GOVERNMENT REGULATION
of 23 August 2021
amending Government Regulation No 589 / 2006 Coll., providing for a derogation from the working and rest periods of workers in transport, as amended
The Government directs pursuant to Sections 100 (1) and 212 (5) of Act No. 262 / 2006 Coll., Labour Code, as amended by Act No. 362 / 2007 Coll., Act No. 292 / 2017 Coll. and Act No. 285 / 2020 Coll.:
Government Regulation No. 589 / 2006 Coll., providing for a derogation from the working and rest periods of workers in transport, as amended by Government Regulation No. 353 / 2008 Coll. and Government Regulation No. 337 / 2016 Coll., is amended as follows:
1. In Article 2 (c) (2), the part of the sentence after the semicolon, including the semicolon, including footnotes 6b and 6c, is deleted.
2. In Paragraph 13 (1), the last sentence is replaced by the sentence: "In the event that the shift is part of the overhead journey, the length of the shift according to the first sentence may be extended only by the duration of that overhead journey, with the maximum period of 15 hours; However, if rail transport workers are on a national, regional and tractor track driving a railway vehicle, the length of the shift may be extended only in the case of a overhead journey planned and carried out at the end of the shift. ';
3. In Paragraph 13, the following paragraph 2 is inserted after paragraph 1:
"(2) Where the employer, by means of a written schedule of working hours, divides the shift between rail transport staff on a national, regional and trawl track into several parts, the period between the beginning of the first part of the shift and the end of the last part of the same shift may be not more than 13 hours or not more than 15 hours, under the conditions referred to in paragraph 1, within 24 hours consecutive. ';
Paragraph 2 shall become paragraph 3.
4. In Article 13, the following paragraph 4 is added:
"(4) The employer in the employment register (16) shall also keep an indication of the time of the overhead journey, indicating the beginning and end of the journey."
5. In the first sentence of Paragraph 14 (2), "6 'is replaced by" 7' and the words "for at least 6 hours' are added at the end of the sentence.
6. In Part Two, Title III, Part 3, including the title, is deleted.
Efficacy
This Regulation shall take effect on 1 January 2022.
