laying down the limits and conditions for the monitoring, assessment, evaluation and management of air quality
The Government mandates pursuant to § 55 (1) of Act No. 86 / 2002 Coll., on Air Protection and on the amendment of certain other laws (Air Protection Act) ("the Act '):
Subject matter
This Regulation lays down, in accordance with the law of the European Communities (1), the limits of imitation, tolerance, target limits and long-term objectives. Furthermore, a method of assessing the level of air pollution, the area and the location with deteriorated and good air quality and the principles for measuring the level of air pollution shall be laid down.
Basic concepts
For the purposes of this Regulation:
(a) the target limit - the concentration of the pollutant in ambient air determined for the purpose of eliminating, preventing or limiting harmful effects on human health and the environment overall, to be achieved, where possible, within a given time;
(b) a long-term objective for ozone - a level of tropospheric ozone air pollution below which direct harmful effects on human or animal health or the environment can be excluded on the basis of current scientific knowledge;
(c) an assessment of air quality - provided by this Regulation or, where appropriate, by the air protection authorities, an approved method for carrying out measurements, calculations, forecasts or expert estimates of air pollution levels;
(d) upper limit for the assessment of the level of air pollution - the value of the concentration of the pollutant at which only measurements must be used to assess the level of air pollution when reaching or exceeding a given territory;
(e) lower limit for the assessment of the level of air pollution - the value of the concentration of the pollutant below which only model calculations or expert estimates may be used to assess the level of air pollution in a territory;
(f) reference method of measurement - a procedure that includes a description of the sampling, transport and modification of the air sample and the determination of the concentration of the substance;
(g) equivalent method - a method which is proven to be of the same quality characteristics and which provides the same, in the case of methods of diffusion of pollutants in air comparable results to the reference method;
(h) nitrogen oxides - a mixture of nitric oxide and nitrogen dioxide, the concentration of which is the sum of the concentrations of nitric oxide and nitrogen dioxide, calculated in ppbv units and expressed as nitrogen dioxide in micrograms per cubic metre;
(i) suspended particles - particles which, due to negligible falling speed, persist for a long time in the atmosphere;
j) suspended particles of the fraction PM10 - particles which pass through the size-selective input filter showing 50% for the aerodynamic diameter of 10 μm separation efficiency;
(k) fine suspended particles of the fraction PM2,5 - particles which pass through the size-selective input filter showing 50% for the aerodynamic diameter of 2,5 μm separation efficiency;
(l) method for calculating the dispersion of air pollution (diffusion method) - method for calculating the concentrations of pollutants and their dispersion over time and space;
(m) ozone precursors - pollutants entering photochemical reactions leading to tropospheric ozone formation;
(n) deposit limit - the maximum permissible amount of air pollutants settled or absorbed on the surface area unit per time unit due to the extraction and eradication processes from the atmosphere which do not cause any negative effects and processes in the ecosystem;
(o) the liner source of air pollution - transport communication used for the operation of mobile sources of air pollution or proposed for use for the operation of such sources within the framework of territorial, building, housekeeping or other management;
(p) dusty fall - the mass of depondered material which, after previous air pollution, has settled per unit of surface area per time unit as a result of extracting and eradicating processes from the atmosphere,
(r) tropospheric ozone - ozone in the ground layer of the atmosphere and arising from the chemical reactions of ozone precursors.
Imitation limits, tolerance limits, target limit and long-term objectives, deposit limit
(1) The limits and tolerance limits are set for these pollutants
(a) sulphur dioxide;
(b) suspended particles of the fraction PM10;
(c) nitrogen dioxide and oxides of nitrogen;
(d) lead,
(e) carbon monoxide;
(f) benzene,
(g) cadmium,
(h) arsenic,
(i) nickel,
(j) polycyclic aromatic hydrocarbons expressed as benzo (a) pyrene.
(2) For tropospheric ozone target limits and long-term objectives shall be established.
(3) For dust fall, a deposit limit shall be established, the amount of which shall be taken into account if actual pollution is detected.
(4) For sulphur dioxide, nitrogen oxides and ozone, additional values of the limit values and the long-term objectives for the protection of human and animal health and the long-term objectives for the protection of ecosystems and vegetation shall be established for sulphur dioxide, nitrogen oxides and ozone.
Assessment of air pollution levels
(1) The assessment of the level of air pollution shall evaluate those pollutants for which the limit values and target limits are set, the fine suspended particles of the fraction PM2,5 and the ozone precursors listed in Annex 7 to this Regulation.
(2) In case of technical availability of the corresponding apparatus, the level of air pollution shall be assessed by fine suspended particles of the PM2,5 fraction and ozone precursors. The detection of concentrations of ozone precursors shall be carried out to ensure further scientific knowledge of the way tropospheric ozone is formed. The concentrations of fine suspended particles of the PM2,5 fraction in the air shall be evaluated in terms of the harmful effects of the substance on human health.
(3) The concentration of the substances referred to in paragraph 2 shall be evaluated in areas with impaired air quality.
(4) Assessment of air pollution levels shall be carried out
(a) measurements in resident groupings (Section 7 (2) of the Act), measurements in areas where the level of air pollution by the pollutant reaches or exceeds the upper limit for assessment, and measurements in areas where the level of ozone pollution exceeds the long-term imitation objectives (within the last 5 years);
(b) modelling or expert estimation in areas where the level of air pollution by the pollutant does not exceed the lower limit for assessment;
(c) a combination of measurement and modelling in areas where the level of air pollution reaches or exceeds the lower limit for assessment and is below the upper limit for assessment.
(5) For the assessment of air pollution levels by pollutants in ambient air, provision shall be made for:
(a) the limit of imitation, tolerance limits, target limits and long-term objectives - Annex 1 to this Regulation;
(b) deposit limit for dust fall - Annex 1 to this Regulation;
(c) upper and lower limits for the assessment of selected pollutants and other requirements for the assessment of concentrations of pollutants - Annex 2 to this Regulation;
(d) the method of classification and the criteria for selecting the points of measurement of concentrations of pollutants - Annex 3 to this Regulation;
(e) criteria for determining the minimum number of continuous measurement points for pollutant concentrations - Annex 4 to this Regulation;
(f) the quality characteristics of the data and the evaluation of the results of the assessment of the level of ambient air pollution - Annex 5 to this Regulation;
(g) reference methods for the measurement of pollutants, calibration of instruments and determination of dust fall mass - Annex 6 to this Regulation;
(h) requirements for the measurement of ozone precursors - Annex 7 to this Regulation;
(i) a set of methods for calculating the diffusion of pollutants in air - Annex 8 to this Regulation.
(6) Air quality assessment shall be carried out with a combination of imitation measurement, emission inventory and modelling.
Areas and places with deterioration and good air quality
(1) Areas with impaired air quality determined on the basis of the ozone concentrations are subject to a national tropospheric ozone precursor emission reduction programme.
(2) Places, zones and locations where pollution does not reach the limit of imitation are considered to be of good air quality.
(3) In the areas listed in Annex 10 to this Regulation and published in the Ministry of the Environment Bulletin (hereinafter referred to as the Ministry Bulletin), the limits for the protection of ecosystems and vegetation listed in Annex 1 to this Regulation must be respected.
Measurement of air pollution levels
(1) The operation of an automated measuring network for continuous measurement of concentrations of pollutants in the air, supplemented by manual measurements, by the Ministry of the Environment (hereinafter referred to as the Ministry) or by a legal person established by it, is ensured throughout the country. Measurement stations (hereinafter referred to as "stations') at sampling points shall be located in accordance with the principles set out in Annexes 3 and 4 to this Regulation. The results of measurements carried out by other authorised bodies are also used to evaluate air quality.
(2) The requirements for the assessment of the concentrations of pollutants, the classification and location of stations and the criteria for their number, the reference and equivalent methods of measurement and analysis, the reference and equivalent modelling methods, the calibration methods and the target quality of data must be identical to the requirements of Article 4 (5). The location of the stations shall be discussed by the Ministry or the legal person established by it with the competent authorities of the regions and municipalities.
(3) The reliability of the data referred to in paragraph 2 shall be provided by the Ministry or the legal person established by it.
Efficacy
This Regulation shall enter into force on the day of its publication.

