GOVERNMENT REGULATION
of 16 December 2019
amending Government Regulation No 50 / 2015 Coll., laying down certain conditions for granting direct payments to farmers and amending certain related government regulations, as amended
The Government mandates pursuant to § 2b (2) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 128 / 2003 Coll., Act No. 441 / 2005 Coll. and Act No. 291 / 2009 Coll., and under § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act on the State Agricultural Intervention Fund), as amended by Act No. 441 / 2005 Coll., Act No. 291 / 2009 Coll. and Act No. 179 / 2014 Coll.:
Government Regulation No. 50 / 2015 Coll., on determining certain conditions for the granting of direct payments to farmers and amending certain related government regulations, as amended by Government Regulation No. 113 / 2015 Coll., Government Regulation No. 185 / 2015 Coll., Government Regulation No. 61 / 2016 Coll., Government Regulation No. 236 / 2016 Coll., Government Regulation No. 423 / 2016 Coll., Government Regulation No. 48 / 2017 Coll., Government Regulation No. 49 / 2017 Coll., Government Regulation No. 427 / 2017 Coll., Government Regulation No. 43 / 2018 Coll., Government Regulation No. 293 / 2018 Coll., is amended as follows:
1. Paragraph 7 (4) reads as follows:
"(4) A breach of the condition referred to in paragraph 2 (c) shall not be considered as a breach,
(a) where agri-environmental climate measures are applied to a given part of the soil block pursuant to Article 19 (8) and (10) of Decree No 75 / 2015 Coll., on the conditions for implementing agri-environmental climate measures and amending Government Regulation No 79 / 2007 Coll., on the conditions for implementing agri-environmental measures, as amended;
(b) when the area concerned is under Article 18 (1) and (3) of Decree No 75 / 2015 Coll.,
(c) if a follow-up agri-environmental climate measure is applied to a given part of the soil block in accordance with Article 16 (8) and (10) of Decree No. 330 / 2019 Coll., on the conditions for the implementation of subsequent agri-environmental measures;
(d) when the area concerned is being discussed in accordance with § 15 paragraphs 1 and 3 of the Government Decree No. 330 / 2019 Coll., or
(e) if the permanent grassland is restored in accordance with Section 3j of the Agricultural Act in the given part of the soil block. "
2. in Article 7 (8), the following points (c) and (d) are inserted after point (b):
"(c) follow-up agri-environmental measures under Government Regulation No. 330 / 2019 Coll.,
(d) the measures following organic farming under Government Regulation No 331 / 2019 Coll., on the conditions for implementing the downstream organic farming measure, ';
Points (c) and (d) shall be renumbered as points (e) and (f).
3. in Article 7 (8) (e), the words' shall be inserted after the word "landscape," the applicant shall provide evidence of a different procedure under the Nature and Landscape Conservation Act not later than the date on which the activities referred to in paragraph 3 were to be carried out '.
4. In Article 7, the following paragraph 9 is added:
"(9) The Fund shall not grant a subsidy for part of the part of the land block registered in the land use register for which the procedure under Section 3g (4) of the Agriculture Act has been applied. '
5. In Article 9 (3), the words "and the applicant referred to in Article 43 (11) or Article 44 (2) and (3) of Regulation (EU) No 1307 / 2013 of the European Parliament and of the Council of 17 December 2013 laying down rules for direct payments to farmers under support schemes under the common agricultural policy and repealing Council Regulation (EC) No 637 / 2008 and Council Regulation (EC) No 73 / 2009 'are inserted after the word" the applicant'.
6. In Article 9 (5), the words "and the applicant referred to in Article 43 (11) or Article 44 (2) and (3) of Regulation (EU) No 1307 / 2013 of the European Parliament and of the Council 'shall be inserted after the words" crops'.
7. in Article 12 (3) (c) and Article 12a (4) (c), the words "treated sludges" shall be inserted after the words "fertilisers."
8. In Article 14, the words "and the area referred to in Article 18 of Decree No. 330 / 2019 Coll., for which an application for subsidy is submitted pursuant to § 7 of the Decree No. 330 / 2019 Coll. 'are added at the end of paragraph 2.
9. in Article 14 (4), the following point (o) is inserted after point (n):
"(o) Indian,"
Points (o) to (q) shall be renumbered as points (p) to (r).
10. In Article 23 (8), at the end of the text in point (b), the words "at least during the period from the date of submission of the application for the grant until 30 June of the relevant calendar year 'shall be added.
11. in Paragraph 32, the following paragraph 8 is added:
"(8) The Fund shall not grant a subsidy for part of the part of the land block registered in the land use register for which the procedure under Section 3g (4) of the Agriculture Act has been applied. '
12. In Annex 10, "15 Chianina (CHIANI) 'is inserted after" 14.
Points 15 to 28 shall become points 16 to 29.
13. In Annex 10, "27. Uckermärker (UCKERM) 'is inserted after" 26. Texas Longhorn (TT)'.
Points 27 to 29 shall be renumbered 28 to 30.
Transitional provision
Applications initiated under Government Regulation No. 50 / 2015 Coll., as effective before the date of entry into force of this Regulation, shall be completed under Government Regulation No. 50 / 2015 Coll., as effective before the date of entry into force of this Regulation.
Efficacy
This Regulation shall take effect on 1 January 2020.
