amending Decree No. 129 / 2012 Coll., on details of the marketing of seed and planting plants, as amended

The Ministry of Agriculture shall determine pursuant to § 3 (14), § 3a (11), § 3b (7), § 5 (8), § 7 (6), § 7a (5), § 15 (6), § 16 (12), § 17 (16), § 19 (17) and § 19a (6) of Act No. 219 / 2003 Coll., on the putting into circulation of seeds and propagating plants and on the amendment of certain laws (Act on the circulation of seeds and propagating plants), as amended by Act No. 178 / 2006 Coll., Act No. 96 / 2009 Coll., Act No. 223 / 2009 Coll., Act No. 331 / 2010 Coll., Act No. 54 / 2012 Coll., and Act No. 295 / 2017 Coll.:

Čl. I

Decree No. 129 / 2012 Coll., on details of the marketing of seeds and propagating plants, as amended by Decree No. 409 / 2013 Coll., Decree No. 368 / 2015 Coll., Decree No. 334 / 2017 Coll. and Decree No. 299 / 2018 Coll., is amended as follows:

1. At the end of footnote 1, the sentence "Commission Implementing Directive (EU) 2019 / 990 of 17 June 2019 amending the list of genera and species referred to in Article 2 (1) (b) of Council Directive 2002 / 55 / EC, Annex II to Council Directive 2008 / 72 / EC and the Annex to Commission Directive 93 / 61 / EEC shall be added to separate rows. Commission Implementing Directive (EU) 2020 / 177 of 11 February 2020 amending Council Directives 66 / 401 / EEC, 66 / 402 / EEC, 68 / 193 / EEC, 2002 / 55 / EC, 2002 / 56 / EC and 2002 / 57 / EC, Commission Directives 93 / 49 / EEC and 93 / 61 / EEC and Implementing Directives 2014 / 21 / EU and 2014 / 98 / EU as regards harmful plant organisms on seeds and other plant propagating material. Commission Implementing Directive (EU) 2020 / 432 of 23 March 2020 amending Council Directive 2002 / 55 / EC as regards the definition of vegetables and the list of genera and species in Article 2 (1) (b). Article 2

2. Paragraph 2 (2) reads as follows:

"(2) Where propagating material put into circulation under Article 3 (2) of the Act contains an ingredient of a genetically modified organism authorised for cultivation in the European Union, such seed shall be referred to as" GMO '. A maximum statistical tolerance of 0,1% shall be allowed for the result of the control test.';

3. In Paragraph 8 (3), the first sentence is replaced by the following: "The crop must be practically free of all harmful organisms which reduce the use value and quality of the seed. The crop shall also comply with the requirements concerning quarantine harmful organisms (" KSO ') for the European Union, the regulated non-quarantine harmful organisms of the European Union ("RNSO') and, where applicable, the KSO for protected zones set out in the implementing acts of the European Union adopted pursuant to Regulation (EU) 2016 / 2031 of the European Parliament and of the Council, as amended. ';

"(5) Regulation (EU) 2016 / 2031 of the European Parliament and of the Council of 26 October 2016 on protective measures against harmful organisms of plants, amending Regulations (EU) No 228 / 2013, (EU) No 652 / 2014 and (EU) No 1143 / 2014 of the European Parliament and of the Council and repealing Council Directives 69 / 464 / EEC, 74 / 647 / EEC, 93 / 85 / EEC, 98 / 57 / EC, 2000 / 29 / EC, 2006 / 91 / EC and 2007 / 33 / EC, as amended. ';

4. In Article 9 (2), after the first sentence, the sentence "The seed must be free of all harmful organisms which reduce the use value and quality of the seed. The seed shall also comply with the requirements relating to the KSO for the European Union, the RNSO and, where applicable, the KSO for protected zones laid down in the implementing acts adopted pursuant to Regulation (EU) 2016 / 2031 of the European Parliament and of the Council, in its version 5, and the measures adopted pursuant to Article 30 (1) of Regulation (EU) 2016 / 2031 of the European Parliament and of the Council, as amended. ';

