amending Government Regulation No 330 / 2019 Coll., on the conditions for implementing the following agri-environmental climate measures, as amended, and other related government regulations
The Government mandates pursuant to § 2b (2) and § 2c (5) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 128 / 2003 Coll., Act No. 85 / 2004 Coll., Act No. 441 / 2005 Coll., Act No. 291 / 2009 Coll. and Act No. 179 / 2014 Coll., and pursuant to § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act on the State Agricultural Intervention Fund), as amended by Act No. 441 / 2005 Coll., Act No. 291 / 2009 Coll. and Act No. 179 / 2014 Coll.:
Amendment of the Government Regulation on the conditions for implementing successive agri-environmental measures
Government Decree No. 330 / 2019 Coll., on the conditions for the implementation of successive agri-environmental climate measures, as amended by Government Decree No. 217 / 2020 Coll., Government Decree No. 54 / 2021 Coll. and Government Decree No. 177 / 2021 Coll., are amended as follows:
1. In Article 10 (3) (b), the words "pursuant to Article 3 (3) under the sub-paragraph referred to in Article 2 (a) or" shall be inserted after the word "commitment."
2. In Article 11 (3) (b), the words "pursuant to Article 3 (3) under the sub-paragraph referred to in Article 2 (b) or 'shall be inserted after the word" commitment'.
3. In Article 12 (3) (b), the words "pursuant to Article 3 (3) under the sub-paragraph referred to in Article 2 (c) or 'shall be inserted after the word" commitment'.
4. In Article 13 (3) (b), the words "31 December 2019 or 31 December 2020 'are replaced by the words" 31 December 2021 classified under Article 3 (3) in the sub-measure commitment referred to in Article 2 (d) or were on 31 December 2019, 31 December 2020 or 31 December 2021'.

Amendment of the Government Regulation on certain conditions for granting direct payments to farmers

1. Paragraph 2 (1) reads as follows:
"(1) The State Agricultural Intervention Fund (hereinafter referred to as" the Fund ") may apply for direct payment to farmers under Article 1 of this Regulation by a natural or legal person who manages the agricultural land registered in the land use register under the Agricultural Act (hereinafter referred to as the Land Use Register). '.
2. Paragraph 2 (1) reads as follows:
"(1) A direct payment to farmers under Article 1 may be requested by the State Agricultural Intervention Fund (hereinafter referred to as the Fund) by a natural or legal person who:
(a) manage the agricultural land registered on it in the land use register according to user relations under the Agriculture Act ("land use register"); and
(b) has access to the Fund's information system under the State Agricultural Intervention Fund Act. ';
3. In Article 2 (2), the text "(b) 'is deleted.
Transitional provision
Applications initiated under Government Regulation No. 50 / 2015 Coll., as effective before the date of entry into force of this Regulation, shall be completed under Government Regulation No. 50 / 2015 Coll., as effective from the date of entry into force of this Regulation.
Amendment of the Government Regulation on the conditions for granting subsidies on animal welfare measures
Government Regulation No. 74 / 2015 Coll., on the conditions for granting subsidies on animal welfare measures, as amended by Government Regulation No. 113 / 2015 Coll., Government Regulation No. 62 / 2016 Coll., Government Regulation No. 17 / 2017 Coll., Government Regulation No. 49 / 2017 Coll., Government Regulation No. 34 / 2018 Coll., Government Regulation No. 58 / 2019 Coll., Government Regulation No. 332 / 2019 Coll., Government Regulation No. 217 / 2020 Coll., Government Regulation No. 55 / 2021 Coll. and Government Regulation No. 177 / 2021 Coll., is amended as follows:
1. In Article 16, the following paragraph 5 is added:
"(5) The fund will not provide the applicant with the sub-subsidy provided for in Paragraph 2 (1) (a) for that holding if, in at least one of the permanent buildings mentioned in the application for the subsidy, there has been an increase in the number of housed animals referred to in § 2 (7) (b) (1) of Decree No. 208 / 2004 Coll., on minimum standards for the protection of livestock, as amended, for stables with an automatic milking system pursuant to § 1a (e) of Decree No. 208 / 2004 Coll., as amended."
2. In Annex 3, the words "on the list of PPAs approved by the Institute for State Control of Veterinary Biocidal Products and Medicinal Products' are replaced by the words" in the Register of Biocidal Products of the CHLAP database of the Ministry of Health notified under Section 13 of Act No. 324 / 2016 Coll., on Biocidal Products and Active Substances and on the amendment of certain related acts (Biocidal Act) '.
3. In Annex No 8, Part I., table F, point 1 is replaced by the following:
"
| 1. | Oplocení hospodářství je minimálně 180 cm vysoké, v rozích zaoblené, dostatečně silné a bezpečné, aby v případě nárazu nedocházelo k poranění běžců. Zařízení musí být zabezpečeno proti vnikání větších druhů volně žijících zvířat nebo toulavých psů. Minimální velikost výběhu na každého dospělého pštrosa dvouprstého je 300 m2. Minimální velikost výběhu na každého dospělého nandu pampového nebo emu hnědého je 100 m2. Stáje nebo přístřešky pro pštrosy dvouprsté, nandu pampové a emu hnědé musí být vzdušné, větratelné a zabraňovat průvanu. Výška stropu musí umožňovat volný pohyb stojícího zvířete. Veškeré průchody musí umožňovat bezpečný pohyb zvířete bez možnosti poranění. |

