of 3 October 2012
on the sustainability criteria for biofuels
The Government mandates pursuant to Sections 20 (7) and 21 (13) of Act No. 201 / 2012 Coll., on Air Protection ("the Act '):
§ 1
Subject matter
This Regulation implements the relevant European Union1 provisions and sets out the sustainability criteria for biofuels, quality system requirements and mass balance system, the elements of the declaration and the partial declaration of compliance with the sustainability criteria and the elements of the separate declaration of biomass growers, including the particulars of the documentation of the biomass grower pursuant to Article 21 (9) of the Act, the elements of the certificates referred to in Article 21 (1) to (3) of the Act, the basic value of the production of greenhouse gas emissions for fossil fuels and the content of the emission report.
§ 2
sustainability criteria
(1) Biofuels meet sustainability criteria where:
(a) report greenhouse gas emissions savings as referred to in paragraph 3;
(b) the biomass used for their production complies with the requirements set out in paragraphs 4 to 7; and
(c) the biomass used for their production has been grown in accordance with the requirements and standards laid down in the common rules for direct support schemes under the common agricultural policy of the European Union (2), if it is biomass grown in the territory of a Member State of the European Union.
(2) Biofuels produced from waste (3) or residues not derived from agriculture, aquaculture, fisheries or forestry meet the sustainability criteria provided that they show greenhouse gas emission savings in accordance with paragraph 3.
(3) The saving of greenhouse gas emissions in the use of biofuels meeting sustainability criteria compared to greenhouse gas emissions arising throughout the life cycle of the reference fossil fuel shall be at least:
(a) 35% until 31 December 2016,
(b) 50% as from 1 January 2017,
(c) 60% as from 1 January 2018 for biofuels produced in a stationary source put into service on or after 1 January 2017.
The value of greenhouse gas emissions when using biofuels shall be determined in accordance with Section 3. The value of greenhouse gas emissions arising throughout the life cycle of the reference fossil fuel shall be as set out in point 3 of Part B of Annex 1 to this Regulation.
(4) Biomass meeting sustainability criteria must not come from land with a high biodiversity value. Soil with a high biodiversity value is a land that had on or after 1 January 2008 one of the above statuses, whether or not it still has it:
(a) forests and other wooded areas with indigenous species where there are no visible signs of human activity and where ecological processes are not significantly disturbed;
(b) areas established
1. the Act on Nature Conservation and Lands4), implementing legislation or the competent authority for the purposes of nature conservation; or
2. Decision of the European Commission pursuant to Article 7c (5) in conjunction with Article 7b (3) (b) (ii) of Directive 2009 / 30 / EC to protect rare or endangered ecosystems or species;
where biomass cultivation affects those conservation purposes;
(c) highly biodiverse grassland, namely:
1. grassland which, without human intervention, would be preserved as such and which still exhibit the natural composition of species and ecological characteristics and processes;
2. crops which, without human intervention, would not be preserved as grassland and are species-rich and undegraded unless it is demonstrated that biomass extraction is necessary to preserve the status of grassland.
Areas with the presence of biotopes listed in Annex 2 to this Regulation shall be considered to be highly biodiverse grassland unless otherwise provided for by the European Commission by a measure adopted pursuant to the second subparagraph of Article 7b (3) of Directive 2009 / 30 / EC.
(5) Biomass meeting sustainability criteria must not be grown on land with a large carbon stock. Soil with a large carbon stock is a land which, on 1 January 2008, had one of the following statutes and no longer has one:
(a) wetlands which mean land covered or saturated with water permanently or for a significant part of the year;
(b) an area of more than 1 hectare with trees of more than 5 metres and a crown cover of more than 30%, or trees capable of achieving these limits at a given location;
(c) an area of more than 1 hectare with trees higher than 5 metres and a crown cover of 10 to 30% or with trees capable of achieving these limits at a given location, unless it is demonstrated that, in applying the method of calculation set out in Part B of Annex No 1 to this Regulation, the carbon stock is in the area before and after the conversion of the land, such that the conditions laid down in paragraph 3 are fulfilled.
(6) Biomass meeting the sustainability criteria must not come from land which was a peat site on 1 January 2008 unless it is demonstrated that its cultivation and acquisition does not involve the drainage of previously irrigated land.
