on the registration of accidents
According to § 137 (2) of Act No. 361 / 2000 Coll., on road traffic and on amendments to certain laws ("the Act '), the Ministry of Transport and Communications provides for the implementation of § 123 (5) of the Act:
Preliminary provisions
This decree implements the relevant European Union2 regulations and regulates the way in which records are kept in the register of accidents and details of data kept in the register of accidents.
Terms
For the purposes of keeping records of accidents, the following shall be considered:
(a) for a participant in a traffic accident, any person who was directly involved in a traffic accident at the time and place of the accident;
(b) for the person killed, the person who died in a car accident or following the consequences of a car accident but no later than 30 days after the accident;
(c) for severe injury, serious injury to health under a special law (1); for the purposes of data provision under European Union3), severe injury shall be considered to be serious injury to health according to the MAIS3 + scale;
(d) for minor injuries other than severe injuries, even if they do not result in incapacity for work;
(e) for damage caused by a vehicle or other property in or in connection with a car accident, the amount of which shall be determined by an estimate by the member of the Police of the Czech Republic, which shall clarify the accident.
Registration of accidents
The accident record contains data on traffic accidents reported by the Police of the Czech Republic, except those which are not obliged to notify the Police of the Czech Republic (4).
Registration of data on the accident participant
(1) An accident participant is always registered in the register of road accidents
(a) his age, sex and nationality;
(b) the status and behaviour of the participant at the time of the accident, including any influence on alcohol or other substance;
(c) the location of a participant in a vehicle at the time of the accident;
(d) the use of safety devices and restraint systems;
(e) the consequences of an accident on the life and health of the participant;
(f) provision of first aid;
(g) the method of release from the vehicle after an accident.
(2) In addition to the data referred to in paragraph 1, the following information shall be recorded on the driver involved in the accident:
(a) driving licences registered in his driving licence;
(b) the date of the first authorisation;
(c) the highest completed education;
(d) the status of the driver and external circumstances having an immediate impact on the behaviour of the driver at the time of the accident.
Registration of vehicle data
A vehicle that has participated in a car accident shall always be registered in the register of road accidents
(a) the type of vehicle;
(b) the State where the vehicle is registered;
(c) the factory mark, type and year of first registration of the vehicle;
(d) information on the manner and type of use of the vehicle;
(e) details of the validity of the technical inspection;
(f) specifying vehicle data, such as total mass and occupancy,
(g) additional information on the vehicle, such as the transport of dangerous or excessive cargo and the right of priority travel;
(h) the position of the vehicle on the road at the time of the accident, including any skid marks;
(i) the consequences of a vehicle and cargo accident and an estimate of the damage.
Registration of infrastructure information at the place and time of the accident
The road communication at the scene of the accident is registered
(a) category, class, road number marking and number of road lanes;
(b) further specifying the location of the accident, such as the identification of the intersection, the road kilometre, the traffic restricted zone;
(c) the construction and transport technical condition of the infrastructure;
(d) the nature and state of the road surface;
(e) the location of a road accident;
(f) a firm obstacle.
Registration of time, location and additional data on a car accident
The accident is always registered
(a) the territorial unit, the coordinates of the global navigation satellite system of the accident site, the date and time of the accident;
(b) the type of accident, such as a collision with a moving vehicle, a parked vehicle, a fixed obstacle, a pedestrian, a cyclist or an animal;
(c) the type of collision of riding vehicles, such as front, side, rear;
(d) the fault of the accident;
(e) the main causes of the accident, such as excessive driving speed, incorrect overtaking, lack of priority in driving, incorrect driving or technical failure of the vehicle;
(f) weather conditions at the scene of the accident;
(g) visibility and visibility at the scene of the accident;
(h) traffic management on the road,
(i) specific locations and objects at the scene of the accident.
Means of keeping records of accidents
Registration of accidents shall be carried out in electronic form.
Final provision
Efficacy
This decree shall take effect on the day of its publication.
