GOVERNMENT REGULATION
of 5 October 2016
amending Government Regulation No 567 / 2006 Coll., on the minimum wage, on the lowest levels of guaranteed wages, on the definition of a difficult working environment and on the amount of the wage supplement for work in a difficult working environment, as amended, and Government Regulation No 589 / 2006 Coll., providing for a derogation from the working and rest periods of workers in transport, as amended by Government Regulation No 353 / 2008 Coll.
The Government orders pursuant to § 100 (1), § 112 (2) and § 117 of Act No. 262 / 2006 Coll., Labour Code, as amended by Act No. 362 / 2007 Coll.:
Amendment of the Government Regulation providing for a derogation from working time and rest periods for transport workers
Government Regulation No. 589 / 2006 Coll., providing for a derogation from the working and rest periods of workers in transport, as amended by Government Regulation No. 353 / 2008 Coll., is amended as follows:
1. In the last sentence of Paragraph 1, the word "i 'is replaced by the words" the remuneration of bus crew members for the waiting period between the time and the local timetable for public regular passenger transport and'.
2. In Section 2 of the introductory part of the provision, the words "for the purposes of this Regulation 'shall be inserted after the words" are'.
3. In Article 2, at the end of the text in point (a), the words "(hereinafter referred to as" a member of a truck or bus crew ") 'are added.
4. In Article 2 (d), the words "in urban bus transport27 'shall be inserted after the words" members of the bus crew'.
Footnote 27 reads:
"27) § 2 (7) (a) of Act No. 111 / 1994 Coll., on Road Transport, as amended."
5. In Article 2 (d), the words "and members of the bus crew of regular passenger services for which the length of any connections does not exceed 50 km 'are deleted.
6. in Article 2, the following point (e) is inserted after point (d):
"(e) members of a bus crew in regular passenger services, which are drivers, drivers' helpers and conductors, for which the length of none of the connections exceeds 50 km (hereinafter referred to as" member of the bus crew in regular passenger services "); a member of the bus crew referred to in point (d) shall not be regarded as such staff; ';
Points (e) to (g) shall be renumbered as points (f) to (h).
7. In Article 2, point (g), including footnote 10, is deleted.
Point (h) shall be renumbered as point (g).
8. in Article 3 (a), the words "except for the time of waiting between connections in public scheduled passenger services within the time and local timetable line," shall be deleted;
9. in Article 3, the following point (c) is inserted after point (b):
"(c) by waiting between public scheduled passenger services by buses for a period of time and at a local time specified by the timetable in which the staff member referred to in § 2 (a) and (e) does not drive or perform any other work for the employer; Such time shall not be included in the working time (hereinafter referred to as" the waiting time between connections'), '.
Points (c) to (h) shall be renumbered as points (d) to (i).
Article 10 (9a) is deleted.
11. In Part Two, Head Part 4, including the title and footnote 28, is added after Part 3:
Remuneration for waiting time between connections
For each full hour of waiting between connections, a member of the bus crew under § 2 (a) shall be remunerated at least 90% of the hourly rate of the lowest level of guaranteed wage fixed for the fifth working group (28). The periods of waiting between connections shall be aggregated for the purposes of determining remuneration in the calendar month.

12. In Part Two, the following Title VI is inserted after Title V:
_
The provisions of § 16 to 19 shall apply to the working hours, rest periods and a security break of a member of the bus crew in regular passenger transport.
During the time of waiting between connections, a member of the bus crew in regular passenger transport is rewarded according to § 9a. '
Titles VI to VIII to date shall be renumbered Titles VII to IX.
13. In Part Two, Title IX, including the title, is deleted.
14. Paragraph 28 (3) is deleted.
EFFECTIVE
This Regulation shall be binding in its entirety and directly applicable in all Member States.
