GOVERNMENT REGULATION
of 20 August 2025
laying down certain conditions for the implementation of exceptional financial support for agricultural sectors affected by adverse climatic events and natural disasters in the Czech Republic
The Government mandates pursuant to § 2b (2) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 85 / 2004 Coll., Act No. 291 / 2009 Coll., Act No. 179 / 2014 Coll. and Act No. 382 / 2022 Coll., and under § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act No. 441 / 2005 Coll., Act No. 291 / 2009 Coll. and Act No. 179 / 2014 Coll.:
Subject matter
Regulation (EU) No 1308 / 2013 of the European Parliament and of the Council of 11 December 2013 establishing a common organisation of the markets in agricultural products and repealing Council Regulation (EC) No 1234 / 2007 (OJ L 347, 20.12.2013, p. 671). The State Agricultural Intervention Fund ("the Fund ').
Request for emergency support
(1) The Fund will grant exceptional aid at the request of a natural or legal person pursuant to Article 3 (1).
(2) The applicant shall submit to the Fund an application for emergency support by 22 September 2025 at the latest.
(3) At the same time as the application referred to in paragraph 2, the applicant of the Fund shall submit the documents referred to in Article 3 (4) (a), (b) or (c) or Article 3 (5).
Conditions for granting exceptional aid
(1) An applicant for emergency aid may be a natural or legal person who manages the agricultural land kept on it in the land use register according to user relations as a type of agricultural culture of standard arable land or area with multiannual production crops.
(2) The Fund shall grant to the applicant exceptional aid for the area of the cultivated part of the soil block or part thereof kept in the land use register according to the user relations of the applicant with the type of agricultural culture standard arable land or area with multiannual production crops on 11 September 2024 for which the applicant:
(a) declare, for the subsidy period of 2024, in an application pursuant to Article 2 of Government Regulation No 83 / 2023 Coll., laying down the conditions for granting direct payments to farmers, the cultivation of potatoes, sugar beet, grain maize, sunflower, soya, vegetable species referred to in Article 32 (2) or Article 33 (2) of Government Regulation No 83 / 2023 Coll., as amended, or the annual and multiannual forage crops listed in the Annex to this Regulation; or
(b) grow rape for the year 2025.
(3) The Fund shall grant to the applicant exceptional aid for the area of the cultivated part of the soil block or part thereof held on the applicant in the land use register in accordance with the user relations referred to in paragraph 2 for potato, sugar beet, grain maize, sunflower, soya, rape, annual and multi-annual fodder plants listed in the Annex to this Regulation or vegetables which have been flooded in the context of the floods in September 2024 ("flooding").
(4) The Fund shall grant the applicant exceptional support under paragraph 2 (a) on the basis of:
(a) maps of the Czech hydrometeorological institute defining the extent of the area affected by the floods in September 2024;
(b) by the applicant for submitted geotagged flood photographs; or
(c) other documentation submitted by the applicant demonstrating the damage caused by flooding.
(5) The Fund shall grant the applicant exceptional support in the case of rape as referred to in paragraph 2 (a). (b) on the basis of the documents referred to in paragraph 4 and documents showing that the part of the soil block or part thereof kept on the applicant in the land use register under the user relations referred to in paragraph 3 has been grown rape intended for the harvest for 2025.
Publication of exceptional aid rates
The amount of exceptional support rates shall be published by the Fund on its website by 22 October 2025 at the latest.
Refusal of an application for emergency aid
The Fund shall reject an application for emergency support if it finds that the applicant:
(a) has submitted an application for emergency aid after the period laid down in Paragraph 2 (2); or
(b) has failed to fulfil the conditions for granting it.
Efficacy
This Regulation shall take effect on 8 September 2025.
