DECLARATION
of 25 January 2010
amending Decree No. 22 / 1989 Coll., on the Safety and Health at Work and the Safety of Operation in Mining Activities and the Conquest of Unreserved Minerals in the Underground, as amended, and Decree No. 659 / 2004 Coll., on the Safety and Health at Work and Safety of Operation at Mine with the Risk of Mining Shocks, as amended, and Decree No. 282 / 2007 Coll.
According to § 6 (6) (a) of Act No. 61 / 1988 Coll., on Mining Activities, Explosives and State Mining Administration, the Czech Mining Authority provides:
Amendment of the Ordinance on Safety and Health at Work and Safety at Operation in Mining and Conquering Unreserved Minerals in Underground
Decree No. 22 / 1989 Coll., on the Safety and Health at Work and Safety of Operation in Mining Activities and the Conquest of Unreserved Minerals in Underground, as amended by Decree No. 477 / 1991 Coll., Decree No. 340 / 1992 Coll., Decree No. 3 / 1994 Coll., Decree No. 54 / 1996 Coll., Decree No. 109 / 1998 Coll., Decree No. 434 / 2000 Coll., Decree No. 330 / 2002 Coll., Decree No. 141 / 2004 Coll., Decree No. 298 / 2005 Coll. and Decree No. 282 / 2007 Coll., is amended as follows:
1. in Article 231a (4) (a):
"(a) the ground current for single-pole land connections of mobile machinery mains and shackles does not exceed 7 A,"
2. In Paragraph 231a (4), the dot is replaced by a comma at the end of the paragraph and the following point (d) is added:
"(d) the power switch, the cable outlet of which is powered by an electrical device located in SNM spaces, shall be equipped with a device to block the switching on of the outlet in the isolation resistance on that outlet of less than 50 Hz / V. ';
3. Paragraph 231d (1) is deleted.
Paragraphs 2 and 3 shall be renumbered paragraphs 1 and 2.
4. In the second sentence of Article 242 (2), "(b) 'is inserted after" paragraph 5'.
Amendment of the Regulation on safety and health at work and safety of operations in mines with the risk of mine shocks
In Section 15 of Decree No. 659 / 2004 Coll., on safety and health at work and safety of operations in mines with the risk of mine shocks, as amended by Decree No. 282 / 2007 Coll., paragraph 3 reads as follows:
"(3) Cable manifolds above 1 kV in mine parts classified in the 2nd or 3rd degree shock hazard shall be equipped with a device for self-discharging the electrical power at:
(a) shaking; or
(b) exceeding the permitted concentration of methane in the mining air. The shutdown shall take place within 2 seconds of exceeding the set limit value of any sensor placed in the specified components.
The location of sensors and auto-off areas shall determine the racing mine. The organisation shall indicate them in the emergency plan. ';
Transitional provisions
1. The requirement laid down in § 231a (4) (d) of Decree No 22 / 1989 Coll., on the safety and health at work and the safety of operations in mining activities and on mining of non-reserved minerals in the underground, as effective from the effective date of Decree No. 35 / 2010 Coll., must be fulfilled
(a) for new and reconstructed power switches first put into service after the entry into force of this Decree, until 30 June 2010;
(b) for power switches reinstalled after the entry into force of this Decree, until 30 June 2011,
(c) for other power switches until 30 June 2012.
2. The requirements laid down in § 15 (3) of Decree No. 659 / 2004 Coll., on safety and health at work and safety of operations in mines with mine shock hazards, as effective from the effective date of Decree No. 35 / 2010 Coll., are to be fulfilled until 31 December 2010.
EFFECTIVE
This Decree shall take effect on 1 March 2010.