Values of limit values and tolerance limits, deposit limit, target limit and long-term objectives
All these limit values refer to standard conditions - volume converted to 293,15 K and normal pressure 101,325 kPa. All these limit values are arithmetic averages. For the purposes of this Annex, the year shall be the calendar year.
Those limit limits shall apply from the date of entry into force of Government Decree No. 350 / 2002 Coll., as amended by this Regulation, unless otherwise specified.

Assessment of suspended particulate concentrations of PM2,5 fraction
The concentration of fine suspended particles of the size fraction PM2,5 shall be evaluated in terms of the annual arithmetic mean, the annual median, the annual 98th percentile and the annual maximum of twenty-four hours average.

Mercury concentrations are evaluated in terms of annual arithmetic mean.

Notes:
(1) In order to achieve the target limit of imitation, all reasonable measures, which are the content of the programmes processed under Sections 6 and 7 of the Act, are taken.
2) Compliance with the target limit shall be assessed from this date. The year 2010 will be the first year in which the data will be used to calculate the transactions during the following 3 or 5 years, respectively.
3) 8-hour rolling averages are calculated from hourly concentrations and recalculated every hour. Each eight-hour average is attributed to the day on which it ends, i.e. the first calculation is made from hourly concentrations during the period 17: 00 of the previous day and 01: 00 of the following day. The last calculation for the day shall be made for the period from 16: 00 to 24: 00.
4) If the average values cannot be evaluated for 3 or 5 years on the basis of a complete set of annual data, the minimum annual figure necessary to check compliance with the target values shall be:
(a) for the target value for the protection of human health - valid data per year;
(b) for the target value for the protection of vegetation - valid data for 3 years.
(5) For the purposes of this Regulation, an AOT 40 means the sum of the differences between the hourly concentration greater than 80 μg.m-3 (= 40 ppb) and the 80 μg.m-3 value at a given period by using only hourly values measured each day between 8: 00 and 20: 00 CET.

