DECLARATION
Ministry of Foreign Trade
of 14 February 1964
on export procedure
The Ministry of Foreign Trade sets out, pursuant to § 1 and § 28 paragraph 2 of Act No. 119 / 1948 Coll., on the State Organisation of Foreign Trade and International Shipbuilding, and § 5 paragraph 1 of Customs Act No. 36 / 1953 Coll.:
§ 1
Commercial exports by foreign trade undertakings
When exporting goods to which foreign trade undertakings are authorised, those undertakings shall proceed in accordance with specific rules. *)
Other exports
§ 2
Exports of gifts in kind, moved uppers and other goods for non-commercial purposes without payment from abroad are permitted only on the basis of an export authorisation granted by the customs authorities concerned (customs turnover).
§ 3
(1) It is for the customs and customs turnover listed in Annex No 1 to decide on applications for export authorisations pursuant to Article 2.
(2) Exports of gifts and other goods in kind for non-commercial purposes may also be authorised by customs and customs diversions operating at border crossing points in so far as they are foreign nationals resident abroad who do not submit export authorisations for exported goods when leaving the CSSR.
§ 4
(1) An application for an export authorisation may be made only on the prescribed form; * * *) one application may relate to only one export case.
(2) There is no legal right to grant an export authorisation.
(3) The export authorisation is non-transferable. It shall be valid for one month from the date of issue and may, where appropriate, be extended for a further one month.
§ 5
The export authorisation shall be presented to the customs office (customs turn) which shall discuss the matters when they arrive abroad or before their admission to transport abroad; the customs office (customs turn), after the customs clearance has been cleared, shall withdraw or add to the transport document.
§ 6
For exceptional reasons, the export authorisation may be replaced by a specific dimension of the Ministry of Foreign Trade - Central Customs Administration.
§ 7
Exports of goods or goods not covered by the provisions of Sections 1 to 6 and 10 of this Decree shall be prohibited without the permission of the Ministry of Foreign Trade.
§ 8
An administrative fee shall be levied for the authorisation of exports in cases provided for in specific provisions. +)
Common and final provisions
§ 9
This decree does not apply to exports of precious metals, precious stones, pearls and their products, which are regulated by foreign exchange regulations. + +)
§ 10
The goods and goods listed in Annex 2 may be exported without the authorisation otherwise required under this Order.
§ 11
Where the export of certain goods or goods requires authorisation under other regulations (e.g. veterinary regulations, the protection of cultural monuments, etc.), such authorisation, unless otherwise provided, must already be attached to the application for export authorisation under this Order.
§ 12
(1) The following shall be deleted:
(a) Decree No 1277 / 1947 of the Ministry of Foreign Trade, on the control of exports of goods, as amended by Decree No 90 / 1949 of the Ministry of Foreign Trade, Ú. l.
(b) Decree No 47 / 1954 of the Minister for Foreign Trade, Ú. l. (No 62 / 1954 Ú. v.) on the control of exports of gifts in kind and of the uppers moved;
(c) Part III of the Annex to Decree No 7 / 1965 Coll., on the organisational network of customs and their responsibilities.
(2) By the date of application of this Decree, the provisions of Decree No. 113 / 1945 of the President of the Republic, on the modification, management and control of foreign trade, are hereby repealed within the meaning of Article 28 (2) of Act No 119 / 1948 Coll..
§ 13
This Decree shall take effect on 1 March 1964.

Annex No 2.
Without authorisation under Sections 2, 6 and 7 of the Order, the following may be exported:
1. Gifts, orders, honours, honorary prizes etc. awarded abroad by Czechoslovak authorities or Czechoslovak public officials.
2. Items exported by the Czechoslovak authorities for service reasons.
3. Matters exported by authorities and persons enjoying diplomatic privileges and immunities in the Czechoslovak Socialist Republic if they are service items (including commercial samples exported by trade representatives) or the personal property of those persons.
4. Re-exported goods imported into the domestic circulation and exported to the external circulation.
5. Returned packaging and packaging where the goods were imported.
6. Rakvas with human remains, urn with ash and floral ornaments with them or additionally balanced.
7. All advertising items, magazines and publications promoting Czechoslovak products and foreign and tourism in Czechoslovakia.
8. Means of transport by passenger and freight, the temporary importation and export of which is regulated by customs regulations, *) including spare parts and fuel and lubricating substances in a quantity of reasonable consumption per journey.
9. Gift consignments of commonly published books and other publications worth up to 100, - Kčs.
10. Gift consignments of up to 100, - Kčs determined as required by the Ministry of Foreign Trade - Central Customs Administration (the conditions can be met at each customs office or customs turn).
11. Postal stamps and stationery when exported according to the regulations on the arrangements for exchange and collection with foreign persons. * *)
12. Consignments of used Czechoslovak postage stamps and stationery, if they are sent in separate letters; one consignor may send a maximum of three consignments within one calendar year. The value of one consignment may not exceed 20 CZK and the consignment may contain a maximum of 100 pieces of different stamps or stationery (with closer conditions can be met for each customs or customs turn).
13. Travel needs of passengers and crew members of means of transport where the type and quantity of such needs correspond to the status and personal circumstances of the passenger and the length and purpose of the journey.
14. Goods exported in the course of travel (excluding border traffic and border tourism), provided that their total value does not exceed 300 CZK for one passenger and, in the case of goods whose exports are covered by the Ministry of Foreign Trade - Central Customs Administration, in agreement with the participating central authorities, provides for special export conditions (the conditions can be met for each customs and customs digress).
15. Cases which are exempt from export authorisation on a reciprocal basis under international agreements and arrangements.
