of 26 February 1964
concerning elections to the National Assembly and national committees
The National Assembly of the Czechoslovak Socialist Republic decided on this law:

Hlava první

Basic provisions
§ 1
The working people elect their best representatives as Members of the National Assembly and of the National Committees, politically and professionally advanced citizens, and able to organise and unify the creative forces of workers in their efforts to fully develop socialist society.
§ 2
Elections to the National Assembly and national committees shall be held on the basis of general, equal and direct voting rights by secret ballot.
§ 3
(1) All citizens of the Czechoslovak Socialist Republic have the right to vote, who reached the age of 18 on the day of the election, regardless of nationality, gender, religion, employment, residence, social origin, property conditions and past activities.
(2) However, citizens who have been legally deprived of legal capacity for mental illness or whose legal capacity has been restricted for such a failure are not entitled to vote. *)
(3) Citizens who are in jail or in custody do not vote.
§ 4
Any citizen of the Czechoslovak Socialist Republic, who has the right to vote, may be elected to the National Assembly and to the National Committee, who has reached the age of 21 on the day of the election.
§ 5
Members of the armed forces and armed corps shall have the same right to vote and be elected as all citizens.

Voting lists
§ 6
Entry into the electoral list
(1) All citizens of the Czechoslovak Socialist Republic who have the right to vote are included in the electoral list according to their place of residence.
(2) Citizens who, after drawing up a list of voters, acquire or lose their voting rights shall be added to or withdraw from the list of voters.
(3) Each voter can only be entered in one voter list.
§ 7
Establishment of the electoral list
(1) The electoral lists are drawn up by the local national committee according to the constituencies.
(2) The electoral lists of members of the armed forces and the armed corps who are housed in the group shall be drawn up by their master.
(3) The electoral lists are common to elections to the National Assembly and to national committees of all grades.
§ 8
Unloading of electoral lists
(1) No later than 30 days before the election date, the local national committee shall land electoral lists so that citizens can see them in official rooms. The local national committee shall inform citizens of the launch of the electoral lists in the usual manner.
(2) In municipalities where there are more than 5000 people on the electoral lists, the local national committee will arrange for a list of voters living in the house to be included in each house. The local national committee may also take such action in municipalities with fewer than 5000 persons on electoral lists.
§ 9
Opposition procedure
(1) Any citizen may, orally or in writing, draw the local national committee's attention to errors and errors in the electoral list and propose corrections. The local national committee shall decide on the alert within 3 days and either make an appropriate correction in the electoral list or inform the complainant in writing of the reasons for the correction.
(2) If the application is rejected, the citizen may submit it to the district court responsible under the constituency. The provisions of the Civil Code on review of decisions of other institutions shall apply to proceedings. According to the court's decision, the local national committee will make a correction on the electoral list. Proceedings before a court shall not be subject to a judicial fee.
§ 10
Election card
Voters who, from the time the electoral lists are unloaded to the election date, as well as voters who, for serious reasons, will not be able to vote in the constituency in whose electoral list they are registered, will issue a local national committee, at their request, and will delete them from the electoral list. The Voting Card authorises the entry on the list of voters in another constituency. The registration is carried out by the local national committee of new residence (place of residence), on the election day of the District Election Commission. On entry, the voter card is withdrawn and added to the voter list.

Election circuits
§ 11
General provisions
(1) Elections to the National Assembly and national committees are held according to the constituencies.
(2) One Member shall be elected in the constituency.
(3) A community of up to 1500 inhabitants is a common constituency for election to the local national committee, in which all Members are elected.
(4) Replacements are not elected.
§ 12
Election Circuits for National Assembly Elections
300 constituencies will be created for election to the National Assembly. Their list shall be published by the Bureau of the National Assembly no later than 60 days before the date of election.
Election circuits for election to national committees
§ 13
Election districts for election to national committees shall be determined by the Board of National Committees whose election is to be made. In doing so, it shall take account, in particular, of the geographical area of its district, the population and the tasks of economic and cultural development. The lists of constituencies shall be published no later than 55 days before the election date.
§ 14
(1) 80 to 160 constituencies will be created for elections to regional national committees and to the National Committee of the City of Prague.
(2) For elections to the District National Committees and to the District National Committees in Prague, up to 80 000 inhabitants of at least 60 constituencies will be created, from 80 000 to 140 000 inhabitants of at least 80 constituencies, over 140 000 inhabitants of at least 100 constituencies. However, 120 constituencies will be created at the highest.
(3) 130 to 160 constituencies will be created for elections to city national committees in Bratislava, Brno, Ostrava and Pilsen.
(4) The local national committee in the municipality, which forms a common constituency, shall be elected if the municipality:
up to 300 inhabitants, at least 9 Members,
from 300 to 800 inhabitants, at least 15 Members,
from 800 to 1500 inhabitants, at least 25 Members.
The number of Members to be elected shall be determined by the Board of the Local National Committee.
(5) To be elected to local and urban national committees will be created in municipalities
between 1500 and 5000 inhabitants, usually 30 constituencies,
from 5000 to 10,000 inhabitants, usually 40 constituencies,
from 10,000 to 20,000 inhabitants, usually 60 constituencies,
between 20 000 and 50 000 inhabitants, usually 80 constituencies,
over 50,000 people, usually 100 constituencies.
However, 120 constituencies will be created at the highest.
(6) As many constituencies as for local national committees will be created for elections to the District National Committees in Bratislava, Brno, Ostrava and Pilsen.

