GOVERNMENT REGULATION
of 14 January 2004
amending Government Regulation No 249 / 2002 Coll., on the conditions for granting mortgage credit contributions to persons under 36 years of age
The Government mandates the implementation of Act No. 218 / 2000 Coll., on Budgetary Rules and on the amendment of certain related laws (Budget Rules), as amended by Act No. 493 / 2000 Coll., Act No. 141 / 2001 Coll., Act No. 187 / 2001 Coll., Act No. 320 / 2001 Coll., Act No. 450 / 2001 Coll., Act No. 202 / 2002 Coll., Act No. 320 / 2002 Coll. and Act No. 479 / 2003 Coll.:
Government Decree No. 249 / 2002 Coll., on the terms and conditions for granting mortgage credit contributions to persons under 36 years of age, is amended as follows:
1. In Section 1, the words "or, where applicable, the land or corresponding part thereof consisting of a single flat or a family house with one flat 'are replaced by the words" or the purchase of an apartment or a family house with one apartment, including the land or corresponding parts thereof, which are purchased together with an apartment or a family house with one flat and the purchase of movable and immovable property on those parcels'.
2. in Article 3 (1) (c):
"(c) at the date of submission of the application for contributions, at least 2 years have elapsed
1. from the acquisition of ownership to a family house with one first owner;
2. from the acquisition of ownership to the building in which the apartment is situated by the first owner, unless it is an apartment referred to in point 3;
3. from the date of the legal power of the approval decision, if it is an apartment which was created by a change in the completed construction,
4. from the date of the legal power of the approval decision, if it is a house with apartments and non-residential premises owned by a construction contract, '.
3. In the first sentence of Article 6 (2), the words "granted under newly concluded credit agreements with contributions under this Regulation and at the average rate of interest on the volume of loans granted to natural persons under concluded credit agreements supported under the special legislation on the promotion of mortgage loans for residential construction.2) 'are replaced by the words:
"(a) granted during the previous year on the basis of new credit agreements concluded and supported under this Regulation;
(b) supported under this Regulation, where the interest rate agreed with the mortgage bank has changed in the previous year;
(c) granted to natural persons on the basis of concluded credit agreements supported under a special legislation on the promotion of mortgage loans for residential construction, (2) which have had a change in the interest rate agreed with the mortgage bank in the previous year. ';
4. In Article 6 (2), the second and third sentences are referred to as paragraph 3.
Paragraphs 3 to 5 shall be renumbered paragraphs 4 to 6.
5. In Article 6 (4) and (6), "paragraph 2 'is replaced by" paragraphs 2 and 3';
6. In the first sentence of Paragraph 7 (1), the words' may not serve other purposes than 'shall be replaced by' must serve '.
7. In the first sentence of Article 8 (3), the words "after the termination of the contract 'are replaced by the words" after the completion of the drawing. "
Transitional provision
Legal relations arising under Government Decree No. 249 / 2002 Coll. before the date of entry into force of this Regulation and the rights and obligations arising therefrom shall be governed by existing legislation.
Efficacy
This Regulation shall enter into force on 1 February 2004.