5. Paragraph 15 (3) and (4) reads as follows:

"(3) The supplier of the mixture shall keep a record of:

(a) mixing of a mixture in the form of a mixing protocol, a specimen of which appears in Annex 9 to this Decree, and sends it by means of remote transmission to the Institute for inspection immediately after mixing; and

(b) the putting into circulation of the mixture, mutatis mutandis, as the register referred to in Article 9 (4) submitted by the Institute for inspection on request.

(4) The Institute at the point of mixing of seed mixtures shall carry out a check on the keeping of records of those mixtures and the mixing protocols referred to in paragraph 3 and take a sample for subsequent inspection from those lots of mixtures which are in stock at the time of the check. The frequency of these checks and sampling shall be determined by the volume of production in the establishment concerned. The Institute shall carry out a follow-up check on these samples, which shall be at least 5% of the number of lots produced in the calendar year. The precise scope of the audit shall be determined by the Institute in accordance with the results of the previous year. Suppliers shall be informed in writing of the results of the check. ';

6. In Article 15, the following paragraph 7 is added:

"(7) Where the mixture contains a species for which requirements for RNSO are laid down, the official label shall be accompanied by a plant passport. '

7. Under the heading of Section 16, the words ", § 5 (8) (d) and (h) and § 7 (6) (a) 'shall be inserted after the words" Article 12b (6)'.

8. In Article 16 (2), the words "the characteristics of the crop and the requirements' shall be inserted after the words" the requirements'.

9. In Article 19 (1), the first sentence is replaced by the following: "The vegetable seedlings shall meet the requirements concerning KSO for the European Union, RNSO and, where applicable, KSO for protected zones laid down in the implementing acts adopted pursuant to Regulation (EU) 2016 / 2031 of the European Parliament and of the Council, as amended, in its version 5), and the measures adopted pursuant to Article 30 (1) of Regulation (EU) 2016 / 2031 of the European Parliament and of the Council. ';

10. in Paragraph 19 (4), point (j) shall be deleted;

Points (k) and (l) shall become points (j) and (k).

11. Paragraph 19 (5), including footnote 6, reads:

"(5) The propagating material of vegetable seedlings shall be accompanied by a plant passport complying with the requirements laid down in the directly applicable European Union Regulation (6), except for vegetable seedlings supplied directly to the final consumer, in accordance with Regulation (EU) 2016 / 2031 of the European Parliament and of the Council (5). In the case of distance contracts and sales to protected zones, the plant passport shall always be attached.

6) Commission Implementing Regulation (EU) 2017 / 2313 of 13 December 2017 laying down the formalities for the plant passport for movements within the Union and the plant passport for imports into and movement within the protected zone. '.

12. In Article 19, the following paragraph 6 is added:

"(6) The plant passport may replace the particulars referred to in paragraph 4 (b), (d) and (k). The plant passport elements shall be framed or otherwise clearly separated from other text or image elements in order to be easily visible and clearly distinguishable. ';

13. in Paragraph 20 (1) (c), the words "the Plant Health Act (2)" are replaced by the words "the directly applicable European Union Regulation (5)."

footnote 2 is deleted.

14. in Paragraph 22 (1) (a), "9" is replaced by "10."

15. in Article 24 (1) (b), the words "Annex No 20 to this Order" shall be replaced by the words "a model of which appears on the Institute's website."

16. In Article 24 (2), the words "and the models of the labels are indicated 'are replaced by the words" is indicated' and at the end of the paragraph the sentence "The models of the labels are shown on the Constitution's website 'is added.

17. in Article 24 (6), the words "or plastic" shall be added at the end of the text of point (a).

