GOVERNMENT REGULATION
of 12 October 2022
providing for an exception to the non-acceptability of applications for residence permits in the Czech Republic lodged at representative offices
The Government hereby orders, pursuant to Paragraph 5a (2) of Act No. 65 / 2022 Coll., on certain measures relating to armed conflict in the territory of Ukraine caused by the invasion of Russian troops, as amended by Act No. 175 / 2022 Coll., hereinafter referred to as "the Act ':
Paragraph 5a (1) of the First Law does not apply to a request for
(a) award
1. a short-stay visa, if the applicant is a family member of a European Union citizen pursuant to § 15a (1) or (2) of the Act on the residence of foreigners in the Czech Republic and following such a citizen;
2. long-stay visas for family purposes,
3. diplomatic or special visa pursuant to § 40 of the Act on the residence of foreigners in the Czech Republic,
4. long-stay visas, if the applicant is a family member of the holder of a diplomatic or special visa pursuant to § 40 of the Act on the residence of foreigners in the Czech Republic; or
5. exceptional work visa pursuant to § 31a of the Act on the residence of foreigners in the Czech Republic, if the applicant resides in Ukraine,
(b) issuing a long-term residence permit for the purpose of:
1. family co-existence in the territory under Section 42a of the Act on the residence of foreigners in the Czech Republic,
2. scientific research under Section 42f of the Act on the residence of foreigners in the Czech Republic,
3. the pursuit of employment pursuant to § 42g of the Act on the residence of foreigners in the Czech Republic by a citizen of Ukraine who is a member of a government approved programme and has not been granted temporary protection or international protection by the Czech Republic; or
4. employment in accordance with § 42i or 42k of the Act on the residence of foreigners in the Czech Republic, served by a citizen of Ukraine who has not been granted temporary protection or international protection by the Czech Republic,
(c) the granting of a residence permit for the purposes of studies under § 64 (a) and (d) of the Act on the residence of foreigners in the Czech Republic,
(d) the granting of a residence permit if the residence of the applicant is in the interests of the Czech Republic; or
(e) the issue of permanent residence permits by foreigners with established Czech origin, living abroad, pursuant to § 66 (1) (b) of the Act on the residence of foreigners in the Czech Republic.
(1) This Regulation shall enter into force on the day following that of its publication.
(2) This Regulation shall expire on the date on which Article 5a of the Act expires.
