GOVERNMENT REGULATION
of 14 June 2006
amending Government Regulation No 205 / 2004 Coll., laying down, within the framework of the common organisation of the market in milk and milk products, detailed conditions for the granting of support and national support for the consumption of milk and milk products to pupils carrying out compulsory schooling in schools included in the school network, as amended
The Government orders pursuant to § 2b (2) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 128 / 2003 Coll. and Act No. 441 / 2005 Coll., and under § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act on the State Agricultural Intervention Fund), as amended by Act No. 441 / 2005 Coll.:
Government Regulation No. 205 / 2004 Coll., laying down, within the framework of the common organisation of the market in milk and milk products, more detailed conditions for the granting of support and national support for the consumption of milk and milk products to pupils who perform compulsory schooling in schools in the school network, as amended by Government Regulation No. 128 / 2005 Coll. and Government Regulation No. 371 / 2005 Coll., are amended as follows:
1. In Article 3 (1), the words "or school catering facilities' shall be inserted after the words" to school '.
2. in Article 3 (2) (b):
"(b) an entity which supplies supported milk products on behalf of one or more legal persons engaged in school or school catering facilities or their promoters."
3. in Article 3 (4) (a) and (b):
"(a) a certified copy of the document certifying the formation of the legal person, if the legal person carrying out the activities of the school or school catering establishment is concerned,
(b) if the school or school catering establishment is concerned, the list of legal persons engaged in the school or school catering establishment established by it and for whom the milk products supported shall be supplied, ';
footnote 12 is deleted.
4. In Article 3 (4) (d) (1), the words "authorises him on behalf of one or more schools' are replaced by the words" authorises him on behalf of one or more legal persons engaged in school or school meals'.
5. In Article 3 (5), the words "or school catering facilities' shall be inserted after the words" to schools'.
6. in Article 4 (3) (a), the words "the address of the individual schools or, where appropriate, of the school food facility (9)" shall be replaced by the words "the seats of the individual legal persons operating the school or, where appropriate, the legal persons operating the school food facility (9)."
7. in Article 4 (3) (c), the words "schools or, as the case may be, school eating establishments 9)" shall be replaced by the words "legal persons engaged in school or, as the case may be, legal persons engaged in school eating establishments 9)."
8. In Article 4 (5), the words "or school catering facilities' shall be inserted after the words" to schools'.
9. Annex 2 shall read as follows:

Explanatory notes:
*) The inclusion of dairy products in the groups referred to in Annex I to Commission Regulation (EC) No 2707 / 2000, as amended by Commission Regulation (EC) No 816 / 2004. For milk products included in the groups referred to in Annex I to Commission Regulation (EC) No 2707 / 2000, as amended by Commission Regulation (EC) No 816 / 2004, the rate of aid from the European Communities' financial resources shall be fixed for the period from 1.9.2006 to 30.6.2007 in Annex II, point E.
* *) For milk products not included in the groups referred to in Annex I to Commission Regulation (EC) No 2707 / 2000, as amended by Commission Regulation (EC) No 816 / 2004, no aid shall be granted from the financial resources of the European Communities. '.
Transitional provision
Legal relationships arising before the date of entry into force of this Regulation shall be assessed in accordance with existing legislation.
Efficacy
This Regulation shall enter into force on 1 September 2006.