Election districts
§ 15
(1) For the adoption of ballots and for the census of ballots, electoral districts are created in the municipalities, which are common to elections to the National Assembly and to elections to national committees of all degrees.
(2) Electoral districts and polling rooms for each district shall be determined by the local national committee at the latest 30 days before the election date.
(3) As a general rule, the electoral district is created to include around 1000 voters. For remote parts of the village, separate electoral districts can be created if there are at least 50 voters.
(4) Special electoral districts can be created in hospitals, births, sanitariums, welfare institutions, similar institutions and facilities, or parts thereof, but only if there are at least 50 voters.
(5) The forces of the armed forces and armed corps form special electoral districts, if they have at least 50 voters.
(6) Special electoral districts may also be created for elections to the National Assembly on Czechoslovak representative offices and ships.

Election Commission
General provisions
§ 16
(1) The National Assembly elections are managed by the Central Election Commission of the National Front. It is also responsible for senior election management for national committees of all grades. The organisation of the Central Election Commission of the National Front in Slovakia is the Slovak Election Commission of the National Front.
(2) Options
the Regional National Committees are managed by the Regional Election Commission of the National Front and the National Committee of the City of Prague by the National Front Election Commission,
the District National Committees and the District National Committees in Prague,
to the municipal national committees of the City Election Commission of the National Front,
to the local national committees and the district national committees in Bratislava, Brno, Ostrava and Pilsen, the local election commission of the National Front.
Election commissions are in their work subordinate to higher-level electoral commissions.
(3) Elections in individual constituencies are governed by the Circular Election Commission.
(4) The votes in the various constituencies are managed by the District Electoral Commission.
(5) The Election Commission will be formed from representatives of the Communist Party of Czechoslovakia, other political parties and other social organisations of the National Front. The draft representatives shall be submitted by the competent authority of the National Front.
§ 17
(1) Election commissions may be quorum if an absolute majority of members are present.
(2) The Election Commission shall act by an absolute majority; in the event of a tie, the chairman's vote shall be taken.
National Front Central Election Commission
§ 18
(1) The National Front Central Election Commission shall be set up by the Bureau of the National Assembly no later than 55 days before the election date.
(2) The Central Election Commission of the National Front consists of the President, Vice-Presidents, Managing Director and the necessary number of other members.
§ 19
(1) The Central Electoral Commission of the National Front directs elections to the National Assembly and to the National Committees and oversees the precise observance of the electoral rules.
(2) For election to the National Assembly and election to the National Committees, the Central Election Commission shall set out the national queues for the formula for voting tickets, the registration of the District Election Commission on the registration of candidates for Members, the registration of the District Election Commission on the vote, the registration of the District Election Commission on the count of votes and the election certificate by the Member.
(3) In elections to the National Assembly of the Central Election Commission of the National Front
(a) concentrate proposals on candidates for elections to the National Assembly;
(b) to register candidates with the District Electoral Commission;
(c) decide definitively on complaints concerning the maladministration of the election committees;
(d) register the elected Members of the National Assembly;
(e) forward the files on the elections of Members of the National Assembly to the Mandate Committee of the National Assembly.
(4) The Central Electoral Commission of the National Front may direct the District Electoral Commission for elections to the National Assembly through the Regional Electoral Commission of the National Front.
§ 20
Slovak Election Commission National Front
(1) The Slovak Electoral Commission of the National Front oversees the precise observance of the rules on elections in Slovakia and performs other tasks entrusted to it by the Central Electoral Commission of the National Front. It shall be established by the Bureau of the Slovak National Council no later than 55 days before the date of election.
(2) The Slovak Election Commission of the National Front consists of the President, Vice-Presidents, Managing Director and the necessary number of other members.
Regional, District, City and Local Election Commission National Front
§ 21
(1) The National Front Election Commission, which directs elections to the National Committee, shall be elected by the National Election Committee no later than 55 days before the election date. It shall be elected by the National Committee at its plenary session, with the participation of representatives of the National Front and citizens.
(2) The Commission shall consist of the President, the Vice-President, the Director and the necessary number of other members.
§ 22
The National Front Election Commission, which directs elections to the National Committee,
(a) oversees the precise observance of the national election rules;
(b) concentrate proposals on candidates for elections to the national committee;
(c) to register candidates with the District Electoral Commission;
(d) make a final decision on complaints concerning the maladministration of the election committees in elections to the national committee;
(e) ensure that voting lists are drawn up for election to the national committee;
(f) register the elected members of the national committee;
(g) forward the electoral files to the national committee's mandate committee.
Circular Election Commission
§ 23
(1) For each constituency, a district electoral commission shall be formed.
(2) The Circular Electoral Commission shall be set up no later than 50 days before the election date
(a) for elections to the National Assembly, the Council of the Regional National Committee and the Council of the National Committee of the City of Prague;
(b) for election to the National Committee, the Board of the National Committee of which the choice is made.
(3) The District Electoral Commission consists of the President, Vice-President, Managing Director and the necessary number of other members.
(4) In a village with a population up to 1500 inhabitants, the tasks of the District Electoral Commission for elections to the local national committee of the National Front Election Commission are performed.
§ 24
(1) Circular Election Commission
(a) oversees the precise observance of election regulations;
(b) register candidates for Members;
(c) provide the district election committees with election ballots;
d) keeps an eye on the election process and ascertains their results in the constituency;
(e) submit a report to the National Front Electoral Commission governing the elections on the outcome of the electoral elections in the constituency;
(f) issue a certificate of election to the candidate elected;
(g) submit the file on the elections for safekeeping to the relevant national committee; The National Assembly elections will be handed over to the Regional National Committee.
(2) The District Electoral Commission for elections to the National Assembly also decides on complaints about the maladministration of the District Electoral Commission in the election to the National Assembly.
Regional Electoral Commission
§ 25
(1) For each electoral district, the council of the local national committee shall form a district election commission no later than 30 days before the election date.
(2) The Commission consists of the President, Vice-President, Managing Director and between 4 and 8 other members. In electoral districts with fewer than 300 voters, the District Electoral Commission has additional members alongside the President and the Director of 2 or 3.
§ 26
Regional Electoral Commission
(a) oversees the proper surrender of ballots and watches over the keeping of order in the voting room;
(b) shall add the votes cast for each candidate;
(c) write an entry on the course of the election and the census of the votes, which shall be submitted without delay to the relevant electoral commission;
(d) surrender the electoral files to the Regional National Committee.

