GOVERNMENT REGULATION
of 5 February 2007
amending Government Regulation No 245 / 2004 Coll., laying down closer conditions for the implementation of measures of the common organisation of the market in wine, as amended by Government Regulation No 83 / 2006 Coll.
The Government orders pursuant to § 2b (2) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 128 / 2003 Coll. and Act No. 441 / 2005 Coll.:
Government Regulation No 245 / 2004 Coll., on the establishment of closer conditions for the implementation of measures of the common organisation of the market in wine, as amended by Government Regulation No 83 / 2006 Coll., is amended as follows:
1. In Paragraph 8 (1), "March 'is replaced by" April'.
2. In Article 8 (5), the words "plan and first 'are replaced by the words" plan or first' and the words "application under paragraph 1 has been included in the plan 'are replaced by the words" grower has requested inclusion in the plan'.
3. In Article 8, paragraph 6 is added:
"(6) Where the grower of the Fund makes a summary application for several measures referred to in paragraph 2, the Fund shall include and assess each measure separately. Paragraph 8a (1) (b) is without prejudice to this. The Fund shall include in the plan the whole or part of the soil block, or parts thereof, for which the conditions laid down in this Regulation and in the Regulation of the European Communities (1a) have been met, by project. ';
4. In Article 8a (4), "6 'is replaced by" 2' and the words "but not later than the date set out in Article 8i (1) 'are deleted.
5. in Article 8b (3) (f):
"(f) the date of termination of the measure referred to in paragraph 4;"
6. Paragraph 8b (4) reads as follows:
"(4) Aid applications for the measure referred to in Article 8 (2) (b) shall be submitted by the grower no later than 2 months after the completion of the planting of the new vineyard planted with support columns. ';
7. In Paragraph 8c (1), the words "; the term must be at least 1 000 pieces / ha 'shall be inserted after the words" at least 3 000 pieces / ha'.
8. in § 8c (2) (d):
"(d) the date of termination of the measure referred to in paragraph 4.";
9. Paragraph 8c (4) reads as follows:
"(4) Aid applications shall be submitted by the grower within 2 months of the increase in the number of shrubs in the vineyard planted with support posts. ';
10. Paragraph 8c (5) is deleted.
11. in Article 8d (3) (f):
"(f) the date of termination of the measure referred to in paragraph 4.";
12. in Paragraph 8d (4):
"(4) The aid application for the measure shall be submitted by the grower to the Fund no later than 2 months after the date of completion of the planting of the vineyard, with supporting columns. ';
13. In Article 8e, at the end of paragraph 1, the following sentence is added: "Measures to protect vineyards against damage caused by game shall be broken down into measures carried out by individual protection to protect individual shrubs at a number of shrubs of at least 1 000 pieces / ha and measures carried out by collective protection carried out by fencing of the vineyard. A vineyard shall be considered as a fenced vineyard, the fencing of which shall prevent the passage of game into the vineyard. ';
14. in § 8e (3) (b):
"(b) the way in which the vineyard is protected in accordance with paragraph 1;"
15. in Article 8e (4), the word "grower" shall be replaced by "whole or part of the soil block."
16. in Article 8e (5), '6' is replaced by '2' and the words' but not later than the date provided for in this Regulation 'are deleted;
17. in Article 8e (6), the words "this measure" shall be replaced by the words "the relevant measure carried out by individual protection or the measure carried out by collective protection."
18. in Paragraph 8f (1):
"(1) Measures to protect vineyards against damage caused by birds shall be broken down into measures carried out by passive protection and actions carried out by active protection. These measures shall include only the whole of the soil block and, where appropriate, the part on which the vineyard is situated. The protection of vineyards against damage caused by birds shall be ensured during the period of maturing grapes on the vineyard, which was planted no later than the previous calendar year. The protection of such vineyards shall be ensured by passive protection or active protection; the following point is inserted:
19. in § 8f (3) (b):
'(b) the way in which the vineyard is protected by a measure carried out by passive protection or an action carried out by active protection,';
20. in the first and second sentences of Paragraph 8f (4), the words "growers" shall be replaced by "whole or part of the soil block."
