amending Act No 29 / 2000 Coll., on postal services and amending certain laws (Postal Services Act), as amended
Parliament has decided on this law of the Czech Republic:
Čl. I
Act No. 29 / 2000 Coll., on Postal Services and on the amendment of certain laws (Act on Postal Services), as amended by Act No. 517 / 2002 Coll., Act No. 225 / 2003 Coll., Act No. 501 / 2004 Coll., Act No. 95 / 2005 Coll., Act No. 413 / 2005 Coll., Act No. 444 / 2005 Coll., Act No. 264 / 2006 Coll., Act No. 110 / 2007 Coll., Act No. 250 / 2016 Coll., Act No. 41 / 2009 Coll., Act No. 221 / 2009 Coll., Act No. 212 / 2013 Coll., Act No. 258 / 2014 Coll., Act No. 329 / 2011 Coll., Act No. 89 / 2012 Coll.
1. In Article 22 (4), the words "the method of calculating the annual net costs of the provision of basic services, which is in accordance with Article 34b, and 'are replaced by the words" a specific proposal for the calculation of the annual net costs of the provision of basic services carried out in accordance with Article 34b and envisaged'.
2. In Paragraph 22, the following paragraph 5 is inserted after paragraph 4:
"(5) If an applicant who is a legal person becomes extinct during a selection procedure, the applicant shall be deemed to be the legal successor of the deceased applicant unless he declares that he is not bound by the application. ';
Paragraphs 5 to 9 shall be renumbered paragraphs 6 to 10.
3. In Paragraph 22 (8), "6 'is replaced by" 7'.
4. In Article 23, the current text becomes paragraph 1 and the following paragraphs 2 and 3 are added:
"(2) The Office may, at the request of the holder of the postal licence, change the scope of the postal obligation if this is justified by an exceptional change in the circumstances on the basis of which the postal licence was granted or by a change in the legislation on the basis of which the decision granting the postal licence was issued. The Office shall decide on the application within 4 months.
(3) The Office may extend the validity of the postal licence granted until the time of the new licence, even repeatedly but not more than one year, should it threaten not to ensure the availability of essential services on the basis of the grant of a new postal licence. "
5. The following Section 23a is inserted after Section 23:
„§ 23a
Transfer of postal licence
Where the transfer of a legal person holding a postal licence is due to result in the loss of the holder of a postal licence, an adjustment to the transfer of the postal licence to his legal successor shall be included in the conversion project or another similar document. The holder of the postal licence shall notify the Office of the conversion and submit the conversion project or other similar document at least 30 days before the date of its entry into force and indicate which person will be the holder of the postal licence from the date of entry into force of the conversion. ';
6. In Article 24 (a), the words "or those conditions are not met by the person on whom the postal licence has been issued pursuant to Article 23a," shall be inserted after the words "granted."
7. In Paragraph 24, the present text becomes paragraph 1 and the following paragraphs 2 and 3 are added:
"(2) Once the decision referred to in paragraph 1 has become final, the Office shall carry out the review provided for in Paragraph 37 (4) without delay and publish the selection procedure provided for in paragraph 22.
(3) In the event of withdrawal of the postal licence, the current holder of the postal licence shall continue to fulfil the postal obligation within the scope of the current postal licence. '
8. In Article 25 (b), the words "or the date of the termination of a legal person with a legal successor, unless a transfer of a postal licence has taken place pursuant to Article 23a," shall be inserted after the word "successor."
9. In Paragraph 25, the text "paragraph 1 'is added at the end of the text in point (c).
10. In Paragraph 25, the current text becomes paragraph 1 and the following paragraph 2 is added:
"(2) In the event of the termination of the postal licence referred to in paragraph 1, points (a) and (b) shall apply. (b) The Office shall temporarily grant a postal licence in accordance with the procedure laid down in Article 22 (10) to the same extent as the basic services in which the expired postal licence was issued for the period remaining until the end of the validity of the expired postal licence, but only once and for a maximum period of one year, and shall review it without delay in accordance with Article 37 (4)."
11. In Section 32, the words "transition or 'shall be inserted after the word" its'.
12. In Article 34 (5), the words "or, failing that, the Contracting Parties to such a contract shall, within 2 months of the date of the opening of the negotiations on the draft amendment 'shall be inserted after the words" draft contract'; the words "or amendments thereto 'shall be deleted;
13. in Article 34b (7), the words "incentive to cost-effectiveness" shall be inserted after the words "benefits."
14. in Article 34c (1), "July" is replaced by "April."
