GOVERNMENT REGULATION
of 20 August 2025
amending Government Regulation No 592 / 2006 Coll., on the conditions for accreditation and performance of proficiency tests, as amended by Government Regulation No 136 / 2016 Coll.
The Government mandates pursuant to Section 21 (b) of Act No. 309 / 2006 Coll., which regulates further requirements for safety and health at work in employment and for ensuring health and safety at work or providing services outside employment (Act on other conditions of safety and health at work), as amended by Act No. 362 / 2007 Coll., Act No. 189 / 2008 Coll., Act No. 88 / 2016 Coll. and Act No. 250 / 2021 Coll.:

Government Regulation No. 592 / 2006 Coll., on conditions for accreditation and performance of proficiency tests, as amended by Government Regulation No. 136 / 2016 Coll., is amended as follows:
1. in Article 3 (1) (a), the words "and methods of assessment of proficiency tests, ensuring impartiality, objectivity, confidentiality and exclusion of conflicts of interest" shall be replaced by the words "and the Code of Ethics of the Panel of Experts (hereinafter referred to as the Code of Ethics)."
2. In Article 3 (1), the words "without undue delay 'shall be added at the end of the text in point (b).
3. In Article 3, the following paragraphs 3 and 4 are inserted after paragraph 2:
"(3) The promoter shall submit the written draft project referred to in paragraph 1 (a) in electronic form.
(4) The Code of Ethics shall contain at least:
(a) the identification data of the accreditation holder;
(b) a description of the subject matter of the accreditation holder's business;
(c) methods for evaluating proficiency tests;
(d) the definition of persons involved in the proficiency test, including the requirement to ensure their impartiality;
(e) establishing the obligation of confidentiality of the accreditation holder in relation to the facts which he has learned in connection with carrying out proficiency tests;
(f) the exclusion of conflicts of interest, including the prohibition of a donation; and
(g) establishing a procedure for dealing with a notification of a breach of the Code of Ethics. ';
Paragraph 3 shall become paragraph 5.
4. In Article 5, paragraphs 3 and 4 are deleted.
Paragraph 5 shall become paragraph 3.
5. In Article 6, the following paragraph 2 is inserted after paragraph 1:
"(2) The holder of the accreditation shall publish the date of the examination, the capacity of the number of candidates for the term and the form to be submitted to the written work on his website at least 60 days before the examination. ';
Paragraphs 2 to 6 shall become paragraphs 3 to 7.
6. Paragraph 6 (5) reads as follows:
"(5) No later than 15 calendar days before the deadline for the examination, the tenderer shall send the accreditation holder a written work in the form required by the accreditation holder in accordance with paragraph 2 for assessment. Submission of written work may be requested in paper or electronic form. ';
7. In Article 6, the sentence "The holder of the accreditation shall draw up a report on the assessment of the written work at the end of paragraph 6 with supplementary questions available to the expert examination committee during the oral part of the examination."
8. In Article 7, at the end of the text of paragraph 2, the words "and if the Protocol referred to in Article 6 (6) has been drawn up 'shall be added.
9. In the third sentence of Article 7 (3), the word "objective 'is deleted.
10. In Article 7, the sentence "The Protocol referred to in Article 6 (6) is annexed to the test record is added at the end of paragraph 7. ';
11. in Article 9, at the end of point (d), the dot is replaced by a comma and the following point (e) is added:
"(e) updates the Code of Ethics in the event of a change in the requirements and methods referred to in Article 3 (4).";
12. In Annex 1 (c), a comma is inserted after the word "disposal '.
13. In Annex 1, point (f) is replaced by the following:
"(g) knowledge of the obligations to record accidents, to identify the causes and circumstances of accidents at work, to report accidents at work, to write and to send an accident record and an accident record - to report changes.";
14. A and B are replaced by "other regulations to ensure safety and health at work ';
15. In Annex 3, Part I, the words "in paper or electronic format 'shall be added at the end of the text of the title A.
16. In Annex 3, Part I, point (b) is replaced by the following: A. point 1 "Written verification 'is replaced by" Verification';
17. In Annex 3, Part I, point (b) is replaced by the following: A. point 2 is replaced by the following: "80 'is replaced by" 90' for the purpose of carrying out risk prevention tasks, and "40 test questions' is replaced by" 50 test questions and 40 test questions for the competence test for the activities of the safety and health coordinator at the site of construction. '
18. In Annex 3, Part I, point (b) is replaced by the following: In point B. (7), the word "written" shall be deleted and the sentence "Supporting documents may also be kept in electronic form in order to enable the Ministry to carry out its inspection."
19. In Annex 3, Part I, point (b) is replaced by the following: D. "at least 90" is replaced by "maximum 100."
20. In Annex 3, Part II, point 1, A and B are added at the end of the table:

This Regulation shall take effect on 1 November 2025.