§ 3
Method for determining greenhouse gas emission savings
(1) For the determination of greenhouse gas emission savings,
(a) the greenhouse gas emission standard values set out in Part A of Annex 1 to this Regulation;
(b) the calculation of the actual values established in accordance with Part B of Annex 1 to this Regulation; or
(c) the calculation according to the formula set out in point 1 of Part B of Annex 1 to this Regulation using certain sub-standard values of greenhouse gas emissions for biofuels set out in Part C of Annex 1 to this Regulation.
(2) The standard values referred to in paragraph 1 (a) may be used only if the annual emissions of greenhouse gases from carbon change due to land use change calculated in accordance with point 6 of Part B of Annex 1 to this Regulation are less than or equal to zero. The standard values listed for headings 1 to 24 in Part A and the sub-standard values for cultivation listed for headings 1 to 18 in point 1 of Part C of Annex 1 to this Regulation may be used if the biomass is:
(a) grown outside the Member States of the European Union;
(b) grown in the Member States of the European Union in the areas listed in Article 19 (2) of Directive 2009 / 28 / EC or Article 7d (2) of Directive 2009 / 30 / EC; or
(c) waste or residues not derived from agriculture, forestry, aquaculture or fishing.
(3) Where biomass is cultivated on arable soils 5) which had arable land status before 1 January 2008, annual greenhouse gas emissions from carbon stock changes due to land use change are considered to be equal to zero.
§ 4
Basic value of greenhouse gas emissions production for fossil fuels
The base value of greenhouse gas emissions production for fossil fuels is 83,8 g CO2ekv / MJ.
§ 5
Content of the emissions report
The emission report shall include the following information:
(a) the total volume of each type of fuel supplied, indicating the place of purchase and its origin; and
(b) the quantity of greenhouse gas emissions per unit of energy contained in the fuel supplied, determined during the complete life cycle of the fuel, including a breakdown into each type of fuel supplied.
§ 6
Quality system and mass balance system
(1) The quality system must at any time enable proof of the origin of biomass, intermediate products and biofuels themselves and shall include:
(a) the introduction and reporting of a mass balance system demonstrating the full origin of biomass, intermediate products or biofuels themselves meeting sustainability criteria when blending them with products that do not meet sustainability criteria;
(b) keeping records of incoming and outgoing products and their keeping records of the separate declarations accepted, the partial declarations of conformity accepted and issued and declarations of compliance issued with the sustainability criteria;
(c) keeping the records referred to in (b) for at least 5 years; and
(d) keeping records of internal processes ensuring that the procedures referred to in (a) and (b) are correct and conclusive.
(2) The mass balance system allows the supply of biomass, intermediate products or biofuels meeting the sustainability criteria set out in Article 2 to be blended even though they have different greenhouse gas emissions production and must ensure that:
(a) information on both the mass and the production of greenhouse gas emissions for individual incoming biomass, intermediate products or biofuels was included in the documentation accompanying the mixture;
(b) the sum of both the mass and the production of greenhouse gas emissions for supplies meeting the sustainability criteria added to the mixture was equal to or greater than the sum of both the mass and the production of greenhouse gas emissions of supplies meeting the sustainability criteria taken from the mixture; that balance must be closed at the latest by the last day of validity of the certificate under Article 21 (1) to (3) of the Act, but not earlier than 30 days before the end of its validity; the incoming and outgoing deliveries of biomass, intermediate products or biofuels purchased or sold after the closing date of the mass balance by the last day of validity of the certificate, including, shall be counted against the following balance sheet period;
(c) in the case of blending of products meeting the sustainability criteria referred to in Article 2 with products which do not meet those criteria, the quantity of sustainable products added to the mixture has been established in advance and the quantity of products to be withdrawn from the mixture and to serve as products meeting the sustainability criteria referred to in Article 2 has not been higher than the quantity of sustainable products added to the blended.
(3) The particulars of the registers are set out in Part A of Annex 3 to this Regulation.
(4) The formalities for registration of biomass growers are set out in Part B of Annex 3 to this Regulation.
§ 7
Documents
(1) The particulars of the certificate are set out in Part A of Annex 4 to this Regulation.
(2) The elements of the biomass producer's separate declaration of compliance with the sustainability criteria, the elements of the sub-declaration of compliance with the sustainability criteria and the elements of the declaration of compliance with the sustainability criteria are set out in Parts B to D of Annex 4 to this Regulation.
§ 8
Transitional provisions
(1) Biomass produced on the territory of the European Union until 31 December 2011 inclusive is considered to meet the sustainability criteria.
(2) Biofuels and liquid or gaseous products intended for the production of biofuels produced on the territory of the European Union until 31 December 2011 inclusive are considered as biofuels and intermediate products meeting the sustainability criteria.