21. in Article 8f (5) (a), the number "6" is replaced by "2" and the words "not later than the date laid down in Article 8i (1)," shall be deleted;
22. in Article 8f (5) (b), the words "within the period laid down in Article 8i (1)" shall be replaced by the words "within 2 months of the end of the active protection of vineyards."
23. in Article 8f (6), the words "this measure" shall be replaced by the words "the measure carried out by passive protection or the measure carried out by active protection."
24. in § 8g (3) (e), the words "building of the supporting structure" are replaced by the words "planting of vineyards."
25. in Article 8h (4), the number "6" is replaced by "2" and the words "but no later than the date laid down in Article 8i (1)" shall be deleted;
26. in Paragraph 8i (1):
"(1) The aid application for restructuring and conversion of vineyards shall be submitted by the Fund grower on the form issued by him within 2 months of the date of completion of the measure in question. ';
27. in Article 8i (2), point (b) is deleted;
Points (c) and (d) shall be renumbered (b) and (c).
28. In Article 8i (3), the sentence "The Fund shall evaluate the individual measures in accordance with Article 8e and Article 8f separately according to the way in which the vineyard is protected."
29. In Paragraph 8i, the following paragraph 5 is added:
"(5) The Fund shall pay the growers the aid for restructuring and conversion of vineyards on the basis of the application referred to in paragraph 1 submitted to the Fund from 1 May of the calendar year to 27 February immediately following the calendar year in question from the appropriations allocated in the marketing year concerned. Aid for the restructuring and conversion of vineyards by growers whose application has been submitted to the Fund from 28 February to 30 April of the calendar year shall be paid by the Fund from the appropriations allocated for the following marketing year. Paragraph 8j (3) and (4) shall not be affected. ';
30. In Section 8j of the introductory part of the provisions of paragraph 1, "within 'is replaced by" to'.
31. in § 8j (1) (c):
"(c) the increase in the number of bushes in the vineyard amounts to CZK 75,000 per ha of vineyard,"
32. in § 8j (1) (e) and (f):
"(e) the protection of vineyards against animal damage shall be:
1. 50 000 CZK per ha of vineyard, if it is an individual protection measure,
2. 90 000 CZK per ha of vineyard, if it is a measure carried out by collective protection,
(f) the protection of vineyards against damage caused by birds shall be:
1. 30 000 CZK per ha of vineyard, if it is a measure carried out by passive protection,
2. 20 000 CZK per ha of vineyard, if it is a measure carried out by active protection,. "
33.In Article 8j (1), the word "vineyard" shall be added at the end of the text in point (g).
Transitional provisions
1. An application for aid for restructuring and conversion of vineyards not yet submitted by the Fund grower and for which, under existing legislation, the deadline for its submission has not yet expired, but pursuant to Government Regulation No 245 / 2004 Coll., as effective from the date of entry into force of this Regulation, that period has expired, shall be submitted by the Fund grower on the form issued by him within 2 months of the date of entry into force of Government Regulation No 245 / 2004 Coll., as effective from the date of entry into force of this Regulation. The application according to the first sentence shall be examined in accordance with Government Decree No. 245 / 2004 Coll., as effective from the date of entry into force of this Regulation.
2. The application for inclusion in the restructuring and conversion plan of vineyards, included in the restructuring and conversion plan of vineyards under the existing legislation or, where applicable, under those regulations, shall be assessed in accordance with the existing legislation.
3. The application for inclusion in the Plan for the restructuring and conversion of vineyards, classified under the existing legislation, shall be deemed to be classified under Government Regulation No 245 / 2004 Coll., as effective from the date of entry into force of this Regulation.
4. The amount of aid for the restructuring and conversion of vineyards for applications included in the Plan for the restructuring and conversion of vineyards under the existing legislation shall be determined in accordance with Government Regulation No 245 / 2004 Coll., as effective from the date of entry into force of this Regulation.
Efficacy
This Regulation shall enter into force on the day of its publication.