2. Determination of cases of exceeding upper and lower assessment limits
(a) The excess over the upper and lower assessment limits shall be determined on the basis of the concentration over the previous five years, provided sufficient data are available. The assessment limit shall be considered to be exceeded if it has been exceeded in at least three calendar years during those five years.
(b) Where less data are available than for a period of five years, short-term metering campaigns may be combined during the annual period and in places likely to be representative of the highest levels of pollution, with the results obtained from emission inventory and modelling data to determine whether the upper and lower assessment limits are exceeded.

Location of sampling points (measuring points) for measuring concentrations of pollutants in ambient air
Classification of sampling points for continuous measurement of concentrations of sulphur dioxide, suspended particles, nitrogen dioxide and oxides of nitrogen, lead, carbon monoxide and benzene in ambient air and selection criteria
1. Placing of sampling points on a macroscale
1.1.Protection of human health
1.1.1. The sampling points aimed at protecting human health shall be positioned in such a way that:
(a) provide data on locations in areas with impaired air quality and on residential groupings where peak concentrations occur, the population of which is likely to be exposed directly or indirectly for a period of time relevant to the average of the relevant limit value (limit values);
(b) provide data on levels in other locations within areas with impaired air quality and residential groupings which are representative of the exposure of the general population.
1.1.2. Sampling points are placed
(a) in such a way as to prevent measurements in and around very small micro-environments.
(b) represent, where possible, air quality in the surrounding area of at least 200 m2 for transport-oriented sites and several square kilometres for urban sites;
(c) to represent, where possible, similar sites which are not in their immediate vicinity in order to ensure that the number of measuring points is minimised while maintaining the required network efficiency.
1.2. Protection of ecosystems and vegetation
The sampling points aimed at protecting ecosystems or vegetation shall be located more than 20 km from the housing clusters or more than 5 km from other built-up areas, industrial installations or motorways. The sampling point shall normally be located in such a way as to represent the air quality in the surrounding area of at least 1000 km2.
2. Microscale sampling points
2.1. The sampling points shall be located, if possible, so that:
(a) the air flow around the inlet of the sampling probe is not limited by any obstacle affecting the air flow around the sampling device (usually several metres from buildings, balconies, trees and other obstacles and at least 0,5 m from the nearest building in the case of sampling points representing the ambient air quality in the area of the line starting with the installation);
(b) the inlet of the sampling probe of the sampling device was between 1,5 m (respiratory zone) and 4 m above the ground. Higher positions (up to 8 m) are necessary and appropriate if the data obtained by the station are to be representative of larger areas,
(c) the inlet of the sampling probe of the sampling device has not been located in the immediate vicinity of the sources of air pollution, in order to avoid direct sampling of emissions undiluted by mixing with ambient air;
(d) in the case of the sampling probe outlet of the sampling device, the recirculation of the flowing air collected back into the sampling device inlet is not prevented;
(e) transport-oriented sampling equipment
1. for the measurement of all pollutants, at least 25 m from the edge of the major junctions and at least 4 m from the centre of the nearest lane;
2. for the measurement of nitrogen dioxide and carbon monoxide, the inlet openings of the sampling probe have a maximum of 5 m from the edge of the road (from the curb),
3. for the measurement of material particles, lead and benzene, the inlet orifices of the sampling probe were located in such a way as to represent the air quality near the starting line.
2.2. Sampling points shall also be placed in such a way that the following factors are taken into account:
(a) co-operating sources of air pollution
(b) operator safety of the sampling device
(c) accessibility to the sampling device;
(d) availability of electricity and telephone connections;
(e) visibility of the site in relation to its surroundings;
(f) public safety,
(g) requirements for the common location of sampling devices for different pollutants;
(h) zoning requirements.
3. Documentation and review of the selection of seats
The selection procedure and selected sampling points shall be documented at the classification stage according to the criteria of the European Environment Agency. It is mandatory to take photographs of the surrounding area in the direction rose (in all directions covering the whole range of compass sections) and detailed maps. The location of sampling points shall be reviewed regularly and new documentation shall be taken to demonstrate the continuous validity of the selection criteria.

(b) in case of pollution from the point source of air pollution
The number of continuous measurement sampling points for the purposes of assessing pollution near point sources of air pollution shall be calculated taking into account emission levels, likely spatial distribution of pollutant concentrations and their distribution in ambient air and potential exposure to the population.