(3) Biofuels produced in a stationary source put into service before 24 January 2008 shall be subject to the savings referred to in Article 2 (3) (a) from 1 April 2013.
§ 9
Repeal
Government Decree No. 446 / 2011 Coll., on the sustainability criteria of biofuels, is repealed.
§ 10
Efficacy
This Regulation shall enter into force on 1 November 2012.

B. Method of calculating greenhouse gas emissions arising throughout the biofuel life cycle
(1) Greenhouse gas emissions resulting from the production and use of biofuels shall be calculated as follows:
EB = eec + el + ep + etd + eu-esca - eccs - eccr - eee,
where:
EB = total greenhouse gas emissions generated throughout the biofuel life cycle;
Eec = greenhouse gas emissions from biomass cultivation and harvesting;
el = annual greenhouse gas emissions from carbon stock changes caused by land use change;
ep = greenhouse gas emissions from processing;
etd = greenhouse gas emissions from transport and distribution;
eu = greenhouse gas emissions from the combustion of the biofuel;
esca = greenhouse gas emission savings from soil carbon accumulation through improved agricultural practices;
eccs = greenhouse gas emission savings by carbon capture and geological storage;
eccr = greenhouse gas emission savings due to carbon dioxide capture and replacement;
Eeee = saving greenhouse gas emissions due to excess electricity from cogeneration;
Greenhouse gas emissions from the production of machinery and other equipment shall not be taken into account.
(2) The total greenhouse gas emissions generated throughout the biofuel life cycle, EB, are expressed as CO2 grams equivalent per megajoule of biofuels [gCO2ekv / MJ].
3. The greenhouse gas emission savings generated by the use of biofuels shall be calculated as follows:
SAFETY = (EF - EB) / EF
where:
EB = total greenhouse gas emissions from biofuels; and
EF = total greenhouse gas emissions from fossil fuel reference.
The EF reference fossil fuel value is 83,8 gCO2ekv / MJ.
4. Greenhouse gases for the purposes of point 1 are CO2, N2O and CH4. For the purposes of calculating CO2 equivalent, the following gases shall have the following values:
CO2: 1
N2O: 296
CH4: 23
5. Greenhouse gas emissions from biomass cultivation, eec, include emissions from the cultivation process itself, biomass extraction (harvesting), waste and losses and emissions from the production of chemicals or products used in cultivation. The capture of CO2 emissions in biomass cultivation is not included. Greenhouse gas emissions from cultivation are mainly affected by the type of seed, the quantity and type of fertiliser and pesticides used, fuel consumption, crop yield and N2O emissions from soil.
6. Annual greenhouse gas emissions from carbon stock changes resulting from land use change, el, shall be calculated by dividing the total emissions evenly into 20 years. The following rule shall apply to the calculation of these emissions:
el = (CSR - CSA) x 3,664 x 1 / 20 x 1 / P -eB
where:
el = annual emissions of greenhouse gases from carbon stock changes due to land change expressed as CO2 equivalent mass per unit of energy generated from gCO2ecv / MJ biofuel;
CSR = carbon stock per unit area associated with reference land use (expressed as carbon mass per unit area, including soil and vegetation). Land use shall be considered as reference in January 2008 or 20 years before the raw material is obtained, whichever is the more recent;
CSA = carbon stock per unit area associated with actual land use (expressed as carbon mass per unit area, including soil and vegetation). Where carbon stocks are accumulated over a period of more than one year, the value of the CSA factor shall be determined as an estimate of the stock per unit area over a period of 20 years or at the maturity of the crop, whichever is the earlier;
P = crop productivity (expressed as biofuel energy per unit area per year); and
eB = a bonus of 29 gCO2ekv / MJ biofuels if biomass is obtained from recovered degraded land under the conditions set out in point 7.
7. A bonus of 29gCO2ekv / MJ shall be assigned if it is shown that the land concerned:
(a) it was not used for agricultural or any other activity in January 2008; and
(b) falls within one of the following categories:
1. land severely degraded, including such land previously used for agricultural purposes;
2. strongly contaminated soil.
A bonus of 29 gCO2ekv / MJ shall be applied for a period of not more than 10 years from the date of soil conversion into agricultural land used, provided that a regular increase in carbon stocks is ensured, as well as a significant reduction in soil erosion under point 1 and a reduction in soil contamination under point 2.
