DECLARATION
of 12 May 2004
amending Decree No. 205 / 1999 Coll., implementing Act No. 168 / 1999 Coll., on insurance of liability for damage caused by the operation of a vehicle and amending certain related acts (Act on Insurance of Liability from the operation of a vehicle), as amended by Decree No. 429 / 2002 Coll.
The Ministry of Finance provides pursuant to § 3 (1), § 6 (4), § 13 (1) and § 14 (3) of Act No. 168 / 1999 Coll., on insurance of liability for damage caused by the operation of a vehicle and on the amendment of certain related laws (Act on Insurance of Liability from the Operation of a Vehicle), as amended by Act No. 47 / 2004 Coll.:
Decree No. 205 / 1999 Coll., implementing Act No. 168 / 1999 Coll., on insurance of liability for damage caused by the operation of a vehicle and amending certain related acts (Act on Insurance of Liability from the operation of a vehicle), as amended by Decree No. 429 / 2002 Coll., is amended as follows:
1. in Paragraph 1 (1) (b), the words "trade name" shall be replaced by the words "business name";
2. in Paragraph 1 (1) (d), the words "trade name" shall be replaced by the words "business name."
3. Paragraph 1 (2) reads as follows:
"(2) The model of the proof of liability insurance is set out in the Annex to this Order. '

Forms of the frontier insurance document
(1) The proof of liability for damage caused by the operation of a foreign vehicle (the "frontier insurance document") shall include the following particulars:
(a) the insurance contract number;
(b) the name and registered office of the Czech Insurers' Office ("the Office"),
(c) the name and, where applicable, the name and surname of the policy holder, the address, the State of permanent or long-term residence, the date of birth, the passport number and the State in which it was issued;
(d) the name and surname of the natural person or business company or the name of the legal person who owns the vehicle;
(e) the address and country code of the person who owns the vehicle;
(f) the type of vehicle, its registration number and the distinguishing mark of the State of registration of the vehicle, if the registration number has not been assigned, the international identifier for the marking of the vehicle, or if it has not been assigned, the chassis number or, if not assigned, the engine number, the factory mark and the vehicle type, the total mass of the vehicle and the number of seating positions;
(h) start and end of insurance,
(i) the amount of the premium, the date and manner in which it is paid;
(j) the stamp and signature of the person authorised to act on behalf of the Office and the signature of the policy holder.
(2) The frontier insurance document must be completed legibly. In the case of manual filling, the entry shall be done by pen or ballpoint pen.
(3) A proof of frontier insurance may be issued in a language other than the Czech language, in particular in the English, French, German and Russian languages. "
5. in Article 3 (a):
"(a) the name and, where appropriate, the name, surname, birth number or date of birth and the place of permanent or long-term residence of the natural person or of the commercial firm or the name and registered office of the legal person as a policy holder; where the owner, holder or operator of the vehicle is not the same person as the policyholder, the certificate and the particulars of those persons shall be provided, according to the vehicle technical licence, ';
6. In Article 3 (b), the words "trade name 'are replaced by the words" business name'.
7. in § 3 (d) to (g):
"(d) the number of the insurance contract, the duration of the latter and the total duration of the liability insurance, including the duration of the liability insurance, as evidenced by the latter;
(e) information on claims arising during the life of the insurance policy under the insurance contract referred to in (d), in particular their number, indicating the date of the occurrence of the event;
(f) the information referred to in point (e) relating to claims arising from previous liability insurance events reported in previous certificates of the duration of the insurance broken down by period of individual liability insurance, specifying the name of the relevant insurer;
(g) the date and reason for the expiry of the last valid liability insurance, ';
8.
List of foreign States
Outside the territory of the Czech Republic, other Member States of the European Union and other States forming the European Economic Area, liability insurance shall cover damage caused by the operation of domestic vehicles on the territory of Albania, Andorra, Bosnia and Herzegovina, Bulgaria, the former Yugoslav Republic of Macedonia, Croatia, Monaco, Romania, San Marino, Serbia and Montenegro, Switzerland, Turkey, Ukraine and the Vatican. '
9. Annex No 2 is deleted.
This decree shall take effect on the day of its publication.
