DECLARATION
of 31 July 2020
amending Decree No. 196 / 2001 of the Ministry of Justice Coll., on the remuneration and replacement of notaries, trustees and notaries of the Czech Republic (notarial tariff), as amended
The Ministry of Justice provides for, pursuant to § 107 of Act No. 358 / 1992 Coll., on notaries and their activities (notarial order), as amended by Act No. 303 / 2013 Coll., and pursuant to § 516 (a) of Act No. 292 / 2013 Coll., on special legal proceedings:
Decree No. 196 / 2001 Coll., on the remuneration and substitutes of notaries, administrators of the estate and notarial chamber of the Czech Republic (notarial tariff), as amended by Decree No. 42 / 2002 Coll., Decree No. 403 / 2005 Coll., Decree No. 399 / 2006 Coll., Decree No. 167 / 2009 Coll., Decree No. 432 / 2013 Coll., Decree No. 162 / 2016 Coll. and Decree No. 338 / 2016 Coll., is amended as follows:
1. In Paragraph 11 (1), the amount "400 CZK 'is replaced by" 1000 CZK'.
2. In Paragraph 11 (2), the words "the notary's remuneration as a judicial commissioner is CZK 2,500 'are replaced by the words" half of the usual value of the assets belonging to the deceased and the surviving spouse is the basis of the notary's remuneration as a judicial commissioner'.
3. In Paragraph 13 (1), the amount "100 000 CZK 'is replaced by" 500 000 CZK', the words "up to 500 000 CZK of the base... 1,2% 'are deleted and the amount" 600 CZK' is replaced by "2 000 CZK '.
4. Paragraph 13 (3) is deleted.
5. In Paragraph 14 (2), "CZK 500 'is replaced by" CZK 1,500'.

The notary is entitled to a flat-rate reimbursement of costs incurred for the payment of telecommunications services, copies and photocopies of CZK 300 and a claim for compensation of other final expenses effectively incurred in connection with the implementation of the operations. Other expenditure shall in particular be judicial and other charges, postal, travel expenses, expert opinions and expert opinions, translations and reimbursement of the costs of entering or obtaining data from central information systems. ';
7. In Article 19, the following paragraph 3 is added:
"(3) If the procedure is not terminated, the notary shall also be liable, in addition to the reimbursement of the final expenses referred to in paragraph 1, for a flat-rate reimbursement of the costs associated with the execution of the proceedings following the completion of the estate proceedings of CZK 300."
8. In point A of Section I of the Annex, the third sentence is replaced by "If a tariff value cannot be determined or can only be determined at disproportionate cost,
a) if there is a notarial registration, which is the basis for registration in the public register.... CZK 4,000,
b) if there is a notarial record of legal action in the conversion of a legal person.... 10 000 CZK,
(c) if there is a notarial record of a contract for a matrimonial property regime or an agreement to change the matrimonial property regime.... CZK 5,000,
(d) if there is another notarial record of legal proceedings.... CZK 3,000. "
9. In section I, under point B (2) of the third Annex, the amount "CZK 3,000 'is replaced by" CZK 4,000'.
10. In Section II, under point H (2) of the Annex, the amount "30 CZK 'is replaced by" 70 CZK'.
Transitional provisions
1. Proceedings initiated before the date of entry into force of this Order shall be governed by Decree No. 196 / 2001 Coll., as effective before the date of entry into force of this Order.
2. The acts of notarial activity which the applicant has requested to be carried out before the date of entry into force of this Decree shall be governed by Decree No. 196 / 2001 Coll., as effective before the date of entry into force of this Decree.
Efficacy
This Decision shall enter into force on 1 January 2021.