The categories referred to in point 7 (b) are defined as follows:
(a) "severely degraded soils" means soils which have been significantly salted or have a particularly low content of organic substances for a significant period of time and which are severely eroded;
(b) "strongly contaminated soils" means soils which are not suitable for the cultivation of food or feed due to contamination.
Such land shall include land subject to a Commission decision in accordance with the fourth subparagraph of Article 7c (4) of Directive 2009 / 30 / EC.
9. The calculation of the carbon stocks in the soil of CSR and CSA shall be carried out in accordance with the guidelines set out in Commission Decision 2010 / 335 / EU on guidelines for the calculation of soil carbon stocks for the purposes of Annex V to Directive 2009 / 28 / EC of 10 June 2010.
10. Greenhouse gas emissions from processing, ep, include emissions from its own processing process, waste and leakage and the production of chemicals or products used in processing. Taking into account the consumption of electricity not generated directly in the biofuel plant concerned, it is assumed that the greenhouse gas emissions from the production and distribution of that electricity are equal to the average emissions in the production and distribution of electricity in the area. Manufacturers may, exceptionally, use the average value applicable to that installation for electricity produced by a separate electricity generating installation unless it is connected to the grid.
11. Greenhouse gas emissions from transport and distribution, etc., include emissions from the transport and storage of raw materials and semi-finished materials as well as from storage and distribution of the final product. This point shall not apply to transport and distribution emissions taken into account under point 5 as cultivation emissions.
12. Greenhouse gas emissions from the use of the biofuel, eu, are considered to be equal to zero.
13. Greenhouse gas emission savings generated by carbon sequestration and geological storage, eccs that have no longer been included in the ep shall be limited to emissions that have not occurred as a result of the capture and sequestration of CO2 emitted directly related to the acquisition, transport, processing and distribution of biofuels.
14. Greenhouse gas emission savings resulting from carbon capture and replacement, eccr, are limited to emissions that have not occurred due to CO2 capture, the source of which is biomass and used to replace CO2 from fossil fuels used in relation to commercial products and services.
15. Greenhouse gas emission savings resulting from excess electricity from cogeneration, eee, shall be taken into account in relation to the excess electricity generated in biofuel plants by cogeneration, but except where the fuel used in the cogeneration cycle is a secondary product which is not the rest of the agricultural crop. Taking into account this excess electricity, it is assumed that the cogeneration unit has at least the capacity necessary to supply the heat energy necessary for biofuel production. The greenhouse gas emission savings associated with this excess electricity are considered to be equal to the greenhouse gas volume that would be emitted in the production of the same amount of electricity at the power plant using the same fuel as the cogeneration unit.
16. In cases where one or more other products (hereinafter referred to as "co-product ') are produced simultaneously in the biofuel production process, greenhouse gas emissions shall be distributed between biofuels or their intermediate products and co-products in proportion to their energy content (for secondary products other than electricity determined as lower calorific value).
17. For the purposes of the calculation referred to in point 16, the divided emissions shall be calculated as: eec + el + shares ep, etd and eee, which arise during the steps preceding the production step in which the secondary product is produced, as well as within this production step. Where greenhouse gas emissions have been assigned to secondary products in any of the previous life-cycle production steps, instead of those total emissions, only the proportion of such emissions assigned to the intermediate biofuel produced in the last of those production steps shall be used for this purpose. For the purposes of this calculation, all secondary products including electricity not covered by point 15 shall be taken into account, with the exception of residues of agricultural crops including straw, bagasse, husks, corn ears and nut shells. The negative energy content of secondary products shall be considered zero for the purposes of the calculation. Greenhouse gas emissions from waste, crop residues including straw, bagasse, husks, corn ears and nut shells and residues derived from processing chains, including crude glycerin (glycerin not refined), shall be considered to be zero throughout the life cycle of such wastes and residues until they are obtained.
18. For the purposes of calculating greenhouse gas emissions from the cultivation and harvesting of biomass (eec), from processing (ep), from transport and distribution (etd), emission savings due to excess electricity from cogeneration (eee) and annual greenhouse gas emissions from carbon change due to land use change (el), the energy content of the most used biofuels and fossil fuels referred to in Part D shall be used.

The brackets behind the biotope designation show its code according to the Catalogue of Biotopes of the Czech Republic issued by the Agency for the Conservation of Nature and Landscape of the Czech Republic (Smart, M. et al., 2010), followed by a slash by the habitat type code according to Annex I to Council Directive 92 / 43 / EEC on the conservation of natural habitats, wild species and flora (Habitats Directive) to which the biotope is assigned.