Candidates
§ 27
Design of candidates
(1) Candidates for elections to the National Assembly and candidates for elections to national committees are candidates for the National Front.
(2) The candidates are proposed by the Communist Party of Czechoslovakia, other political parties and other social organisations of the National Front, the assembly of workers, peasants and others working on races, offices and villages, and the assembly of soldiers and members of other armed corps. The proposals are submitted to the local (city) election committee by the National Front. This Election Commission will forward proposals to candidates for elections to national committees of higher degrees and for elections to the National Assembly Regional Election Commission of the National Front. The Regional and Regional Election Commission of the National Front is doing the same.
(3) Candidates are designed for individual constituencies. One or more candidates may be proposed for each constituency. For elections to the local national committee in the municipality which forms a common constituency, as many candidates as the designated number of members of the local national committee or more candidates may be proposed.
Registration of candidates
§ 28
(1) Candidates for elections to the National Assembly are registered by the National Front Central Election Commission. Candidates for elections to national committees are registered by the National Front Election Commission, which directs elections to the national committee. Applications shall be submitted to the relevant electoral commission not later than 30 days before the election date.
(2) Candidates are registered by constituency. However, no one may be candidate for election to the National Assembly or for election to the same National Committee in more than one constituency.
(3) The application shall contain a statement by the candidate that he agrees to his or her candidacy. The application shall be accompanied by a report on the meeting of the organisation or assembly of workers where the candidate has been proposed.
§ 29
The District Electoral Commission shall register all duly designed candidates.
§ 30
Announcement
The District Electoral Commission shall publish the names, surnames, age and employment of all registered candidates at the latest.
(a) 25 days before the election date for elections to the National Assembly, to the Regional National Committees, to the National Committee of the City of Prague, to the District National Committees, to the Municipal National Committees in Bratislava, Brno, Ostrava, Pilsen and to the District National Committees in Prague,
(b) 15 days before the election date to the other municipal and district national committees and local national committees.
§ 31
Voting lists
(1) All registered candidates must be listed on ballots.
(2) Voting lists must take the form laid down and be reproduced in the quantities required.
§ 32
Membership of candidates in election committees
Candidates may not be members of district or district electoral committees where they are candidates.
§ 33
Election agitation
Every workers' organisation and every citizen of the Czechoslovak Socialist Republic have the right to freely agitate candidates in the press, in meetings and in other ways.

Announcement of elections
§ 34
Election Day
(1) The election date for the National Assembly and the National Committees shall be determined by the Bureau of the National Assembly no later than 60 days in advance.
(2) National Assembly elections and national committees of all grades are held on the same day on the territory of the whole state. The elections take place on a day of work. Supplementary elections to the National Assembly and national committees may also take place on a working day.
(3) The elections are held on a specified day from 7 a.m. to 16 p.m.. In the capital city of Prague, the cities which are the seats of regional and regional national committees, as well as in all municipalities with at least 10 000 inhabitants, elections take place on a specified day from 7 a.m. to 20 p.m. If local needs so require, the start of the elections may be set for an earlier hour.