4. In Annex No 8, Part I, under table F, the following point 4 is added:

5. In Annex No 8, Part I, entry G. of the table is deleted.
The current entries H. and I. are renumbered as entries G. and H..
6. In Annex 8, Part II, under Table 2, the following is added at the end of the text of Note 3: "; in stables with an automatic milking system, the number of housed animals may be increased by up to 20% compared to the number of lying boxes if the bulk feed is fed to the animal's own needs and if the animal movement control system ensures that the number of animals in the lying box space is not greater than the number of such boxes (9)."
Transitional provision
Applications initiated under Government Regulation No. 74 / 2015 Coll., as effective before the date of entry into force of this Regulation, shall be completed under Government Regulation No. 74 / 2015 Coll., as effective before the date of entry into force of this Regulation.

Government Regulation No. 76 / 2015 Coll., on the conditions for the implementation of organic farming measures, as amended by Government Regulation No. 113 / 2015 Coll., Government Regulation No. 64 / 2016 Coll., Government Regulation No. 236 / 2016 Coll., Government Regulation No. 18 / 2017 Coll., Government Regulation No. 49 / 2017 Coll., Government Regulation No. 29 / 2018 Coll., Government Regulation No. 43 / 2018 Coll., Government Regulation No. 57 / 2019 Coll., Government Regulation No. 332 / 2019 Coll., Government Regulation No. 217 / 2020 Coll., Government Regulation No. 55 / 2021 Coll. and Government Regulation No. 177 / 2021 Coll., are amended as follows:
1. In Section 12 (2) of the Introductory Part of the Provisions and in Section 12 (3) of the Introductory Part of the Provisions, the words "or pursuant to Section 10 (1) (a) or (c) of Government Regulation No 331 / 2019 Coll. 'shall be inserted after the words" (a) or (c)'.
2. In Annex 6, Part B, the following row 44 is inserted after row 43:

Row 44 is renumbered as row 45.
Transitional provision
Applications initiated under Government Regulation No. 76 / 2015 Coll., as effective before the date of entry into force of this Regulation, shall be completed under Government Regulation No. 76 / 2015 Coll., as effective before the date of entry into force of this Regulation.
Amendment of the Government Regulation on the conditions for implementing the downstream organic farming measure
Government Decree No. 331 / 2019 Coll., on the conditions for the implementation of the downstream organic farming measure, as amended by Government Decree No. 217 / 2020 Coll., Government Decree No. 55 / 2021 Coll. and Government Decree No. 177 / 2021 Coll., are amended as follows:
1. In Section 10 (2) of the Introductory Part of the Provisions and in Section 10 (3) of the Introductory Part of the Provisions, the words "or pursuant to Section 12 (1) (a) or (c) of Government Regulation No 76 / 2015 Coll. 'shall be inserted after the words" (a) or (c)'.
2. In Annex 5, Part B., the following row 44 is inserted after row 43.:

Transitional provision
Applications initiated under Government Regulation No 331 / 2019 Coll., as effective before the date of entry into force of this Regulation, shall be completed under Government Regulation No 331 / 2019 Coll., as effective before the date of entry into force of this Regulation.
EFFECTIVE
This Regulation shall enter into force on 1 March 2022, with the exception of the provisions of Part Six which shall take effect on 1 August 2022, and with the exception of the provisions of Part Two, Article III, point 2, which shall take effect on 1 January 2023.
