THE LAW
of 8 February 1995
amending and supplementing the Act of the Czech National Council No. 186 / 1992 Coll., on the service ratio of members of the Police of the Czech Republic, as amended, and Act No. 100 / 1970 Coll., on the service ratio of members of the National Security Corps, as amended
Parliament has decided on this law of the Czech Republic:
Act No. 100 / 1970 Coll., on the service relationship of members of the National Security Corps, as amended by Act No. 63 / 1983 Coll., Act No. 74 / 1990 Coll., Act No. 169 / 1990 Coll., Act No. 546 / 1990 Coll., Act No. 77 / 1992 Coll., Act No. 143 / 1992 Coll. and Czech National Council Act No. 586 / 1992 Coll., is added as follows:
1. the following Section 114b is inserted after Section 114a:
Where, under this Act, a service allowance in the Federal Security Information Service has been awarded higher than that in the calculation of the period of employment referred to in Section 134 (3), or where the service allowance has been awarded under this Act, although it does not apply to the calculation of the period of employment referred to in Section 134 (3), that allowance shall be reduced from the date of application of this Act to the amount corresponding to that of the period of employment referred to in Section 134 (3) or its payment shall cease. The reassessment of the reduced contribution shall be carried out by 31 October 1995 at the latest; until the reassessment of the contribution, its payment shall be suspended. ';
2. In Paragraph 134 (1), the following words are added at the end: "unless otherwise specified."
3. the following paragraph 3 shall be added to Article 134:
"(3) Former members of the Federal Security Information Service shall not be counted for service periods until the duration of the service applicable to the grant of the service allowance.
(a) a national of the National Security Corps, classified in the State Security component of the counter-intelligence or intelligence division or as an investigator or chief of the Department and higher in the State Security component;
(b) armed forces with military counterintelligence;
(c) in the armed forces, classified in the branch of the Czechoslovak People's Army Intelligence, unless they have been included in the functions of servicing technical equipment for military exploration;
(d) a member of the National Security Corps, classified in the Political Administration (branch) of the Federal Ministry of Interior, the Ministry of Interior of the Czech Republic or the Ministry of Interior of the Slovak Republic, who was directly engaged in political activities;
(e) a national of the National Security Corps, appointed as Deputy Chief of Political Work,
(f) a member of the Correctional Education Corps, appointed as Deputy Chief of Administration or Political Work Unit;
(g) a soldier of the Czechoslovak People's Army, included in the Political Administration of the Czechoslovak People's Army, who was directly engaged in political activities or who was assigned as Deputy Commander for Political Work or Propagandists. "
This Act shall take effect on 1 April 1995.
