GOVERNMENT REGULATION
of 29 January 2003
imposing a provisional safeguard measure on imports of ammonium nitrate into the Czech Republic
The Government mandates pursuant to § 19 of Act No. 62 / 2000 Coll., on certain arrangements for export or import of products and on licensing and amending certain laws:
(1) For goods covered by the Customs Tariff (1) under subheading 3102 30 90 - Other, the rate of the import duty fixed by the Customs Tariff (1) or the international contract (2) shall be increased by 5, by 35 for the same goods originating in the Russian Federation and the Republic of Ukraine by 16.
(2) Religious goods originating in the Russian Federation or in the Republic of Ukraine are goods which meet the conditions laid down in specific legislation.3)
For goods referred to in § 1 whose customs value declared on importation is more than CZK 4,200 per tonne, the increased import duty rates shall not apply.
(1) Paragraphs 1 and 2 shall not apply to goods originating in a developing country (1) or least developed country (1) which is a member of the World Trade Organisation (4), provided that its share of imports of goods as defined in paragraph 1 does not exceed 3% of the total import of those goods and that imports from those countries with a share of less than 3% do not represent more than 9% of the total import volume of the goods.
(2) Religious goods originating in a developing country or least developed country are goods which meet the conditions laid down in specific legislation. 5)
(1) This Regulation shall enter into force on the day of its publication.
(2) This Regulation shall expire on 28 August 2003.

1) Government Decree No. 534 / 2002 Coll., on the issue of the Customs Tariff and on the fixing of import duty rates for goods originating in developing and least developed countries and the conditions for their application (Customs Tariff).
2) For example, the Central European Free Trade Agreement concluded between the Czech Republic, the Republic of Hungary, the Republic of Poland and the Slovak Republic, published under No 54 / 1995 Coll., as amended.
3) § 59 to 63 of Act No. 13 / 1993 Coll., Customs Act.
4) Agreement establishing the World Trade Organisation (WTO), published under No 191 / 1995 Coll.
5) Articles 59 to 63 of Act No. 13 / 1993 Coll. 3 to 6 and Annex 4 to Decree No. 69 / 1989 Coll., on exemption of commercial goods imported and originating in developing countries from import duties.