18. In Paragraph 25, at the end of paragraph 1, the sentence "The name and address of the supplier shall be optional for the official label and, if indicated, shall be in the unofficial part of the label. ';

19. Paragraph 25 (4) reads:

"(4) The labels for international trade referred to in Article 24 (1) (b) shall contain:

(a) the designation of the International Seed Testing Association or the Organisation for Economic Cooperation and Development;

(b) the designation of the Constitution and the Czech Republic,

(d) the variety name,

(e) seed category,

(f) lot number,

(g) date of sampling;

(h) weight per package,

(i) the country of manufacture;

(j) the label number. ';

20. in Articles 25 (5) and 26 (6), the words "Annex 20 to this Decree" shall be replaced by the words "on the Institute's website."

21. in Paragraph 25, the following paragraph 7 is added:

"(7) For those species for which an obligation to procure propagating material with a plant passport is laid down in implementing acts adopted pursuant to Regulation (EU) 2016 / 2031 of the European Parliament and of the Council, in the version in force, 5, the official label or label of the supplier must be accompanied by a plant passport which meets the requirements laid down in the directly applicable European Union Regulation (6).";

22. In Article 27, the following paragraph 3 is added:

"(3) In the case of small packages for species for which the implementing acts adopted pursuant to Regulation (EU) 2016 / 2031 of the European Parliament and of the Council, in the version in force (5), provide for the obligation to procure propagating material with a plant passport, a plant passport complying with the requirements laid down directly by the European Union6 Regulation shall be attached, unless it is a direct supply to the final consumer. In the case of distance contracts and sales to protected zones, the plant passport shall always be attached. The plant passport elements shall be framed or otherwise clearly separated from other text or image elements in order to be easily visible and clearly distinguishable. ';

23. In Annex No 1, Part III, in note 3, the words "and sorghum 'are replaced by the words", sorghum and millet'.

28 - Seeds of winter cereals intended for sowing in the year of harvest max. 17,0%, seed of spring cereals intended for sowing in the next growing season after the year of harvest maximum 16%.

30 - In 1000 g of wheat, not more than 100 grains of wheat in plums.

31- In the case of barley, not more than 1% of grain with a pain longer than the length of the grain.

32 - In oats, not more than 5% of the grain in the pods.

33 - Content of other varieties with different grain colour in 1000 g: for oats cut in category SE, E 20 pcs, in category C1 60 pcs, in category C2 200, for millet SE, E 10 pcs, in category C1 50 pcs.

34 - The limit values for harmful organisms are given in Table 5.3.

35- In the case of category C naked barley seed, the minimum germination capacity shall be reduced to 75% if the germination capacity is found to be less than 85% when testing naked barley seed, the official label shall bear the words "Germination capacity at least 75% '.

36 - The presence of a second seed of another type of cereal in a sample of the prescribed weight shall not be considered as impurity if no seeds of other cereal species are present in the second sample of the same weight.

37 - The presence of one seed of one of the species listed in column 10 of the sample with the prescribed weight shall not be considered as impurity if no seeds of those species are present in the other sample with the same weight.

38 - In the case of mixtures limited by zero, the presence of one piece shall be considered random and shall not be considered, except for canary seed.

39 - The seed must correspond with its appearance to purified seed.

The proportion of the bottom under the sieve with holes of dimensions as defined in Table 5.2b may not exceed 3%

1. During the show, the unremoved mother tubers and the unremoved new seed tubers are assessed as a plant with symptoms of virus infestation.

2. In the case of selection by postponement, when live non-winged aphids are present, each of the selected thorns left in the crop is assessed as a plant with symptoms of virus infestation.

3. The maximum levels for the occurrence of symptoms of virus infestation apply only if they are viral diseases caused by viruses common in Europe.

4. In the event of the presence of Stolbur potato in the crop, all plants at the production site showing symptoms must be plucked and destroyed including subsidiary tubers and for all seed potatoes where symptoms have been observed in the crop, tubers must be tested for each lot after harvesting to confirm the absence of Candidatus Phytoplasma solani.