15. in Article 34c (2) and (3):
"(2) By decision, the Office shall determine the provisional net costs at the level indicated in the request referred to in paragraph 1, but not more than the net costs representing an unfair financial burden for the nearest preceding settlement period for which the net costs have been verified. At the same time, the provisional net costs shall not exceed the net costs indicated for the period in question in the application for a postal licence. In the first year of validity of the postal licence, the Office shall, by decision, determine the provisional net costs of the holder of the postal licence not exceeding the net costs indicated in the application for a postal licence for a given settlement period, or the amount referred to in Article 34d (2), whichever is the lower. In the event that the holder of the postal licence has fulfilled or is required to fulfil the post obligation only in part of the settlement period, the Office shall reduce the amount of provisional net costs proportionately.
(3) The Office of the State Budget shall reimburse the provisional net costs for the quarter of the accounting period ending before the decision referred to in paragraph 2 becomes final, within 30 days of the date on which the decision becomes final. The provisional net costs for the next quarter of the accounting period shall be paid to the postal licence holder within 30 days of the end of that quarter. ';
16. In Article 34c, the following paragraph 4 is added:
"(4) Where the holder of a postal licence has fulfilled the postal obligation only during the part of the period for which the provisional net costs have been quantified by the decision referred to in paragraph 2, the Office shall, before making the payment referred to in the second sentence of paragraph 3, make an official amendment to the decision. ';
17. in Article 34d (2), the words "at the rate of net costs verified in accordance with Article 34b (6)" shall be deleted and the amount "CZK 1 500 000" shall be replaced by "CZK 2 000 000 000."
18. in Article 34d (3), the words "plus interest at the end of the text of point (b), at the rate of the average of the two-week repos declared by the Czech National Bank in the year in which the application for reimbursement of the provisional net costs was made, shall be added; interest shall be determined for the period from the time when the holder of the postal licence was paid the amount of the provisional net costs in excess of the net costs constituting an unfair financial burden until the date of recovery."
19. in Article 34d (4), the words "The State shall pay through the Office" shall be replaced by "The Office shall pay from the State Budget."
20. In Paragraph 34d, the following paragraph 6 is inserted after paragraph 5:
"(6) If the holder of a postal licence has not submitted an application pursuant to paragraph 1, he shall, within 30 days of the expiry of the deadline referred to in paragraph 1, repay to the State the full amount of the provisional net costs paid for the relevant settlement period plus interest of the average of the two-week repos declared by the Czech National Bank in the year in which the application for reimbursement of the provisional net costs was submitted per year. Interest shall be fixed for the period from the date on which the amount of the provisional net costs was paid to the holder of the postal licence until the date of its recovery. The holder of the postal licence shall provide proof to the Office within 15 days of the payment. ';
Paragraph 6 shall become paragraph 7.
21. in Article 34d (7), the words "and the amount referred to in paragraph 6" shall be inserted after the words "(b)."
22. in Article 34d, the following paragraph 8 is added:
"(8) The criteria for assessing the unfair financial burden on the Office in the procedure referred to in paragraph 2 shall be laid down in implementing legislation.";
23. In Article 34e (3), the second sentence is replaced by the following: "The Office shall not issue a decision pursuant to Article 34c (2) or Article 34d (2) until the European Commission has decided on the eligibility of provisional net costs or net costs constituting an unfair financial burden."
24. in Article 37a (3), the word "or" shall be deleted at the end of point (g).
25. In Paragraph 37a, at the end of paragraph 3, the dot is replaced by "or 'and the following point (i) is added:
"(i) in contravention of Paragraph 23a, it shall not notify the Office of the conversion, submit a conversion project or any other similar document or indicate which person will be the holder of the postal licence from the date of entry into force of the conversion.";
26. in Paragraph 37a (6) (b), "(g) or (h)" is replaced by "(g), (h) or (i)."
27. in § 41 (1), the words "and § 34b (7)" are replaced by the words "§ 34b (7) and § 34d (8)."
Čl. II
Transitional provisions
1. The proceedings in respect of postal licences which were not definitively concluded before the date of entry into force of this Act shall be completed in accordance with Act No. 29 / 2000 Coll., as effective before the date of entry into force of this Act.
2. Entitlement of the holder of the postal licence to cover the provisional net costs and net costs for the accounting period started
(a) no later than 31 December 2024, shall be assessed in accordance with Act No. 29 / 2000 Coll., as effective before the date of entry into force of this Act,
(b) after 31 December 2024, it shall be assessed in accordance with Act No. 29 / 2000 Coll., as effective from the date of entry into force of this Act.
Čl. III
Efficacy
This Act shall take effect on 1 January 2026.
