Paragraphs 2 and 3 shall become paragraphs 3 and 4.
Article 2 (5) (4) reads as follows:
"(4) The Czech National Council may revoke the Council if the Council does not fulfil the obligations under Article 2 (2) and (3) of this Act or if the Czech National Council does not approve the Council's final account or reapprove the Council's activity report. The activity report shall be submitted by the Council to the Czech National Council by the end of February of the calendar year."

(1) The activities of the Council are covered by 0,3% of the return on rates for the use of radio and 0,3% of the return on rates for the use of television receivers subject to registration.
(2) The broadcasters shall, by law, pay the Council 0,3% of the rate yield referred to in paragraph 1 by the 15th day of the following calendar month. "
Act of the Czech National Council No. 483 / 1991 Coll., on Czech Television, is amended as follows:
1. in Article 3, point (b) shall be deleted;
2. In Paragraph 9, the following paragraph 2 is inserted after paragraph 1:
"(2) The Director shall require the prior consent of the Council to load or rent for a period of three months or to dispose of real estate or parts thereof. ';
Paragraphs 2 and 3 shall become paragraphs 3 and 4.
3. In Article 12 (3), the words "with the exception of point (a) 'shall be inserted after the words" the law'.
4. The following Sections 14a and 14b are inserted after Article 14:
(1) Czech television also operates on the remaining broadcasting circuit until the licence holder commences on this broadcasting circuit.
(2) In television broadcasting on the broadcasting circuit referred to in paragraph 1, the advertising time shall not exceed 7 per cent of daily broadcasting time.
(3) The holder of the broadcasting licence is obliged to notify Czech Television the day of the launch of his broadcast, but no later than 90 days before that date.
(1) On the broadcasting circuit according to § 14a (1), the Czech Television Intender of News and Publishing (hereinafter referred to as the "intendant") operates while operating the circuit. The Intendant shall be elected by the Council, which may revoke it.
(2) The intendant is obliged to maintain the range of news and publicity programmes, corresponding to at least the extent in 1992.
(3) Disputes between the intender and the Director shall be decided by the Council. "
Act of the Czech National Council No. 484 / 1991 Coll., on Czech Radio, is added as follows:
1. In Paragraph 9, the following paragraph 2 is inserted after paragraph 1:
"(2) The Director shall require the prior consent of the Council to load or rent for a period of three months or to dispose of real estate or parts thereof. ';
Paragraphs 2 and 3 shall become paragraphs 3 and 4.
2. the following Section 9a is inserted after Section 9:
The Czech Radio is entitled to broadcast abroad on order. The costs associated with this shall be borne by the client. ';
This Act shall take effect on 30 December 1992.
