Regulation on the disposal of road motor vehicles used in commercial transport

Order of the Minister for Transport
of 27 March 1950
on the disposal of road motor vehicles used for commercial transport.
The Minister of Transport hereby orders pursuant to § 41 (4) of Act No. 241 / 1948 Coll., on the first five-year Economic Plan for the Development of the Czechoslovak Republic (Act on the Five-Year Plan):
§ 1.
(1) In order to ensure the performance of the tasks of the five-year plan, buses, coaches, coaches and lorries used for the commercial transport of persons or goods (hereinafter referred to as "vehicles') may only be disposed of (voluntarily and in forced auctions) with the prior approval of the District National Committee responsible for the vehicle station. This provision does not apply to vehicles of Czechoslovak automotive transport, national enterprise, and municipal enterprises.
(2) In the request for approval to be disposed of, the owner of the vehicle shall give a brief description of the vehicle, the registration number and the place where the vehicle can be viewed.
§ 2.
(1) If the District National Committee gives its consent to the disposal of a vehicle, it shall, as a general rule, determine who is entitled to acquire the vehicles; no vehicle shall be stolen from others.
(2) In determining the eligible acquirer, care must be taken to ensure that the vehicle is used efficiently and economically. If the vehicle has mainly served the needs of a particular economic sector, the acquirer must be obliged to satisfy those needs at least to the present extent.
(3) As a legitimate acquirer, the District National Committee will determine, in particular, the Czechoslovak Automotive Transport, the National Company, or a municipal undertaking in the district of the relevant district which operates the type of public transport for which vehicles can be used. Where such undertakings are not interested in a vehicle or do not make a binding declaration that they will meet the transport needs as referred to in paragraph 2, they shall be designated as a legitimate other acquirer (government, state, national, municipal or cooperative).
§ 3.
If the public administration or undertakings referred to in the second sentence of Article 2 (3) are not interested in the vehicle, the district national committee may consent to its disposal without designating a legitimate acquirer.
§ 4.
Where he acts against or circumvents the provisions of this Regulation, he shall be punished by the county national - if not a criminal offence - by a fine of CZK 250,000 or a prison sentence (lockdown) within 6 months. In the event of imperfections, a replacement prison sentence (lock-down) shall be determined in accordance with the guilt rate, up to a maximum of 6 months.
§ 5.
This Regulation shall enter into force on the day of its publication.
